SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104

LIMITED SOURCE JUSTIFICATION FOR FSS ORDER (above SAT)

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: This is a Limited Source Justification. The requiring activity is the Center for Security Forces (CENSECFOR); the contracting activity is Fleet Logistics Center Norfolk, VA.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This acquisition is conducted under the authority of the Multiple Award Schedule Program (Title 41 U.S.C. 152 (3) and Title 40 U.S.C. 501, Services for Executive Agencies). This is a limited source action to be awarded as a new Federal Supply Schedule order identified in paragraph 3 below. The placement of a firm, fixed price order with Controlled F.O.R.C.E., Inc. is anticipated.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is to train and certify CENSECFOR self-defense instructors in a Navy mandated self-defense system.

CENSECFOR requires qualified/certified instructors to provide self-defense (SD) and non-lethal weapons (NLW) training and certification for personnel at CENSECFOR Commands, Detachments, and Learning Sites located in San Antonio, TX; Chesapeake, VA; San Diego/Miramar, CA; Mayport, FL; Bangor, ME; Groton, CT; Pearl Harbor, HI; and Yokosuka, Japan. This process will enable CENSECFOR instructors to train and certify students in SD and NLW mission areas of Master-at-Arms (MA); Law Enforcement (LE); Corrections; Anti- Terrorism (AT); Reaction Forces (RF); Visit Board Search and Seizure (VBSS); AT Training Supervisor (AT TRASUP), and NLW Basic Instructor (NLWBI).

The anticipated contract will include a one-year base period and four, one-year options. The Independent Government Estimate (IGE) for this requirement is $1,020,002.00. Performance start dates and amounts are detailed in the below table:

4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR

DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 or 8.405-2 is 41 U.S.C. 251, as implemented by FAR 8.405-6.

The proposed requirement is to acquire CENSECFOR self-defense system instructor training and certification in Mechanical Advantage Control Holds (MACH), which is the backbone of the Controlled F.O.R.C.E. training system and provides the trainee with continued progression in

SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104 defensive tactics training. MACH and the Controlled F.O.R.C.E. training system have been developed and taught so as to ensure a high level of retention for all trainees.

Pursuant to OPNAVINST 5530.14E w/ CH-3, Navy Physical Security and Law Enforcement Program, dated 20 Nov 2017 and NTTP 3-07.2.1, Antiterrorism, dated June 2010, CHAPTER 9, Self-Defense, the DOD standard of training for SD and NLW must utilize MACH training which is proprietary content of Controlled F.O.R.C.E, Inc. The vendor is the developer and sole source provider of the training system. The system is the solely approved technique used throughout the DOD for SD and NLW.

5. DETERMINATION OF THE BEST VALUE: GSA has determined the prices of fixed-price services, of the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contract. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs.

Per FAR 8.404 (d) DEVIATION, Fleet Logistics Center Norfolk, Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order.

6. DESCRIPTION OF MARKET RESEARCH: The requiring activity and contracting activity have conducted market research among schedule holders. Initial market research included internet searches which revealed no additional suppliers with the approved MACH certification. Controlled F.O.R.C.E. is the developer and sole source provider of the training system offering renewed certification. Further research revealed these training services are regularly bought and sold in the commercial marketplace; therefore, the requirement meets the definition of a commercial item. Additional research included a review of the GSA eLibrary website, which revealed the required MACH training is available from only on source via GSA:

Controlled F.O.R.C.E. (GS-07F-0613W).

The market research determined the required MACH training is available from only one source:

7. ANY OTHER SUPPORTING FACTS: This procurement uses a GSA Schedule and will be solicited and awarded in accordance with FAR Subpart 8.4.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: For the aforementioned reasons and those set forth in Paragraph 4, NAVSUP FLC Norfolk will solicit Controlled F.O.R.C.E., Inc. If another potential source emerges, NAVSUP FLC Norfolk will assess whether competition for future requirements is feasible. All future requirements will be handled on a case-by-case basis.
