The completion and submission of the above as called for herein will constitute an offer (proposal) and will be considered the offeror’s unconditional assent to the terms and conditions of this solicitation and any attachments and/or exhibits hereto. Alternate proposals are not authorized. An objection to any of the terms and conditions of the solicitation will constitute a deficiency (see FAR 15.001) which will make the offer unacceptable.
Non-price Proposal Information
This volume shall address compliance with solicitation factors, capacity/delivery, relevant Past Performance and include all information required for proposal evaluation.
In making such submission, the offeror shall utilize Attachment B Past Performance Information Form. This volume of the proposal shall exclude any reference to the price aspects of the proposal.
Capacity should be presented in the form of Repair Turnaround Time (RTAT) and Throughput Constraint.
Repair Turnaround Time (RTAT) definition: The contractual delivery requirement is measured from asset acceptance under the terms of the contract. For purposes of this section, Return is defined as physical receipt of the F-condition asset at the contractor’s facility as reflected in the Action Date entry in the Commercial Asset Visibility (CAV) system. In accordance with the CAV Statement of Work, the contractor is required to accurately report all transactions by the end of the fifth regular business day after receipt and the Action Date entry in CAV must be dated to reflect the actual date of physical receipt. RTAT day count begins on the date of induction.
Throughput Constraint: Total assets to be repaired monthly after initial delivery commences.
A more detailed delivery schedule will be made at award based on award date, RTAT, awardee’s proposal information and assets ready to ship.
Price/Cost Proposal Information This informaton shall include the completed solicitation documents or a quote containing substantially similar information.
IMPORTANT NOTES:
(1) The price/cost proposal shall support the Non-price proposal. Offerors are cautioned not to alter the solicitation.
(2) In the event any person who is not a bona fide employee of the offeror participated in the creation, formulation, or writing of any portion of the proposal, a certificate to this effect shall be included in the proposal which shall be signed by an officer of the offeror. Such certificate shall identify the name of the person who is not a bona fide employee, that person’s employment capacity, the name of the person’s firm, the relationship of that firm to the offeror, and the portion of the proposal in which the person participated.
II. REQUIREMENTS FOR PROPOSAL CONTENT
(1) Any offeror who will be submitting CLASSIFIED data in its Non-price proposal shall first notify the Contracting Officer by contacting the point of contact in the solicitation. CLASSIFIED data that is forwarded as part of an offeror’s proposal shall be housed in its own binder, separate from the unclassified portion.
(2) Introduction and Purpose - This section specifies the format that offerors should use in proposals submitted in response to this solicitation. The intent is not to restrict the offerors in the manner in which they will perform their work but rather to ensure a certain degree of uniformity in the format of the proposals for evaluation purposes.
(3) Requirements for Style: Each offeror shall submit a proposal that clearly and concisely sets forth the contractor’s response to the requirements of the solicitation. Unnecessary elaboration or other presentations beyond that sufficient to present a complete and effective proposal are not desired and may be construed as an indication of the offeror’s lack of cost consciousness. Elaborate artwork, expensive paper or bindings, and expensive visual or other presentation aids are neither necessary nor desired. The proposal shall contain all the pertinent information in sufficient detail in the one area of the proposal where it contributes most critically to the discussion. When necessary, the offeror shall refer to the initial discussion and identify its location within its proposal.
III. PROPOSAL CONTENT
1. Non-price Proposal Information
The non-price proposal is based on compliance with the solicitation requirement, capacity/delivery, and past performance.
The following Technical Factors will be used to evaluate offers: Compliance with the solicitation requirements, Capacity/Delivery, Past Performance.
The Non-price evaluation factors are listed in detail below:
(a) Compliance with the Solicitation Requirements
The Government will evaluate the offeror’s proposal and determine whether it complies with the requirements of the solicitation. Please note, compliance with terms of the solicitation includes, but is not limited to:
(1) Demonstrate Government Source Approval prior to award.
(2) Demonstrates an unconditional offer to perform. A proposal that offers alternative terms or takes exceptions to a solicitation requirement will be considered “technically unacceptable.”
Compliance with solicitation requirements will be as either acceptable or unacceptable. The proposal will only be further evaluated if it is rated as acceptable.
(b) Capacity/Delivery:
(c) Past Performance:
The offeror shall indicate its throughput constraint and repair turn around time (RTAT) to do the repairs hereunder in terms of number of repairs per month for throughput and calendar days for RTAT.
Contractor must notify the government in writing (including electronic commerce methods, such as email) when assets have been received upon physical receipt of the assets.
Throughput Constraint: Total assets to be repaired monthly after initial delivery commences.
The offeror shall indicate its capacity and repair turn around time (RTAT) to do the repairs hereunder in terms of output of RFI or “A” Condition items per month for each line item. The contractor shall do so by indicating such output figures in the chart below to this amendment. For example, if from a capacity standpoint, for Year 1, the first month’s throughput is estimated at 4 units, insert “4” in the corresponding block.
NIIN Throughput Constraint
Government’s Desired Throughput
RTAT Government’s Desired RTAT
016219050 1-2 units per month 120 calendar days
A more detailed delivery schedule will be made at award based on award date, RTAT, awardee’s proposal
The evaluation will consider capacity/delivery as important as past performance and price.
(c) Past Performance
The offeror should complete a “Past Performance Information Form” (Attachment B) for each reference submitted. The form is an attachment to the solicitation. For additional information regarding a particular reference beyond that which will fit on the form, the offeror may continue onto another sheet of paper. The offeror shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contacts or efforts (within the past three years) that is of similar scope, magnitude, and complexity to that which is described in the solicitation.
The evaluation will consider past performance as important as capacity/delivery and price.
3. Price/Cost Information
Price/Cost Information shall include the completed solicitation documents or a quote containing substantially similar information. The price/cost proposal shall support the Non-price proposal. If the price/cost proposal does not support the Non-price proposal, the offeror’s overall technical proposal rating may be downgraded. The price/cost proposal shall include all elements of cost and such other cost information as considered appropriate to support the offeror’s proposal. The evaluation of proposals will consider the offeror’s Non-price proposal as important as the offeror’s Price proposal.
(a) Each offeror shall identify in its pricing proposal if the offeror intends to obtain engineering support services from the government for efforts related to this procurement. NAVSUP WSS intends to identify the level of support, if any, provided to an offeror by the government in the past fiscal year and assign the appropriate monetary value associated with any engineering support provided to an offeror during that fiscal year. This value will then be added accordingly to the unit price per repair in order to ensure that each offeror’s price is evaluated equally.
The evaluation will consider price as important as capacity/delivery and past performance.
L10 – FAR 52.216-27 SINGLE OR MULTIPLE AWARDS (OCT 1995)
The Government may elect to award a single delivery order contract or to award multiple delivery order contracts for the same or similar supplies to two or more sources under this solicitation.
SECTION M – EVALUATION FACTORS FOR AWARD
M01 – FAR 52.247-47 EVALUATION – F.O.B ORIGIN (JUN 2003)
This clause of the Federal Acquisition Regulation set forth at FAR 52.247-47 is hereby incorporated by reference and made a part hereof with the same force and effect as if set forth in full.
M02 - EVALUATION CRITERIA AND BASIS FOR AWARD
The Government intends to award a contract resulting from this solicitation to the responsible offeror whose proposal represents the best value after evaluation in accordance with the factors in the solicitation. The offeror’s proposal shall contain a response to each of the areas identified in the Section L solicitation provision entitled “Submission of Proposals.” The evaluation of proposals will consider the offeror’s non-price factors as important as the offeror’s price factor.
The non-price evaluation factors are in compliance with the solicitation requirements, capacity/delivery, and past performance.
The evaluation of proposals will be as follows.
A. Factors and Evaluation
(1) Compliance with the Solicitation Requirements
The Government will evaluate the offeror’s proposal and determine whether it complies with the requirements of the solicitation. Please note, compliance with terms of the solicitation includes, but is not limited to:
1. Demonstrates Government Source Approval prior to award.
2. Demonstrates an unconditional offer to perform. A proposal that offers alternative terms or takes exceptions to a solicitation requirement will be considered “technically unacceptable.”
Compliance with solicitation requirements will be rated as either acceptable or unacceptable as shown in the table below The proposal will only be further evaluated if it is rated as acceptable.
Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation Unacceptable Proposal does not meet the requirements of the solicitation.
(2) Capacity/Delivery
Desired RTAT is 120 calendar days. RTAT is subject to negotiation if deemed necessary by the Contracting Officer. Justification for RTAT values exceeding 120 calendar days is strongly recommended and will be considered in evaluation.
Desired throughput constraint is 1-2 per month. Throughput is subject to negotiation if deemed necessary by the Contracting Officer. Justification for throughput constraint values below those desired is strongly recommended and will be considered in evaluation.
Contractor must notify the government in writing (including electronic commerce methods, such as email) when assets have been received upon physical receipt of the assets. Assets must be inducted within 5 business days of physical receipt.
A more detailed delivery schedule will be made at award based on award date, RTAT, awardee’s proposal
The evaluation will consider capacity/delivery as important as past performance and price.
(2) Past Performance
In determining the rating for the Past Performance evaluation factor, the Government will give greater consideration to the contracts or efforts which the Government considers most relevant to the RFP. Relevant past performance is performance under contracts or efforts (within the past three years) that is of similar scope, magnitude, and complexity to that which is described in the solicitation.
Relevancy will be rated based on the ratings in the table below:
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance. However, the proposal of an offeror with no relevant past performance history, while not rated favorably or unfavorably for past performance, may not represent the most advantageous proposal to the Government and thus, may be an unsuccessful proposal when compared to the proposals of other offerors.
The offeror should provide the information requested above for past performance evaluation, or affirmatively state that it possesses no relevant directly related or similar past performance. If an offeror fails to provide any past performance information which is similar in scope, magnitude and complexity to that which is detailed in the RFP or fails to affirmatively state that it possesses no relevant directly related or similar past performance, the offer may not be awardable.
The Government will consider the quality of offeror’s past performance. This consideration is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s past performance will be used as a means of evaluating the relative capability of the offeror and other competitors to successfully meet the requirements of the RFP.
When an offeror is determined to have relevant past performance, the quality of its past performance will be evaluated; an offeror whose past performance demonstrates either a low expectation or no expectation that the offeror will be able to successfully perform the required effort will be considered ineligible for award. The ratings shown in the table below will be used:
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort
Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
(3) Price
Price will be evaluated on the basis of price analysis. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer and will be based on the evaluated standard repair price of all items listed. The Government reserves the right to award the contract to other than the lowest priced offeror.
The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and non-price standpoint. However, the Government reserves the right to conduct discussions if later it is determined by the Contracting Officer to be necessary or in the Government’s best interests.
The Contracting Officer reserves the right to determine that the offeror’s overall firm fixed price proposal represents an unacceptable level of risk, based on the information submitted by the offeror.
A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer or no fewer than 10 business days, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
