The requirement is for five units of FCDC (Model N/A, Drawing 857AS500-5, National Stock Number 1377-00-409-1099) used in the emergency canopy removal system of AH-1J/W/Z Cobra helicopters. The items are designated as Critical Safety Items and must comply with specifications AS 4563 and AS4563 SCN2, with data list DL857AS500 revision P dated 27 JUN 95. Delivery is required within 45 calendar days from the date of award to Naval Surface Warfare Center Indian Head Division (DoDAAC N3724E) in Indian Head, Maryland.

The procurement is not a small business set-aside and is subject to extensive federal compliance requirements including CMMC Level 2 (C3PAO) cybersecurity certification, ISO-9001:2015 quality standards, and DFARS regulations governing ammunition and explosives. Specific requirements include unique item identification (UID) marking in accordance with DFARS 252.211-7003, adherence to MIL-STD-1168 for lot numbering, and compliance with DoD Manual 4145.26 for safety precautions. Energetic materials cannot exceed 24 months from manufacturing or retest date, with raw ingredients limited to 12 months. All packaging, marking, and transportation must comply with MIL-STD-129, MIL-STD-2073, and CFR 49 requirements. The award will be made to the eligible, responsible offeror whose conforming offer is most advantageous to the Government, with past performance in quality and timeliness of delivery evaluated as non-price factors.

The shipping container will normally be the outer container.

The Contractor shall ensure one of the below traceable seals are properly affixed depending on the type of shipping container.

a. Type 1 TRACEABLE SEALS (WIRE SEALS): Type 1 seals are the preferred seals for containers having provisions or means for application of the seals, e.g., metal, plastic, fiberglass, or wood containers with lids or hinged covers, latches, brackets or flanges. b. Type 2 SEALS (LABEL SEALS): Type 2 seals are the preferred seals for fiberboard or Styrofoam containers or for metal, plastic, fiberglass or wood containers that will not readily accept Type 1 seals. Type 2 seals are, typically, nonmetallic labels with pressure sensitive backing. They may be pre-printed, stamped or marked with a "U.S." symbol. Type 2 seals be shall applied such that the label must be cut or defaced in order to open a container. Adhesives adhere well enough to prevent shall peeling during shipping conditions and well enough to prevent lifting and replacement of the label. Particular consideration shall be given to label seals required to adhere to wood and fiberboard surfaces.

8. Restrictions Involving Non-Manufactured Wood Packaging (NMWP) and Pallets (per Defense Logistics Agency Directive subpart 47.305-1(c)(90): " wooden pallets and wood containers produced of non-manufactured wood be constructed All shall from Heat Treated (HT to 56 degrees Centigrade for 30 minutes) material and certified by an accredited agency recognized by the American Lumber Standards Committee (ALSC) in accordance with Non-manufactured Wood Packing Policy and Non-manufactured Wood Packing Enforcement Regulations, both dated May 30, 2001."

(a) . As used in this clause-Definition

Qualification requirement means a Government requirement for testing or other quality assurance demonstration that must be completed before award.

(b) One or more qualification requirements apply to the supplies or services covered by this contract. For those supplies or services requiring qualification, whether the covered product or service is an end item under this contract or simply a component of an end item, the product, manufacturer, or source must have demonstrated that it meets the standards prescribed for qualification before award of this contract. The product, manufacturer, or source must be qualified at the time of award whether or not the name of the product, manufacturer, or source is actually included on a qualified products list, qualified manufacturers list, or qualified bidders list. Offerors should contact the agency activity designated below to obtain all requirements that they or their products or services, or their subcontractors or their products or services, must satisfy to become qualified and to arrange for an opportunity to demonstrate their abilities to meet the standards specified for qualification.

If, after award, the Contracting Officer discovers that an applicable qualification requirement was not in fact met at the time of award, the Contracting Officer may either terminate this contract for default or allow performance to continue if adequate consideration is offered and the action is determined to be otherwise in the Government's best interests.

(e) If an offeror, manufacturer, source, product or service has met the qualification requirement but is not yet on a qualified products list, qualified manufacturers list, or qualified bidders list, the offeror must submit evidence of qualification prior to award of this contract. Unless determined to be in the Government's interest, award of this contract will not be delayed to permit an offeror to submit evidence of qualification.

(f) Any change in location or ownership of the plant where a previously qualified product or service was manufactured or performed requires reevaluation of the qualification. Similarly, any change in location or ownership of a previously qualified manufacturer or source requires reevaluation of the qualification.
