About this file
This file is an instruction document for Form 1295 compliance requirements issued by Region One Education Service Center in Texas, applicable to all vendors submitting proposals or contracts for state and local procurement opportunities, including the Child Nutrition Program - South Texas Cooperative Local Beef Products solicitation. All business entities must electronically complete, print, sign, and submit a Disclosure of Interested Parties - Form 1295 with their proposals or signed contracts, regardless of whether interested parties exist. Vendors are required to register and complete the form through the Texas Ethics Commission website at https://www.ethics.state.tx.us/filinginfo/1295/, include the proposal number and contract name with a service description, print the submitted form with its certification number, and submit the completed document as part of their proposal response.
The Form 1295 requirement stems from Texas House Bill 1295, which amended the Texas Government Code Section 2252.908 to mandate disclosure of interested parties. The document defines key terms including "business entity" (any for-profit or nonprofit entity conducting business with Region One ESC, excluding governmental entities), "controlling interest" (ownership or board membership exceeding ten percent or officer positions), and "intermediary" (persons receiving compensation while actively facilitating contract negotiations). Six exemptions exist to the requirement, including publicly traded business entities, utility contracts, sponsored research contracts, interagency contracts, health and human services contracts with undetermined values, and higher education contracts. The Texas Ethics Commission provides supplementary resources including instructional videos and frequently asked questions to assist vendors in Form 1295 completion and filing.
