About this file

This document consists of Form 1295 instructions issued by Region One Education Service Center in Texas, outlining compliance requirements for the Certificate of Interested Parties disclosure mandated by Texas House Bill 1295. All vendors submitting proposals or contracts to Region One ESC must electronically complete, print, and submit Form 1295 with their bid responses, regardless of whether interested parties exist. The form must be filed through the Texas Ethics Commission website at https://www.ethics.state.tx.us/filinginfo/1295/, and vendors must include a printed copy bearing the certification number with their proposals. The submission applies specifically to the Bank Depository Services contract opportunity, which seeks to establish a responsible depository to provide banking services and potential partnership with Region One ESC as the primary depository.

The instructions define key terms governing Form 1295 compliance, including "business entity" (any entity conducting business with Region One ESC, excluding governmental entities), "controlling interest" (ownership or participation exceeding 10 percent, board membership in entities with ten or fewer members, or officer status), and "interested party" (persons with controlling interest or intermediaries who facilitate contract negotiation and receive compensation). Form 1295 requirements apply to all business entities and contain specific exemptions for sponsored research contracts, interagency contracts, certain health and human services contracts, publicly traded entities, electric utilities, and gas utilities. The Texas Ethics Commission has established supplementary resources including frequently asked questions and instructional videos to assist vendors with first-time registration and certificate creation.
