About this file

This is a public works solicitation issued by the Washington State Convention Center (a King County public facilities district), doing business as Seattle Convention Center (SCC), for exterior barrel vault recaulking services at the facility's Arch location in downtown Seattle. The project involves removing and replacing existing caulking and backer rod on a barrel vault glazing system comprising 416 glass panels (approximately 64" x 58" each) located in the skybridge area between grid lines N17 and N22. Prospective bidders were required to attend a mandatory pre-bid meeting and walk-through on Monday, March 23, 2026, at 11:00 AM at SCC's administrative offices (705 Pike Street, Seattle, WA 98101). Sealed bid proposals were due by 3:00 PM on Monday, April 7, 2026, submitted electronically through the SCC public procurement portal. Bid opening occurred via Microsoft Teams meeting on the same date. Substantial completion must be achieved by August 5, 2026, with all equipment removal required by end of day on the substantial completion date. The scope of work requires removal of all existing caulking and backer rod, cleaning and preparation of all joint areas, installation of new backer rod matching existing profiles, and application of GE UltraGlaze SSG4000 silicone caulk in black color. Work is available 24 hours daily on the exterior area, though interior storage areas require clearance during the weekend of July 25–26 due to an internal event.

The estimated cost of work is $750,000. A bid guarantee equal to five percent of the base bid amount is required, acceptable in the form of a bid bond, postal money order, certified check, or cashier's check. No payment or performance bond is required if the contract sum is $150,000 or less. For contracts exceeding $150,000, AIA Payment Bond and Performance Bond forms (A312) covering 100 percent of the contract sum including all change orders and state sales tax are mandatory. The project is subject to Washington State prevailing wage requirements under Chapter 39.12 RCW, with the King County prevailing wage schedule effective April 7, 2026, provided in the specifications. MWBE voluntary participation goals are set at 10 percent for Minority Business Enterprises and 6 percent for Women's Business Enterprises. The apprenticeship utilization requirement of 15 percent of total contract labor hours applies only to public works projects estimated at $2,000,000 or more; this project falls below that threshold. Bidders must be registered as vendors through the SCC public procurement portal and possess a current certificate of registration as a contractor in compliance with Chapter 18.27 RCW, a Washington Unified Business Identifier (UBI) number, and required industrial insurance and employment security coverage. The contract documents include prevailing wage schedules, general terms and conditions, insurance and bonding requirements, and detailed specifications for the GE UltraGlaze SSG4000 structural glazing silicone product. Progress payments are made within 30 days of receipt of properly executed applications for payment, with 5 percent retainage held in accordance with RCW 60.28.011.

INSTRUCTIONS TO BIDDERS Page 2

All potential bidders must attend the pre-bid meeting. All attendees at the meeting will be asked to sign the attendance sheet and participate in a building walkthrough of the relevant areas of the facility.

Substantive questions arising at the pre-bid meeting will be documented and answered in a bid addendum, as specified below. The SCC will be bound only by written answers;

E. Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must submit a request in writing by logging in to the SCC public procurement portal (seattleconventioncenter.bonfirehub.com) and submitting a vendor discission no later than the end of the day on Thursday, March 26, 2026. Oral explanations or instructions given before the award of a contract will not be binding. Any information given to a prospective bidder concerning a solicitation will be furnished to all other prospective bidders by addendum to the solicitation if that information is judged by the Owner to be necessary in submitting bids or if the lack of it would be prejudicial to other prospective bidders. Any addendum to this solicitation will be issued not later than the close of business on March 31, 2026.

F. Prevailing Wages: All work under this solicitation is subject to Washington State prevailing wage requirements (reference Chapter 39.12 RCW and WAC 296-127): Wages to be paid workers, laborers or mechanics, pursuant to any contract resulting for this solicitation shall not be less than the prevailing rate of wage in the same trade or occupation in the locality within the State where the labor is performed. The current King County prevailing wage schedule is provided as a separate document for this solicitation.

Questions regarding prevailing wages should be directed to the Washington State Department of Labor & Industries, Prevailing Wage Section, P.O. Box 44540, Olympia, WA 98504-4540, PW1@Lni.wa.gov, 360-902-5300.

Participation may be either on a direct basis in response to this solicitation or as a subcontractor to a bidder. However, no preference will be included in the evaluation of bids, no minimum level of MWBE participation shall be required as a condition for receiving an award, and bids will not be rejected or considered non-responsive on that basis.

INSTRUCTIONS TO BIDDERS Page 3

Specific conditions and additional actions necessary to fulfill the requirements of this section are contained in the “General Terms and Conditions for SCC Facilities Construction”.

H. Apprenticeship Utilization: Consistent with 39.04.320 RCW, the SCC requires that 15% of the total contract labor hours for public works projects estimated to cost two million dollars ($2,000,000) or more be performed by apprentices registered with the Washington State Apprenticeship and Training Council (WSATC). Specific conditions and additional actions necessary to fulfill the requirements of this section are contained in the “General Terms and Conditions for SCC Facilities Construction”.

Bidders may contact the Washington State Department of Labor & Industries’ regional apprenticeship consultant office for King County at 206-515-2842 to obtain information on available apprenticeship programs, or get general apprenticeship program information at the Labor & Industries website, www.lni.wa.gov/TradesLicensing/Apprenticeship/.

0.02 SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK

By submitting a bid in response to this solicitation, the bidder acknowledges that it has taken all practicable steps to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost, including (as applicable) but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during the work. The bidder also acknowledges that it has satisfied itself as to the character, quality and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including exploratory work done by the Owner as applicable, as well as from the drawings and specifications included in the Contract Documents. Any failure of the bidder to take the actions described and acknowledged in this paragraph will not relieve that bidder from responsibility for estimating properly the difficulty and cost of successfully performing the Work.

By submitting a bid proposal under this solicitation, the bidder affirmatively acknowledges that scheduling the Work will be affected by Owner’s event schedule, and will be subject to Owner’s prior approval, which approval will not be unreasonably withheld. The exterior area of the barrel vault will be available for work 24 hours a day. On the weekend of July 25-26, there will be an event inside this area so any items stored inside will need to be moved to the loading dock or off site for storage.

INSTRUCTIONS TO BIDDERS Page 9

Because final contract award is based on an evaluation of bidder responsiveness and responsibility as noted herein, bidders are cautioned that the announcement of bid amounts at the bid opening does not constitute a contract award.

B. Responsiveness Screening: Bid proposals received by the published deadline will be administratively screened for responsiveness, i.e., meeting all the material requirements of the solicitation.

C. Responsibility Documentation: The apparent low bidder will be asked by the Owner to submit the documentation specified in Section 0.09.B, above; the bidder must supply the requested information within two (2) business days of the request. Withholding information or failure to submit all the information requested may render the bid non-responsive.

D. Evaluation: The Owner will evaluate the responsibility documentation submitted by the apparent low bidder to determine if said bidder meets the supplemental bidder responsibility criteria. In making this determination, the Owner will require the bidder to “substantially meet the criteria” taken all together, such that a bidder may be declared to be responsible under the solicitation if the Owner is confident that the bidder is capable of successfully performing the project based on the documentation provided.

E. Appeals: If the Owner determines that the apparent low bidder does not meet the supplemental bidder responsibility criteria specified herein, the Owner shall notify said bidder in writing with the reasons for its determination. If the bidder disagrees with this determination, it may appeal the determination within two (2) business days of receipt of the Owner’s determination by presenting additional information to the Owner. The Owner will consider the additional information before issuing its final determination. If the final determination affirms that the bidder is not responsible, the Owner will not execute a contract with any other bidder until two (2) business days after the bidder determined to be not responsible has received the final determination.

0.12 SUBCONTRACTOR LISTING

Pursuant to 39.30.060 RCW, if the base bid plus the net value of any selected alternates is one million dollars ($1,000,000) or more, the bidder shall comply with the following requirements:

C. The bidder can name itself for the performance of the work.

D. Substitution of a listed subcontractor may be made by the prime contractor for the following reasons:

1. Refusal of the listed subcontractor to sign a contract with the prime contractor;

2. Bankruptcy or insolvency of the listed subcontractor;

F. Failure of the bidder to submit as part of the bid the names of such subcontractors or to name itself to perform such work shall render the bidder's bid non-responsive and, therefore, void.

0.13 CONTRACT AWARD & EXECUTION

A. Contract Award: The Owner intends to award a contract for the work solicited herein to the responsive and responsible bidder offering the low aggregate amount for the base bid plus selected additive or deductive alternates, and meeting all other bid submittal requirements. Notwithstanding the preceding sentence, issuance of this public works project bid solicitation does not obligate the Owner to contract in whole or in part for the work specified herein.

B. Contract Execution: The apparent successful bidder will be expected to return to the

Owner a signed contract, insurance certificate and payment/performance bond(s) within fifteen (15) days after receipt of the finalized contract. If said bidder fails to sign all contractual documents or provide the bond(s) and evidence of insurance as required within the time specified, the Owner reserves the right to rescind award of the contract, and award the contract to the next lowest responsible bidder. The contract will only

INSTRUCTIONS TO BIDDERS Page 11 become effective when signed by the Owner. Prior to the Owner’s signature, any and all costs incurred shall be the sole responsibility of the bidder.

C. Subcontractor Responsibility Criteria: The awarded Contractor shall include the language of “Basic Bidder Responsibility Criteria”, Section 0.09.A, above, in each of its first-tier contracts, and shall require each of its subcontractors to include the same language of this section in each of their subcontracts, adjusting only as necessary the terms used for the contracting parties. Upon request of the Owner, the Contractor shall promptly provide documentation demonstrating that a subcontractor meets the subcontractor’s responsibility criteria cited. The requirements of this section apply to all subcontractors, regardless of tier.

D. Within ten (10) business days, the Reviewing Official will prepare a final report regarding the merits of the protest, and a decision on action, if any, which the SCC will take as a result. A copy of the report will be promptly provided to the protesting party.

E. During the protest review period, the SCC will not commence work on the project at issue, except where, in the considered judgment of the SCC, emergency conditions dictate otherwise.

The Bidder shall not list more than one subcontractor for each category of work identified UNLESS subcontractors vary with bid alternates, in which case the Bidder must indicate which subcontractor will be used for which alternate. Substitutions are prohibited except as outlined in RCW 39.30.060.

Failure of the Bidder to submit the NAMES of such subcontractors or to name itself to perform such work may render the Bidder’s bid nonresponsive and, therefore, VOID.

Bidders who name themselves to perform the work are expected to perform the work and the Seattle Convention Center reserves the right to reject substitution of the bidder with a subcontractor unless the bidder demonstrates a change in circumstances from the time of bid submission that is outside of the control of the bidder.

Upon receipt of this notice, Contractor shall immediately suspend the Work and take all reason-able steps to minimize the costs of performance di-rectly attributable to such suspension. Contractor shall be entitled to an equitable adjustment in the Contract Time, or Contract Sum, or both, for any increases in the time or cost of performance directly attributable to the suspension, provided Contractor complies with all requirements set forth in Part 7.

If Contractor fails or refuses to perform its obliga-tions in accordance with the Contract Documents, Owner may order Contractor, in writing, to stop the Work, until satisfactory corrective action has been taken. 3.6 DAMAGES FOR FAILURE TO ACHIEVE TIMELY

COMPLETION

A. It is acknowledged that the Contractor’s failure to achieve Substantial Completion of the Work within the Contract Time provided by the Con-tract Documents will cause the Owner to incur substantial economic damages and losses of types and in amounts which are impossible to compute and ascertain with certainty as a basis for recovery by the Owner of actual damages, and that liquidated damages represent a fair, reasonable and appropriate estimate thereof.
