13. Measurement and Payment.
Amend section 109.1.1 of the Standard Specifications to add the following subsections:
109.1.1.1 Bid Items Designated as Pay Plan Quantity
109.1.1.1.1 General
If the schedule of items designates a bid item with a **P** in the item description, the department will not measure that bid item. The department will use the plan quantity, the approximate quantity the schedule of items shows, for payment unless one or both of the following occurs:
• Scope changes resulting in a quantity for the designated bid item that varies by more than 5 percent from plan quantity.
• Errors and omissions that affect the plan quantity by more than 5 percent.
109.1.1.1.2 Scope Changes
For engineer-directed quantity increases, the engineer will measure the additional work and pay for the addition quantity under the designated pay item. For engineer-directed quantity decreases, the engineer will measure the work eliminated and make an equitable reduction to the plan quantity under the designated bid item.
109.1.1.1.3 Errors and Omissions
The engineer will adjust the plan quantity of the designated pay item to an agreed quantity for an error or omission with no change in contract unit price.
109.1.1.2 Bid Items Designated as **R**
If the schedule of items designates a bid item with **R** in the item description due to budget restraints this item may not be used or may be used in part or in its entirety and the County will not make adjustments to the contract unit price as included in the section 104.2.2.4, section 104.2.2.5, and section 109.5.
Revise section 109.6.2 of the Standard Specifications to read as follows:
26-009 7 of 19
The department will make one progress payment each month.
Add the following paragraph to Section 109.6.3.2.1 of the Standard Specifications:
Provide copies of weight bills and delivery tickets to the engineer as the work progresses. Payment quantities will be determined from the approved weight bills and delivery tickets. Verify total daily tonnage with the engineer on a daily basis. Only quantities agreed upon as the work progresses will be paid.
Weight bills and delivery tickets must be provided to the engineer within 7 days of placement to be considered for payment.
Revise the second paragraph of section 109.6.3.3 of the Standard Specifications to read as follows:
In addition to the above retainage, the department will retain 5% of the value of the work completed, and 5% of the value of materials and equipment delivered and suitably stored, until 50% completion. At 50% completion, no additional amounts will be retained unless the engineer certifies that the work is not proceeding satisfactorily, but amounts previously retained will not be paid to the contractor until final acceptance of the work by the department. When the contractor substantially completes the work under the contract or upon completion and acceptance of the work, and pending final payment, the engineer may choose to reduce the amount retained.

The department will rely on the contractor’s QMP testing as monitored by the State and any corrections made to ensure HMA pavement mix placed on the project meets specifications. QMP testing requirements are incidental to HMA pavement. The contractor shall provide the engineer with all test results.
The department may not perform its own density testing per standard spec 460.3.3; however, the department reserves the right to order contractor-provided nuclear density testing of all asphalt pavements as they desire and determine necessary as incidental to the HMA pavement. The department will expect the density to meet the minimums required in table 460-3 and air voids within tolerances. Density incentives will only be paid conforming to standard spec 460.5.2.3 if a contractor-provided independent tester performs density testing. If any individual density test result falls more than 3.0 percent below the minimum required target density, the engineer may order work stopped to conduct a review of construction operations with the contractor.
17. Backfill Slurry, Item SPV.0035.01.
This special provision describes furnishing and placing slurry backfill in accordance with pertinent requirements of Section 209 except as hereinafter modified.

(1) Use aggregates conforming to the gradation in standard spec 501.2.7.2 for fine aggregate and for Size No. 1 in standard spec 501.2.7.3. Provide aggregates in the same proportion by weight as required for Grade A concrete in standard spec 501.2.7.4.2.2. Weigh aggregates at a batch plant suitable for batching concrete. Mix and deliver to the project site using a truck mixer. Add enough water to enable the mixture to flow readily to fill all annular spaces within the excavation.
C Construction
Replace standard spec 209.3 with the following:
Discharge from the truck in a manner to prevent segregation. Completely fill excavation in a single operation. Consolidation or compaction effort will not be required; however, provide ample time for the mixture to “set” prior to continuing any further operations on top of the slurry. The mixture will be considered “set” when all visible surface water has dissipated and an average-sized man can walk on top of the mixture without leaving footprints. At least twelve hours shall elapse before paving over backfill.
D Measurement
The department will measure Backfill Slurry by the cubic yard acceptably completed. Such volume shall be computed from actual measurements of the trench to be backfilled, up to the maximum trench width and length as shown on the plans. 22. Grading and Shaping Ditches, Item SPV.0090.02.
This special provision describes cutting, filling, shaping, and re-grading existing ditches as shown on the plans, realigning with a new culvert, improving ditch side-slopes, providing positive drainage, or as directed by the engineer.
B Materials
Topsoil and other unsuitable material shall not be used in embankments of backfill under pavements and shoulders.
Properly dispose of all surplus and unsuitable material conforming to standard spec 205.3.12.
C Construction
Excavate, fill, grade, and shape ditches as necessary at specified locations or as determined by the engineer. Ditching will be required for the following reasons:
1. Realign existing ditches with the location of a new culvert. Provide smooth, rounded transitions in the ditchlines to line up the existing ditch with the new culvert ends. Abrupt changes in direction that could cause embankment erosion will not be acceptable.
2. Improving ditch side-slopes. In areas of shoulder widening, build roadway embankment and push flowline out if necessary to improve ditch foreslope.
3. Filling and regrading. Some ditches will require filling and regrading to shallow a ditch that is too deep for conditions or providing swales where full-depth ditches cannot fit within County right-of-way, are impractical, or otherwise shown on the plans or directed by the engineer.
4. Provide positive drainage. Re-grade and shape existing ditches that have excessively silted in over time or are otherwise higher in elevation than new culvert inverts to eliminate pockets of standing water, where practical.
Construct drainage ditches with a minimum longitudinal slope of 1.0% (0.01 foot per foot) and side-slopes of 3H:1V maximum slope (4H:1V is preferred where practical). Longitudinal slopes as flat as 0.5% (0.005 foot per foot) may be allowed by the engineer in flat areas where providing 1% will result in excessively long ditches (greater than 100 feet longer than the length shown in the plans).
