Cocalico Creek Tributary Stream Restoration at Pump Station 18

This is a project manual and invitation to bid issued by Warwick Township in Lancaster County, Pennsylvania, for stream restoration construction services. The project entails stabilization of approximately 2,545 linear feet of streambank along a Cocalico Creek tributary adjacent to Pump Station 18 infrastructure. Work includes selective site demolition, erosion and sediment controls, flow diversion, excavation and removal of accumulated sediment, construction of log sill grade control structures, plunge pools, livestock crossing installation, temporary stream crossings, and native riparian buffer planting with trees, shrubs, and herbaceous plugs. The project is divided into two substantial completion milestones: general earthwork and structural restoration by November 20, 2026, and herbaceous planting completion by April 30, 2027, with final project completion by May 11, 2027. A mandatory pre-bid meeting is scheduled for April 15, 2026, at 1:00 PM at the Warwick Township office. Sealed bids are due online via PennBid by 2:00 PM on May 21, 2026, with the Township Board of Supervisors scheduled to award the contract on June 3, 2026. The contract term extends from the notice to proceed through May 11, 2027, with no renewal options specified.

Bidders must submit bid security equal to 10% of the total bid amount and comply with the Pennsylvania Prevailing Wage Act, as the project is estimated to exceed $25,000. Performance and payment bonds, each equal to 100% of the contract price, are required at contract execution. Warwick Township has received grant funding from the Pennsylvania Department of Environmental Protection Growing Greener Grant Program to assist with construction costs, which subjects contractors to compliance with Build America Buy America requirements, federal prevailing wage standards, and minority and disadvantaged business enterprise good faith efforts. The project documents specify liquidated damages of $250 per day for delays in achieving substantial completion and final completion milestones. All bid documents are available at no cost through PennBid, and bids remain irrevocable for 60 days following bid opening. Contractors must demonstrate relevant experience completing at least two similar stream restoration projects within the past five years and comply with Pennsylvania's anti-kickback regulations and underground utility protection requirements, including protection of an active sanitary sewer force main within the project limits.

ARTICLE 14 – BASIS OF BID

14.01 Base Bid with Alternates

A. Bidders shall submit a Bid on a lump sum basis for the base Bid and include a separate price for each alternate described in the Bidding Documents and as provided for in the Bid Form.

The price for each alternate will be the amount added to or deleted from the base Bid if Owner selects the alternate.

B. In the comparison of Bids, alternates will NOT be applied in the same order of priority as listed in the Bid Form.

ARTICLE 15 – SUBMITTAL OF BID

15.01 Sealed Bids shall be submitted online via the PennBid Program (www.pennbid.bonfirehub.com)

ARTICLE 16 – MODIFICATION AND WITHDRAWAL OF BID

16.01 A Bid may be withdrawn or modified at any time prior to the date and time for the opening of bids.

Page 7 and the Bid security will be returned. Thereafter, if the Work is rebid, that Bidder will be disqualified from further bidding on the Work.

ARTICLE 17 – OPENING OF BIDS

17.01 Bids will be opened publicly at the time and place indicated in the advertisement or invitation to bid. An abstract of the amounts of the Base Bids and Alternates, if any, will be made available to the Bidders after the opening of Bids.

ARTICLE 18 – BIDS TO REMAIN SUBJECT TO ACCEPTANCE

18.01 All Bids will remain subject to acceptance for the period of time stated in the Bid Form, but Owner may, in its sole discretion, release any Bid and return the Bid security prior to the end of this period.

ARTICLE 19 – EVALUATION OF BIDS AND AWARD OF CONTRACT

19.01 Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner will reject the Bid of any Bidder that Owner finds, after reasonable inquiry and evaluation, to not be responsible. If Bidder purports to add terms or conditions to its Bid, takes exception to any provision of the Bidding Documents, or attempts to alter the contents of the Contract Documents for purposes of the Bid, then the Owner will reject the Bid as nonresponsive; provided that Owner also reserves the right to waive all minor informalities not involving price, time, or changes in the Work.

19.02 If Owner awards the contract for the Work, such award shall be to the responsible Bidder submitting the lowest responsive Bid.

19.03 Evaluation of Bids

A. In evaluating Bids, Owner will consider whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices, and other data, as may be requested in the Bid Form or prior to the Notice of Award.

B. In the comparison of Bids, alternates will be applied in the same order of priority as listed in the Bid Form. To determine the Bid prices for purposes of comparison, Owner shall announce to all bidders a “Base Bid plus alternates” budget after receiving all Bids, but prior to opening them. For comparison purposes alternates will be accepted, following the order of priority established in the Bid Form, until doing so would cause the budget to be exceeded. After determination of the Successful Bidder based on this comparative process and on the responsiveness, responsibility, and other factors set forth in these Instructions, the award may be made to said Successful Bidder on its base Bid and any combination of its additive alternate Bids for which Owner determines funds will be available at the time of award.

19.04 In evaluating whether a Bidder is responsible, Owner will consider the qualifications of the Bidder and may consider the qualifications and experience of Subcontractors and Suppliers proposed for those portions of the Work for which the identity of Subcontractors and Suppliers must be submitted as provided in the Bidding Documents.

19.05 Owner may conduct such investigations as Owner deems necessary to establish the responsibility, qualifications, and financial ability of Bidders and any proposed Subcontractors or Suppliers.

Dear Mr. Harris:

This is in reference to an email request, on your behalf, from Landstudies, dated May 20, 2024, to amend your Pennsylvania State Programmatic General Permit–6 (PASPGP-6) verification, issued on December 22, 2023, identified by this office as NAB-2023-00414-P12 (Cocalico Creek Tributary at Warwick Township Pump Station 18 Stream Restoration). The PASPGP-6 authorized the discharge dredged and/or fill material into waters and/or wetlands associated with the restoration of approximately 2,545 linear feet of a tributary to Cocalico Creek and an additional 20 linear feet of another tributary. The Township has proposed this restoration project to address the eroding streambanks that are threatening to undermine an existing sanitary sewer force main that runs adjacent to this tributary. The project is located at Warwick Township Pump Station 18, in Lancaster County, Pennsylvania. The site begins at Picnic Woods Road and is contained within two privately-owned properties by Anthony G. Zimmerman and Aaron H. Reiff.

The original plan set had shown 14 log sills proposed as part of this restoration;

however, the landowner has since requested that the livestock crossing be shifted approximately 30 feet upstream. Along with the shift in the livestock crossing location, an additional log sill has been added below the livestock crossing to provide grade control. There are now a total of 15 log sills proposed as part of this restoration. In addition, the original authorization, we required 5 years of monitoring in Special Conditions 7-9 to ensure stream channel/bank stability post construction. To ensure consistency with past projects that required 3 years of monitoring, a change is requested to be more in line these past restoration projects.

After a review of your modification request, including submitted plans, this office hereby modifies the previously verified PASPGP-6 to allow for your requested changes.

In accordance with your request, including the revised project plans, Special Condition 1 of the subject PASPGP-6 verification are hereby modified to read:

-2-

1. All authorized work shall be constructed in accordance with project plans prepared by Landstudies, entitled: “Cocalico Creek Tributary Stream Restoration at Pump Station 18 – Warwick Township, Lancaster County, Pennsylvania”, dated October 31, 2023 and revised February 1, 2024, sheets 1 through 22 of 22.

In addition, the following Special Condition(s) are hereby added to the referenced PASPGP-6 verification:

2. The authorized work shall result in no more than 2580 linear feet of permanent rehabilitation to the tributaries and will include the installation of 15 foot long by 10 foot wide livestock crossing within the area of the rehabilitation. In addition, 450 linear feet of stream channel will be temporarily impact by the installation of three temporary stream crossings. There are no wetland impacts proposed for this project.

7. The stream/floodplain restoration site shall be monitored for a period of three years for the purpose of ensuring stream channel/bank stability. Monitoring will be completed in accordance with the “Operations and Maintenance Plan – Cocalico Creek Tributary at Warwick Township Pump Station #18 Stream Restoration”, prepared by LandStudies, Incorporated, dated October 18, 2023. Monitoring shall be performed by or supervised by an environmental consultant with documented success in stream restoration. The monitoring shall commence with the first spring season following completion of the stream/floodplain restoration. The monitoring period of any given calendar year shall begin in spring and end in autumn. The reports shall be submitted to the Corps for review and approval by January 31 following the monitoring year. Additional monitoring may be required if the Success Criteria identified in special condition 9 are not met.

9. By year three of the monitoring period, the Success Criteria identified in the referenced monitoring plan shall be met, including stable stream channels and banks.

All other conditions, including all Special Conditions, of the original permit remain in effect and adherence shall be strictly maintained. Please be advised that all work must be accomplished in accordance with the terms and conditions of the PASPGP-6 authorization, and applicable Pennsylvania Department of Environmental Protection permits, including amendments.

This permit modification does not obviate the need for obtaining other federal, state, or local authorizations.

Dear Mr. Harris:

This is in reference to your application, identified by this office as NAB-2023- 00414-P12 (Cocalico Creek Tributary at Warwick Township Pump Station 18 Stream Restoration), for Department of the Army authorization to discharge dredged and/or fill material into waters and/or wetlands associated with the restoration of approximately 2,545 linear feet of a tributary to Cocalico Creek and an additional 20 linear feet of another tributary. The Township has proposed this restoration project to address the eroding streambanks that are threatening to undermine an existing sanitary sewer force main that runs adjacent to this tributary. If this restoration project is not implemented, then the banks will continue to erode and potentially expose and damage the existing force main. The project proposes eliminating existing unvegetated, vertical streambanks and replacing them with a vegetated floodplain bench to accommodate storm flows.

Once implemented, this project would result in a stabilized system with a functional floodplain that would provide water quality benefits, infrastructure protection, reduced erosion and flooding issues, and significant ecological uplift. Native trees and shrubs will be planted to enhance the existing riparian buffer and help filter pollutant runoff. The project will also include one livestock crossing. The project is located at Warwick Township Pump Station 18, in Lancaster County, Pennsylvania. The site begins at Picnic Woods Road and is contained within two privately-owned properties by Anthony G. Zimmerman and Aaron H. Reiff.

In accordance with Section 404 of the Clean Water Act, a Department of the Army authorization is required for the discharge of dredged and/or fill material into waters of the United States, including jurisdictional wetlands. Section 10 of the Rivers and Harbors Act also requires Department of the Army authorization for any work in, over, or under a navigable water of the United States.

We have determined that your proposed work, if accomplished in accordance with the enclosed terms and conditions and the information included in your application, is authorized under the Pennsylvania State Programmatic General Permit-6 (PASPGP-6).

This PASPGP-6 verification is provided pursuant to Section 10 of the Rivers and

-2-

Harbors Act of 1899 and/or Section 404 of the Clean Water Act. This authorization may be subject to modification, suspension, or revocation if any of the information contained in the application, including the plan(s), is later found to be in error.

The enclosed list of conditions must be followed for purposes of the PASPGP-6 (Enclosure 1). In accordance with General Condition 34 of PASPGP-6 you are required to submit a signed certification documenting completion of the authorized activity and implementation of any required compensatory mitigation. An example of the information that is required is posted on the Baltimore District webpage at:

https://www.nab.usace.army.mil/Portals/63/self%20cert%20example.pdf.

You and your contractor are also requested to sign, date and return enclosure 2 of this verification letter whereby you are acknowledging and agreeing to comply with the terms and conditions, including the special conditions, of this PASPGP-6 verification.

These documents should be submitted to the following email address: nab-regulatory@usace.army.mil, with the Corps permit number NAB-2023-00414-P12 included in the subject line. In addition, the following special conditions are incorporated as part of this authorization:

1. All authorized work shall be constructed in accordance with project plans prepared by Landstudies, entitled: “Cocalico Creek Tributary Stream Restoration at Pump Station 18 – Warwick Township, Lancaster County, Pennsylvania”, dated October 31, 2023, sheets 1 through 22 of 22.

2. The authorized work shall result in no more than 2565 linear feet of permanent rehabilitation to the tributaries and will also include the installation of 15 foot long by 10 foot wide livestock crossing within the area of the rehabilitation. There are no wetland impacts proposed for this project.

3. The permittee shall require its contractors and/or agent to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit.

4. Any Pennsylvania Fish and Boat Commission time-of-year restrictions assigned to Cocalico Creek and its tributaries in the project area are a condition of this authorization.

5. The permittee shall implement proper sediment and erosion control measures, as approved by the Lancaster County Conservation District and/or the Pennsylvania Department of Environmental Protection, for the purpose of protecting the waterways and wetlands located beyond the area designated for fill.

https://www.nab.usace.army.mil/Portals/63/self%20cert%20example.pdf mailto:nab-regulatory@usace.army.mil

-3-

6. No excavated or fill material shall be stockpiled in waterways or wetlands. Any stockpiling within the vicinity of streams or wetlands shall be stabilized to prevent entry of materials into these areas.

7. The stream/floodplain restoration site shall be monitored for a period of five years for the purpose of ensuring stream channel/bank stability.

8. The monitoring reports must include an evaluation of project integrity, a brief analysis of the inspection results, including a discussion on observed stream flow within the channels, and photographic documentation. Photographs should be clear and should show as much of the in-stream work as needed to verify whether the site is stable and has visible flows or requires modification or maintenance. Documentation of progress towards meeting the Success Criteria identified in special condition 9 should be included in all reports. If an assessment shows bank erosion or streambed aggradation severe enough to jeopardize the integrity and stability of the project reach, as determined by the U.S. Army Corps of Engineers, then the permittee shall develop and submit an assessment of the problem with a remedial plan, to this office. Upon review and approval by this office, the permittee shall correct any problems in accordance with this plan.

9. By year five of the monitoring period, the Success Criteria identified in the referenced monitoring plan shall be met, including stable stream channels and banks.

10. The permittee's responsibility to meet the Success Criteria as set forth in special condition 9, will not be considered fulfilled until it has been determined that the project is successful, as determined by the U.S.
