About this file

This document is a Justification for Other Than Full and Open Competition (JOTFOC) for a lease renewal with the General Services Administration (GSA) for the Drug Enforcement Administration (DEA) in Florence, SC. GSA currently leases 10,125 ABOA/10,628 rentable square feet at 151 Quartz Lane, with the current lease expiring on April 6, 2026. The proposed new lease is for a 15-year term with 10 years firm, commencing on April 7, 2026, and includes 20 reserved parking spaces.

The solicitation requirements specify the space must be contiguous, on one floor, located on the second floor or higher (unless the agency is the sole tenant), and have a 20' setback from surrounding uses. Market research conducted through SAM.gov and platforms like CoStar and LoopNet resulted in only one expression of interest from the incumbent lessor. The lease is being pursued as a sole-source action under 41 U.S.C. 3304(a)(1), with the rental rate deemed Fair and Reasonable based on market surveys. The DEA has been at this location since 2011 and has expressed satisfaction with the current lessor and property condition.

Project No: 2SC0273

Agency Name: Drug Enforcement Administration (DEA)

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 10,125 ABOA SF/10,628 rentable square feet (RSF) of office space at 151 Quartz Lane, Florence, SC, 29506, under lease number GS-04P-LSC50019 for the DEA. The current lease expires April 6, 2026. Approval is requested to negotiate a succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location.

The procedures for pursuing a succeeding lease are detailed in GSAR 570.402: Succeeding Leases.

2.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.402-4. In accordance with GSAR 570.402-4, use of the sole source authority is appropriate if the Government cannot identify any potential acceptable locations through the advertisement or the market survey.

4.

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

GSAM 570.402-4 allows for negotiation with the incumbent Lessor when no other potential acceptable locations are identified through the advertisement or the market survey. Based on market research and

Project No. 2SC0273 responses to the SAM pre-solicitation notice, GSA has identified only one source, the incumbent location,

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on the Contracting Opportunities domain of SAM.gov on April 19, 2024, for 21 calendar days.

During the period that the notice was active, Public Properties responded to telephone and email inquiries from landlord representatives about the space requirement. Despite active market engagement, GSA received only one expression of interest, which came from the representative for the incumbent location at 151 Quartz Lane.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market surveys conducted by Public Properties in Florence, SC, using CoStar and LoopNet showed the full-service rental rate within the market ranges from $ to $ per RSF. The proposed rental rate for this succeeding lease of $ per RSF is within the current market range for this submarket and is, therefore, deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

GSAR 570.402-4 allows for negotiation with the incumbent Lessor when the Government does not identify any potential acceptable locations through the pre-solicitation notice or the market survey.

GSA posted an advertisement conforming to GSAR 570.402-2 on the Contract Opportunities domain of SAM.gov website on April 19, 2024. The incumbent Lessor was the only interested party that provided an expression of interest. In addition, Public Properties conducted market research using CoStar and LoopNet, to identify possible locations identified.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.

The most recent property inspection showed the space to be well maintained and in good condition. Due streets. The office must be located near major highways and not far from where they can conduct their operations. Additionally, the current space meets the agency requirements for , , and . DEA has been in this location since 2011 and has expressed their satisfaction with the current Lessor.

9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION.

151 Quartz Lane (incumbent lessor)

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

There are no systemic barriers to competition.
