Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION

UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

Sole Source – Phoenix Integration, Inc - ModelCenter Floating, Node locked License and Training

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

ModelCenter will provide the interoperability and singular execution of these tools and the capability to customize a solution for toolsets beyond its out-of-the-box capability. NSWC Common Engineering Toolset Community will also be able to open, review, and execute contractor created ModelCenter model integration frameworks.

Phoenix Model Center is being used in concert with other engineering software tools to integrate tools to assist with the ongoing effort for . Normally engineering software tools work very independently of each other and Phoenix Model Center acts as a translator with some of these engineering software tools that does not. In the effort to integrate several engineering software tools together Phoenix Model Center is a stepping stone to help solve a larger issue of integrating and translation to make utilizing specific engineering tools with specific qualities work together in . Phoenix ModelCenter is currently is use in NSWC Crane environments. In order to maintain compliance with existing licenses, software maintenance and support is required.

provides limited integration capabilities to toolsets currently in use and planned continued use. However, does not integrate into toolsets for integration and visual representation of the analysis, and it does not have the integration toolset capacity capabilities offered by the ModelCenter. Other possible options for this capability would be to create our solutions internally at a much higher cost for labor and a much longer schedule.

Market Research was performed by attending vendor conferences (National Defense Industry Association and International Council for Systems Engineering) along with market survey and evaluating available products. The Phoenix Integration ModelCenter Software was identified as the only product that would meet the Government’s current needs based on industry experience, the many capabilities unmatched by other vendor’s software products and integration operability with the Government’s customers and teaming contractors.

While some other suppliers offer similar features, none offer all of these in one single package necessary to fulfill the Government’s unique requirements in this case. This proprietary equipment may only be purchased from the original equipment manufacturer, Phoenix Integration.

B. BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.

C. UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.

Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
