About this file
This is a Justification and Approval (J&A) document for a sole source contract modification for the USS HARPERS FERRY (LSD-49). The Navy plans to add a new work item to an existing contract with National Steel and Shipbuilding Company (NASSCO) for an overhaul of the Number 1A and 1B Main Propulsion Diesel Engine (MPDE) Dual Clutch Assembly. The total estimated value of the modification is $1,681,060.66, funded by FY25 OPN (TYCOM funds), with work to be performed from 28 July 2025 through 16 October 2026.
The sole source justification is based on urgent operational needs and schedule constraints. The clutch overhaul was discovered after the initial contract package was locked, and is critical to ensuring the ship's operational capabilities. NASSCO is uniquely positioned to perform the work as the ship is currently in their shipyard, and competitive rebidding would potentially cost approximately $690,000 more and risk delaying the ship's maintenance availability. The modification is being made under the authority of 10 U.S.C. 3204(a)(2), which allows for unusual and compelling urgency exceptions to full and open competition.

The USS HARPERS FERRY (LSD 49) FY25 SRA start of the availability begins 28 July 2025 with a Delivery Date of 16 October 2026. Estimating a total of 194 days to accomplish the work.
d. The Government’s minimum needs have been certified as complete and accurate by the technical and requirements personnel.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(2) as implemented by the Federal Acquisition Regulation (FAR) 6.302-2 – this authority applies in those situations where an unusual and compelling urgency and full and open competition need not be provided for. This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY.
Request for Contractor Change (RCC) 2N was written in order to overhaul Number 1A and 1B Main Propulsion Diesel Engine (MPDE) Dual Clutch Assembly in Main Machinery Room Number One (5- 52-0-E).
RCC 2N is to accomplish Number 1A and 1B Clutch Overhaul. The contractor is responsible to provide NAVSEA Standard Item (NSI) 009-90 of an authorized Original Equipment Manufacturer (OEM) technical representative for technical oversight, special tools and technical documentation for the accomplishment of this work item, of accomplish a clutch/overhaul inspection for the repair of (2EA) number 1A and 1B main propulsion dual clutch assembly located in main machinery room number one (5-52-0-E), submit one legible copy, in hard copy or approved transferrable media, of a list of new parts installed, excluding parts specifically listed to be removed in this Work Item or invoked Standard Item, in place of those identified to be missing or defective, with documenting invoices or other substantiating data, to the SUPERVISOR, accomplish the requirements of NSI 009-32 cleaning and painting for each new and disturbed surface, and procure and install CFM material.
The decision to overhaul 1A and 1B clutch was due to multiple LPD and LSD clutch brake inspections during the availability with the frequent result for a full clutch brake overhaul. The recommendation for the overhaul was after an RCM workshop was conducted, which concluded to overhaul the clutch brake assemblies versus open and inspect to improve planning and reduce time and cost growth. This overhaul is required to prevent an issuance of a C3 or C4 CASREP. In the latest inspection completed by C200 on 21 August 2025, the following was found and recommended for repair: 1A clutch has no grease leaking from the rear seal, but what was there was dry and brittle, with dried grease indicating that 1A should be overhauled due to time and current visual condition. 60M-1 6UQX inspection of actuator tubes and to measure brake wear is also required; and 1B clutch has a Blown rear and front seal and air manifold plate has grease escaping out the front, 1B needs to be done.
The requirement to overhaul 1A and 1B clutch is critical and necessary for USS HARPERS FERRY to ensure both clutches are brought back to operational and support the mission. If the clutches are not overhauled, the ship is unable to provide full power to be operational, which will impact the completion of Sea Trials and follow on milestone. Since the ship did not identify the need for 1A/1B clutch overhaul until after 100% Package Lock, this work is not included in the basic work package. There is currently no scope for the repair within the USS HARPERS FERRY FY25 SRA work package and will be needed to be added as new work.
The window of opportunity to accomplish the work is 28 July 2025 through 16 October 2026 and is critical to this availability and repair must be accomplished during the scheduled SRA. The Contractor notified the Government that there is 17 weeks of long lead time material and will not be able to begin production work until all materials are received. Any delay to the purchase of materials and start of work would jeopardize the ability to meet the current contractual Production Completion Date (PCD) milestone of 20 July 2026. If this work is not completed, it will cost the Government extensively to extend the contract and there will be additional costs for acceleration if work is not incorporated into the schedule, it could potentially have subsequent impact to the remaining milestones.
Based on the information the contractor provided for the impact and incorporation of new work schedule, there is an 87-days schedule impact to the follow-on installation. The PCD milestone had gone from a 125 days float to a 38 days float with a net loss of -36 days to facilitate LLTM installs and a further day for day slip to remaining float for everyday unauthorized beyond 11 August 2025. There is currently 10 days of float remaining and competing this work would further reduce float to the PCD milestone by an additional 30 days, which would put the number of days of float at negative 20 days. In addition to the existing schedule, contractor also have to incorporate this new work changes and schedule into the timeline to satisfy the availability completion without potential impact. For everyday this RCC is not authorized and on contract, it has the potential to impact the PCD milestone date of 20 July 2026, which is a certifiable milestone. With follow-on work and unknown complication, and with the adequate time to accomplish those repairs, we can potentially avoid impact that may lead to extension of availability.
The USS HARPERS FERRY (LSD 49) daily extension rate is $22,650.00 and if applied to the negative days of float, if this work is solicited, would result in a subsequent contract extension costing nearly $453,000.00. Since the current contract already have support services in place, it would also result in a duplication of costs estimated at $235,348.49 or 14% of production costs and schedule conflict between different contractors. NASSCO has the means to incorporate the scope of work without significant delays or duplications of costs.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE:
The original contract was awarded competitively in which NASSCO was the selected awardee.
During this window of maintenance availability, no other source can satisfy the Agency’s requirements without a significant impact to the availability completion schedule. An impact to the availability completion schedule would pose a serious risk to mission readiness and war fighting capabilities of the USS HARPER FERRY (LSD 49). NASSCO is uniquely positioned to perform the work as the ship is currently in the NASSCO shipyard undergoing a major repair period, and it is impracticable for another company to perform these support service with other ongoing repairs as it would cost approximately $690,000.00 for someone other than NASSCO to complete this requirement
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Contracting Officer has determined that the anticipated cost to the Government of this acquisition will be fair and reasonable based on cost and price analysis to be conducted pursuant to FAR Part 15. In addition, technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost, and subcontractor cost correspond with the expected cost.
8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:
It was unanticipated that the discovery of this work would become immediately necessary after 100% Package Lock. However, during the next maintenance availability, a contract of this nature will be awarded by providing for full and open competition, so long as full and open competition is appropriate for the circumstance. Any lessons learned will be implemented to ensure requiring activities become more pro-active in modifying solicitations prior to award to mitigate issuing a new work under a sole source environment.
