About this file

This is a Justification for Other Than Full and Open Competition (JOTFOC) for a lease extension filed by the U.S. Forest Service Wallowa Valley Ranger District.

The Forest Service seeks to extend its current office lease for 10,879 rentable square feet at 201 E 2nd Street, Joseph, Oregon 97846 (Lease Number 1204H110L1608) for up to 60 months without full and open competition. The current lease extension expires January 31, 2026. The justification cites 41 U.S.C. 3304(a)(1) and GSAR 570.405 as statutory authority, specifically invoking the provision that use of a sole source is appropriate when the government experiences delays in acquiring replacement space. The stated reason is the last-minute termination of a GSA replacement project, leaving insufficient time for competitive procurement before the current extension expires. Market research conducted on March 5, 2025 using COSTAR identified zero potentially acceptable alternative locations in the Joseph, La Grande, and Enterprise, Oregon areas beyond the incumbent property. The proposed rental rate is stated to be slightly above current market averages but deemed fair and reasonable based on surveys by James Navarro. A conversation with the lessor, Andy McKee, on July 1, 2025 indicated interest in a five-year extension, though rate negotiations were deferred pending review of amendment terms. The document emphasizes that relocation would impose unrecoverable move and replication costs on the Ranger District. Future competitive procurement is planned once sufficient time is available before the extension expires, with consideration given to the time and cost implications of potential relocation versus remaining at the existing location.

Text version

The government is consolidating various agencies and the contracting officer needs to extend the terms of some leases to establish a common expiration date

The agency occupying the space has encountered delays in planning for a potential relocation to other federally controlled space due to documented organizational, financial, or other uncertainties

4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location during the extension period, due to issues selected in section 3 of this JOTFOC. Award to other than the current Lessor would require relocation of the entire requirement and would cause the Wallowa Valley Ranger District to incur move and replication costs that would not be recovered through competition.

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

In accordance with GSAM 570.106(d) and 570.405, an advertisement is not required for extensions.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market surveys conducted by James Navarro in Joseph, OR and surrounding areas showed the un-serviced market rate average to be with full-service rates averaging an estimated

Therefore, the proposed rental rate for this lease extension of , the current rate for the incumbent property, for a fully serviced lease is slightly above the current market range for this area, yet is deemed fair and reasonable by the Forest Service Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

On 3/5/2025 market research was conducted using COSTAR and 0 potentially acceptable locations plus the incumbent were identified that can meet the agency’s needs within the delineated area. A conversation between USFS LCO, Ron Feist and the Lessor, Andy McKee occurred on 7/1/2025. During that discussion Andy stated he would be interested in a 5-year extension but declined to discuss rates until he could review the terms of the extension via a draft Lease Amendment.

See Figure 1 below for the results of the market research including the incumbent.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.

The incumbent is the only option given the time between when GSA canceled the replacing project and when the current extension expires.

9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION.

N/A

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

In advance of the existing lease extension’s expiration, considerations will be given to allow for sufficient time to conduct a full and open procurement. The Government will consider the time and cost of moving from the existing location, and the time and cost to build out new space when deciding whether it is economically advantageous to stay at the existing building or to undergo a competitive action.

Additionally, consideration will be given to the Forest Services' mission and security requirements (if applicable) to include limiting any agency space requirements that may be deemed unduly restrictive and thus favor the incumbent. The Government will remain conscious of the effort to continuously encourage competition when practicable.
