About this file
This is a Justification and Approval (J&A) document for a sole source acquisition above the Simplified Acquisition Threshold (SAT) by the Department of Veterans Affairs.
The Department of Veterans Affairs, Network Contracting Office 15 (NCO15) at CMOP Leavenworth, Kansas, is awarding a firm-fixed-price contract to SJS Executives, LLC, a Service-Disabled Veteran-Owned Small Business (SDVOSB), for temporary on-site electrical and mechanical maintenance technical support. The requirement is for up to three Full-Time Equivalent Employees (FTEEs) to provide maintenance services for the facility's automated pharmaceutical equipment systems, including automatic packaging systems, tote and conveyor systems, and drug dosing machines. The estimated service requirement encompasses 3,048 regular hours, 50 overtime hours, and 120 weekend/holiday hours. The contract covers a base period from April 2026 to September 2026 with one six-month option period (October 2026 to September 2027), plus a FAR 52.217-8 Option to Extend Services. The award is justified under 41 USC §3304(a)(1) (Only One Responsible Source) because the incumbent contractor possesses unique familiarity with Leavenworth CMOP's complex systems and the transition to the new Shawnee facility (operational capacity estimated between May 2025 and March 2027) creates operational continuity risks. Price analysis determined the new pricing reflects approximately 9% increase over previous contract rates, consistent with updated Service Contract Act Wage Determinations and normal market cost growth—lower than the prior contract's 13% increase. No formal market research was conducted, and no other sources expressed interest. Following full transition of operations to CMOP Shawnee, future maintenance requirements will be competed using full and open competition.

2. Nature and/or Description of the Action Being Approved:
This procurement provides CMOP Leavenworth with temporary on-site Electrical and Mechanical Maintenance technical support necessary to sustain operations of the facility’s automated pharmaceutical equipment systems, including automatic packaging systems, tote and conveyor systems, and drug dosing machines. The requirement will be fulfilled through an above-SAT, repetitive sole-source award to a Service-Disabled Veteran-Owned Small Business (SDVOSB). The acquisition will utilize a firm-fixed-price contract with SJS Executives, LLC.
3. Description of Supplies/Services Required to Meet the Agencys Needs:
The procurement is for up to three Full-Time Equivalent Employees (FTEE) to provide on-site technical support. The required service is for up to 3048 regular hours, 50 Over Time hours (if needed), and 120 weekend/holiday hours (as required); the total estimated value of this acquisition is for a base period of six (6) -months and one, six (6) month option period, and a 52.217-8 Option to Extend Services.
The period of performance for the base period is from April 2026 to September 2026 and the option period if needed is from October 2026 to September 2027.
4. Statutory Authority Permitting Other than Full and Open Competition:
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by
RFO 6.103-1;
( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by RFO 6.103-3;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by RFO 6.103-7;
5. Demonstration that the Contractors Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The maintenance support should gradually diminish as work begins to transition during the 6-12 months to the new site located in Shawnee, KS. The shift over to the new site could begin as early as May 2025 or as late as March 2027 as the APFS system begins to come online. SJS Executives are already performing at an acceptable level and are familiar with the process at Leavenworth CMOP. Sole sourcing this requirement IAW VAAR Part 819.70008 is in the best interest of the government due to the uncertainty of how long this requirement will be needed. The current vendor, SJS Executives, LLC is familiar with the work requirements and will not need any ramp up time.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):
Due to the limited and uncertain timeframe of this requirementdependent upon the Shawnee facility reaching full operational capacity the Government did not resolicit this effort. It has been determined to be in the best interest of the Government to retain the incumbent contractor, who possesses direct experience with the comprehensive technical maintenance support required for CMOP Leavenworth’s automated equipment systems including automatic packaging systems, tote and conveyor systems and drug dosing machines. Any lapse in service could significantly disrupt operations, potentially affecting the approximately 335,000 prescriptions processed weekly at CMOP Leavenworth. Engaging a new vendor would introduce delays associated with recruiting qualified personnel (Electronic Technician Maintenance, Machinery Mechanic, Machinery Maintenance Mechanic), completing VA onboarding requirements (background checks, mandatory training, and administrative processing), and providing sufficient time for the workforce to become familiar with the facility’s complex maintenance requirements.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
A price analysis was performed in accordance with RFO 12.201-1(e)(1). The anticipated cost to the Government for the requirement of 1–3 Full‑Time Equivalent Employees (FTEs) was compared to pricing from previous, similar contracts that performed the same services under comparable market conditions.
The new pricing reflects an average increase of approximately 9% over the most recent contract rates. This increase is consistent with updated Service Contract Act Wage
Revision: 04 Effective Date: 12/15/25
Determinations, changes in vendor Overhead and General & Administrative expenses, and normal market cost growth. For comparison, the prior contract experienced an average increase of approximately 13% over the preceding period for the same set of CLINs.
Because the new acquisition’s rate changes fall within normal market cost growth and are lower than the historical increase observed between earlier contracts, the anticipated cost to the Government is assessed to be fair and reasonable.
*Previous similar contracts comparable increases.
The Current market research using the most recently available Kansas Bureau of Labor Statistics (BLS) from May 2023 Occupational Employment and Wage Statistics indicates that prevailing labor rates for the relevant State Occupational Codes (SOC) are consistent with the labor categories and unit wage rates reflected in the incumbent contract. Updated BLS data for 2024-2025 is not yet released (anticipated May 2026); however, the most recent published wage data confirms that the anticipated labor pricing aligns with current market conditions for the region.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Formal market research was not conducted for this acquisition. The requirement is directly tied to the Shawnee facility achieving full operational capacity as part of the transition of services from the CMOP Leavenworth location. Given the highly specialized nature of the technical maintenance support required-including automated packaging systems, tote and conveyor systems, and drug dosing machines, it is in the Government’s best interest to retain the incumbent Service- Disabled Veteran-Owned Small Business (SDVOSB) contractor. The current vendor possesses unique knowledge and familiarity with the Leavenworth facility’s integrated automated equipment and operational environment, which is critical to ensuring continuity of service and minimizing operational risk during the transition period.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
None.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
None.
11. A Statement of the Actions, if any, the Agency May Take to Remove or
Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Following the full transition of operations from CMOP Leavenworth to CMOP Shawnee, any subsequent requirement for maintenance services will be competed using Full and Open Competition, as appropriate. Once the transition is complete and continuity risks are mitigated, the agency will reassess the market landscape and solicit competitive proposals to ensure future acquisitions promote competition and provide the best value to the Government.
