STATEMENT OF WORK:

Background:

Unity Healing Center, located at 448 Sequoyah Trail Drive, Cherokee, NC 28719, is an Indian Health Service youth drug and alcohol treatment facility. This facility is capable of holding up to 16 residents but, on average, houses 6 to 8. The building was originally built in the late 1930s and had served as the Cherokee Hospital. In the late 1990s after sitting abandoned for many years, the building was gutted and converted into a youth treatment facility. In 2008 the building was renovated but the bathrooms were not remodeled. Currently these bathrooms are showing signs of their 25+ years of use and need to be remodeled. This project will remodel 4 of the most frequently used resident bathrooms that were installed during the 1990s.

Since this facility is fully operational only 2 bathrooms can be renovated at the same time.

Resident Bathrooms (136, 131, 116, 111/113)

Demolition:

All resident bathrooms shall be demolished to the studs with the exception of the ceiling.

Any/All partition walls in the bathrooms shall be removed. In a few bathrooms pluming will need to be relocated for the shower due to being located in the partition wall.

All tile on the floor shall be removed with the exception of the Marble transition strip leading into the bedrooms. Existing transition strip to remain.

Existing lighting fixtures shall be removed.

All electrical switches and receptacles shall be removed.

All fixtures (Tub, shower stall, toilet sink, towel holders, toilet paper holders, etc.) shall be removed.

Window sills shall be removed.

Insulation in walls is to be left in place, with the exception of insulation behind bathtub and shower walls.

Renovation:

Wall structure consists of metal studs. From what is known these studs are in good condition. Any damaged studs shall be replaced.

Two bathrooms (136 & 111/113) shall be ADA compliant. All bathrooms must utilize ligature resistant fixtures and accessories with the exception of the Toilets. All bathrooms shall have the same gender neutral design. Toilets shall be elongated and use an open front seat with no lid.

All bathrooms shall have showers only. Showers shall be curb-less and shall utilize trench drains.

Bathrooms shall have waterproof membrane under all tile and use a turn up installation on all walls. Note: At various locations in the building it is know that there are chunks of marble mixed in with the concrete. All drain locations will need to be relocated to accommodate trench drains.

Trench drain are to be located along the outside edge of the shower just inside of the shower curtain and run the full length of the shower.

Replace all insulation behind existing showers and tubs located along exterior walls. Insulation shall be a minimum of R-19. All other exterior wall locations are known to have good insulation.

New walls must be able to withstand abuse (Kicking/Punching) and shall be a minimum of 5/8” cement board behind tile and 5/8” mold resistant gypsum board elsewhere.

Tile o Large format tiles shall be used to minimize grout lines. All grout lines shall be kept a small as possible. Provide minimum of 3 style choices for floor and wall tile. Provide 5 gender neutral colors choices for the floor and wall tile. Tile shall be easily cleanable non-porous and properly sealed.

o Walls shall be tiled to 4 foot high inclusive of window sill and window surround.

o Provide inset shelf in wall adjacent to sink for toiletry items. 12” tall, 3.5” deep, 18” wide, 36” from floor minimal pitch to assure water drainage. Inset shall use same tile as wall.

o Shower portion of the walls shall be tiled to the ceiling.

o In shower provide a 3.5” inset 18” high area a minimum of 24” long for use for soap and shampoo storage. Inset shall be approximately 36” from the finished flor height. This inset shall utilize the same tile as the shower walls. Insert shall be minimally pitched to assure water drainage.

o Floors shall resist slipping when wet. Shower floor shall utilize same tile as bathroom floor.

Provide and install – items must be ligature resistant or fall down if too much pressure is added.

o Toilet, sink with faucet, toilet paper dispenser, paper towel dispenser o Dual showerhead & shower valve, Whitehall model WH538-FH-CSH-SRCH or similar o clothing hooks (4 each), 8 each in the bathroom for 111/113 o LED lighting fixtures mounted on ceiling to provide even light throughout the bathroom and shower area. (Minimum of 2) o LED light fixture above mirror at the sink on separate light switch.

o 15 AMP GFCI receptacle near sink.

o Glassless shatterproof mirror over sink flat mounted to wall no medicine cabinet. (ADA mirror shall be slanted forward) o Showers will utilize curtains on a tension rod. Rods and opaque curtain shall be provided.

o ADA compliant grab bars around toilet and in shower in the two ADA bathrooms. Note:

Relocation of fixtures may be required in order to meet ADA regulations.

o Existing exhaust fan shall be replaced and new exhaust line added and vented under building eve. Fan shall operate on the same switch as the room lights. Eve of building is expected to be hardie-board style material. Note: eve of building was an addition to the previous roof. Depending on location the Exhaust line may be required to fit through a width of 1 ½ inches. Ductwork used shall provide the exhaust fan rated cubic feet per minute flow. All exterior vents shall be caulked and painted to match existing eve color.

Special Note - Bedroom converted to Office (Room number 134):

Remove bathroom access door and frame from office at the end of the corridor on the first floor.

Office side shall of wall shall be finished to match existing. This room was originally designed to be a bedroom, but has since been converted to an office. Bathroom access from the office side is no longer needed.

First Floor Public Restroom (Room Number 102)

Add handicapped bars at toilet per ADA regulations.

Required Submittals

For approval prior to installation: Manufacture specification sheet for all bathroom fixtures, paints, adhesives, electrical, and lighting components to be installed.

Schedule of construction work.

As-built drawings for all newly installed or modified systems.

Operations and Maintenance manual (2 copies).

o Include all manufacture provided documentation for all systems/items installed.

o Include all warranty information with contact information.

Proof of liability insurance $1 million minimum. (Submit with Proposal)

10% Bid bond (With Proposal)/ 100% Performance bond. (After contract Award)

General Requirements

1. Codes

All designs and construction shall be in accordance with the most current issues of the

International Pluming Code, National Electric Code, National Fire Codes, AIA Guidelines, ADA, UBS, ASHRAE, OSHA (during construction), UFAS (Uniform Federal Accessibility

Standards), all Federal, State, and local ordinances, and shall be in accordance with the most current Industry Standards for a residential board care facility.

Where conflicts between codes occurs the more stringent code shall apply.

2. Local Labor

Use of personnel or contractors belonging to the Eastern Band of Cherokee Indians to provide specialized services where applicable, practical, effective and feasible is encouraged.

3. Meetings

Weekly progress meetings will be held with Health Service Administrator or designated staff member, and facilities engineer to ensure progress and future work is communicated to all stakeholders on this project.

4. Material Considerations / Requirements

Paint

i. All interior paints shall be NO VOC / LOW ODOR Paint - Wall Finish: Satin or Eggshell;

Trim Finish: Gloss. Paints in bathrooms shall contain an EPA approved mildewcide that resists the growth of mold and mildew.

Colors

i. Colors and materials shall be approved by Health Service Administrator.

Materials

i. Materials must be equal or better grade compared to existing facility, free from defects or imperfections and wherever possible shall meet GREENGUARD or ANSI/BIFMA

M7.1/X7.1 standards.

Fixtures

i. All plumbing fixtures shall meet EPA’s WaterSense criteria except where not available due to the ligature proof requirement.

LED Lighting

i. All LED Lighting in this scope of work shall be 3,500 K Warm White, 50,000 hour minimum life expectancy, CRI rating 77 or better, LM 70 or better unless otherwise stated.

Extra Materials

i. All extra materials purchased under this contract for this work shall be left on site in location as designated by maintenance staff.

Waste

i. All wastes generated during construction shall be disposed of at a receiving facility that is authorized to receive those wastes, i.e. construction and demolition wastes, refuse.

5. Scheduling

Unity Healing Center is a 24/7 facility. Residents’ schedules vary from day to day. Special considerations to noise, climate control, dust containment, safety and traffic flow are mandatory. All efforts will be made to minimize interference.

Any proposed power outages, disruptions of patient service, blocked exit ways, disruption of fire suppression or annunciation, or similar action that may require temporary closures must be scheduled and approved at least TWO DAYS IN ADVANCE with the Health Service

Administrator.

Contractor must ensure access to and from the facility is not hindered or create any safety issues for patients. Location of staging area, temporary trailers, construction dumpster, and any other items being stored on site must be approved by Health Service Administrator.

Any relocation of furniture and/or equipment by the contractor shall be coordinated with the

Health Service Administrator. If through negligence or carelessness any of the furniture and/or equipment is lost or damaged, the Contractor will be held liable.

6. Site Restoration

All utilities shall be fully functional at the completion of the project. It is the contractor’s responsibility to connect all relevant utility lines. Contractor is responsible to pay all applicable fees and comply with any standards imposed by the respective utilities company.

The contractor shall restore all areas interior and exterior disturbed by construction to condition at least equal to that existing prior to construction.

7. Performance Period

Work shall commence within 14 days of NTP but not before receipt of performance bond and approval of submittals. All construction work shall be completed 90 days from NTP.

Proposal Requirements

Pre-bid site visit will be held on Wednesday, May 4, at 10:00 am EST. Bidders must attend pre-bid site visit to have their proposal considered.

Proposals will be evaluated based upon:

o Price o Past Performance – Submit references with bid o Quality of work – Submit photograph examples of prior work.

o Comprehension of scope – Initial material design ideas (Submit basic conceptual drawings / illustrations) o Experience – Submit list of staff/sub-contractors that will work on this project and their overall experience with similar projects.

o A list of all “green” and energy efficient products with quantity and costs shall be included (e.g. LED light fixtures, water sense plumbing fixtures, consumables and so on that meet energy efficiency criteria. This information will be used to meet DCIS reporting standards.) Please note the ligature resistance has higher priority than the energy efficiency of the selection.

Payments

Payments will be made on a monthly basis based upon the percentage of completion minus a

20% retainage payable once all work has been completed, final inspection has been made and all punch list items have been completed.

WORK SCHEDULE:

A. Delivery arrangement must be scheduled with the center prior to the start of work as determined by the need of the center’s staff.

PROPOSAL EVALUATION:

Evaluation factors of this solicitation event shall consist of the following: Price, Past Performance (submit references 2-4), Quality of Work (submit examples if desired), Technical Acceptance (written work plan will aid in determination).

FEDERAL, STATE, AND LOCAL TAXES:

Contractor understands that the government does not pay any IRS requirements (taxes), insurance or any other benefits for the contractor under this contract. This is in accordance with (FAR 52.229-3 FEDERAL, STATE, AND LOCAL TAXES (FEB 2013) and FAR 52.229-4 FEDERAL, STATE, AND LOCAL TAXES (NON-COMPETITIVE CONTRACT [FEB 2013]). 52.203-2 Certificate of Independent Price Determination (APR 1985).

(a) The offeror certifies that—

(1) The prices in this offer have been arrived at independently, without, for the purpose of restricting competition, any consultation, communication, or agreement with any other offeror or competitor relating to—

(i) Those prices;

(ii) The intention to submit an offer; or

(iii) The methods or factors used to calculate the prices offered.

(2) The prices in this offer have not been and will not be knowingly disclosed by the offeror, directly or indirectly, to any other offeror or competitor before bid opening (in the case of a sealed bid solicitation) or contract award (in the case of a negotiated solicitation) unless otherwise required by law; and

(a) The right of the Contractor to proceed may be terminated by written notice if, after notice and hearing, the agency head or a designee determines that the Contractor, its agent, or another representative—

(1) Offered or gave a gratuity (e.g., an entertainment or gift) to an officer, official, or employee of the

Government; and

(2) Intended, by the gratuity, to obtain a contract or favorable treatment under a contract.

(b) The facts supporting this determination may be reviewed by any court having lawful jurisdiction.

(c) If this contract is terminated under paragraph (a) of this clause, the Government is entitled—

(1) To pursue the same remedies as in a breach of the contract; and

(2) In addition to any other damages provided by law, to exemplary damages of not less than 3 nor more than 10 times the cost incurred by the Contractor in giving gratuities to the person concerned, as determined by the agency head or a designee. (This paragraph (c)(2) is applicable only if this contract uses money appropriated to the Department of Defense.)

(d) The rights and remedies of the Government provided in this clause shall not be exclusive and are in addition to any other rights and remedies provided by law or under this contract.

52.204-1 Approval of Contract (DEC 1989).

This contract is subject to the written approval of Andrew A. Rhoades, Contracting Officer and shall not be binding until so approved.

52.204-3 Taxpayer Identification (OCT 1998).

(a) Definitions.

“Common parent,” as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member.

“Taxpayer Identification Number (TIN),” as used in this provision, means the number required by the

Internal Revenue Service (IRS) to be used by the offeror in reporting income tax and other returns. The

TIN may be either a Social Security Number or an Employer Identification Number.

(b) All offerors must submit the information required in paragraphs (d) through (f) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26

U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the IRS. If the resulting contract is subject to the payment reporting requirements described in Federal Acquisition Regulation

(FAR) 4.904, the failure or refusal by the offeror to furnish the information may result in a 31 percent reduction of payments otherwise due under the contract.

(c) The TIN may be used by the Government to collect and report on any delinquent amounts arising out of the offeror’s relationship with the Government (31 U.S.C. 7701(c)(3)). If the resulting contract is subject to the payment reporting requirements described in FAR 4.904, the TIN provided hereunder may be matched with IRS records to verify the accuracy of the offeror’s TIN.

(a) Definitions. As used in this provision—

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and

“Data Universal Numbering System +4 (DUNS+4) number” means the DUNS number assigned by

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and

Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer

Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
