About this file

This is a Justification and Approval (J&A) document for the use of other than full and open competition in a federal procurement action.

The Naval Sea Systems Command Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD) seeks to award a firm-fixed price sole source contract to V2X for repair services of nine different Depot Level Repairable (DLR) parts. The parts include Driver Units, Electronic Components, Power Amplifiers, Filters, Oscillators, and Amplifier-Mixer Assemblies, with quantities ranging from 1 to 38 units across nine part numbers and NIINs. The procurement is justified under 10 U.S.C. 3204(a)(1) (only one responsible source) because repair activities must be certified to repair these DLR components in accordance with DoD Directive 5135.02, and V2X is currently the only commercially certified qualified Depot Source of Repair for these specific components. Certification of an alternative vendor would require approximately two years, which NSWC PHD determined would unreasonably delay fleet support and deplete remaining spare inventory. A sources sought notice was published via SAM.gov from April 1-8, 2026, yielding no industry responses. The Contracting Officer has determined the anticipated cost will be fair and reasonable. NSWC PHD is pursuing efforts to insource this repair capability through the DoD Instruction 4151.24 Depot Source of Repair Assignment Determination Process, expected to take approximately two years, after which commercial sources will no longer be required.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

10 U.S.C. 3204(a)(1) applies in this case because the repair activity must be certified to repair broken Depot Level Repairable (DLRs) components of the n accordance with DoD Directive 5135.02. At this time, V2X is the only repair facility that has been certified by the as a qualified Depot Source of Repair to service the components on this list. There are no other commercial entities and/or vendors that are currently certified. In fact, to certify another vendor to meet NSWC PHD’s needs, NSWC PHD would undergo an unreasonable delay of approximately 2 years. Specifically, based on NSWC PHD’s own efforts to bring this capability in-house, it would take another vendor approximately 2 years to establish the capability and become certified. A 2 year delay is unreasonable since it would interrupt fleet support and prevent the usage of the currently broken DLRs components of the

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Given the certification requirements associated with repairing the specialized equipment on this list, prospective repair facilities are limited to those who have achieved certification as a qualified Depot Source of Repair to repair these components. The process to achieve this certification typically takes over a year to complete for new offerors. In the meantime, the few remaining spares in inventory will be depleted and fleet support will suffer. As of this writing, V2X is the only commercial repair depot qualified to repair the items on this list. Efforts are underway to insource this requirement to DOD repair depots.

To further validate the lack of alternative sources, a sources sought notice was solicited via System for Award Management (Sam.gov) From April 01, 2026, through April 08, 2026. The sources sought notice specifically sought to identify any potential capabilities in the marketplace that could support the requirement for Evaluation and Repair of Parts. The Sources Sought yielded no responses from industry.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

Efforts are currently underway to insource repair of these components in accordance with DOD INSTRUCTION 4151.24 Depot Source of Repair Assignment Determination Process. This process is expected to take approximately 2 years. At the time this capacity is established, the need to seek commercial sources will no longer exist.
