About this file

This is a Justification and Approval (J&A) document for the use of other than full and open competition in federal contracting. The Naval Air Warfare Center Aircraft Division (NAWCAD) at Patuxent River, Maryland is seeking to award a sole-source contract to L3Harris Technologies, Incorporated of Palm Bay, Florida for integration and support of the Automatic Ground Collision Avoidance System (AGCAS) into Digital Video Map Computers (DVMC) and Digital Map Computers (DMC) in support of the PMA-209 platform. The contract has a total estimated value of $3 million for fiscal years 2026-2027, funded through Aircraft Procurement, Navy (APN) appropriations.

The required supplies and services include redesigning and delivering DVMC software to enable Digital Terrain Elevation Data (DTED) Level 1 and Shuttle Radar Topography (SRT) level 1F data utilization; integrating an Automated Terrain Awareness Warning System (ATAWS) software module into the DMC; performing software integration, testing, and modifications; executing non-recurring engineering and third-party/Government-performed flight testing of AGCAS; providing engineering and technical support; and performing software configuration management. L3Harris is justified as the sole source based on FAR 6.302-1(a)(2) because it is the original designer, developer, and manufacturer of the AGCAS, DMC, and DVMC systems with exclusive ownership of the technical data package and required intellectual property. The Government lacks adequate technical data and data rights to competitively award the requirement. A cost-benefit analysis indicates that awarding to another vendor would result in substantial duplication of costs estimated at $5.25 million due to the requirement for 1.75 to 3 times the labor needed to develop equivalent supplies and services. A Request for Information/Sources Sought was posted November 10, 2025, yielding three respondents, and a contract synopsis was posted December 10, 2025, with only L3Harris expressing interest. The Contracting Officer has determined the anticipated cost to be fair and reasonable, and the Procurement Activity Competition Advocate has approved the J&A.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with FAR 6.302-1(a)(2), the Government has deemed the requirements listed above to be available only through the original source and award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

L3Harris is the original designer, developer, and manufacturer of the AGCAS, DMC, and DVMC, hardware and software, and is the only source with the knowledge, expertise, and technical data required to successfully maintain these systems. The Government does not possess adequate technical data or the data rights necessary to competitively award this requirement. L3Harris Technologies, Inc. will not sell or provide Government Purpose Rights to the full technical data package (TDP) necessary to procure or obtain support for the items and is the only manufacturer that maintains the TDP to provide the qualified end items and support within the required timeframes. The Government is unable to compete this requirement without this intellectual property and associated rights.

Based upon data provided from the NAVAIR Cost Department Database, award of this requirement to a source other than L3Harris would result in a substantial duplication of costs estimated at $5.25M.

This estimate is based upon the NAVAIR cost department estimate, which determined that a new vendor would require between 1.75 to 3 times the amount of labor to develop equitable supplies and services as a result of the Government not owning the technical data. Therefore, L3Harris is the only responsible source and no other suppliers or services will satisfy agency requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The Request for Information/Sources Sought pursuant to DFARS PGI 206.302-1 was posted on the SAM website on 10 November 2025, three (3) companies responded providing capability statements;

however, without L3Harris’s technical data another sources would not be capable of performing the work without a duplication of cost and an unacceptable delay. The proposed contract was synopsized on the SAM website on 10 December 2025 and only L3Harris expressed interest in this requirement.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than L3Harris to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAWCAD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAWCAD will assess whether competition for future requirements is feasible.

As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
