JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD)
2. Description of the Action Being Approved.
NSWC PHD plans to award a firm-fixed price contract on a brand name basis for Energy Technology, Inc. branded Uninterrupted Power Supplies (UPS) in support of
3. Description of Supplies/Services.
NSWC PHD has a requirement to procure 23 new UPS, part number ETI0001-1237, brand Energy Technology, Inc., estimated at using FY23 and FY24 funds identified below. The UPS is a sealed unit containing a non-removable rechargeable, lead-acid, gel-cell battery and connects to the Power Distribution Unit (PDU) of a rack. In the event of a loss of ship’s power gives the system time to complete to safely power down the Rack in the hardware configuration.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1). The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency; IAW FAR 6.303- 2(b)(4).
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
Naval Surface Warfare Center, Port Hueneme Division (NSWC PHD) has no plans at this time to compete future contracts to support the for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
