This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Products and Commercial Services. Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the Government contemplates award of a firm-fixed-price contract resulting from this solicitation.

MSC Strategic Sealift Program Support Office, N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.usff.navy.mil, under “Business Opportunities”, select “Contracts”, then “Proforma”, or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the owner/offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

A. PART I-DRYVOY BOXES:

1. Vessel Required:

Request one, U.S. or foreign flag, self-sustaining vessel capable of carrying a minimum of 204 ammunition TEUs, while satisfying all applicable regulatory HAZMAT compatibility and segregation requirements.

A. Vessel LOA is not to exceed 948 ft. / 289 m.

B. Vessel draft not to exceed 50 ft. / 15.2 m.

2. Cargo Description:

• Cargo: 20-foot ISO shipping containers as per packing list. Average container weight of

25,000 lbs and maximum container weight of 40,000 lbs.

• Hazardous Material: Hazard Classes/Divisions 1.1 through 1.4S.

• Packing List: Contact MSC Contracting for packing list to be used for stow plan.

6. Laydays:

Two-day layday window, to be indicated by Offerors such that the ALD in Naval Magazine, Indian Island, WA and LAD at each discharging port are met.

7. Terms/Conditions/Attachments added, deleted or modified:

A. Health and Safety:

Owner/Offeror agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the Owner/Offeror agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.

B. Lashing Gear: Vessel must be fully outfitted with container deck fittings, semi-automatic twist locks, stackers, rods, and turnbuckles sufficient in quantity to stow and secure a full load of containers. If cargo stowage variances are required, proof of capability (Letter of Variance) must be provided.

C. Certificates: Provide most recent and complete copy (with all endorsements) of the Vessel Document of Compliance for the Carriage of Dangerous Goods and Certificate of Documentation. Upon award, provide most recent and complete copy (with endorsements) of the Vessel Certificate of Inspection (COI).

D. Stow Plan: Provide detailed stow plan showing required HAZMAT segregation, including vessel trim and stability values resulting from the proposed stow plan, using the provided packing list showing the vessel’s ability to support the requirement. Stow plan may be cross-checked in ICODES for feasibility - to include square footage, weight, trim, and stability issues.

E. Fully Bunkered: Vessel shall be fully bunkered for the voyage upon NOR submission.

F. Itinerary: Provide vessel itinerary showing vessel can meet the laydays proposed by the offeror.

G. Spreader Bar: Vessel must be equipped with a certified 20-foot spreader bar for each of its cranes.

H. Segregation: Contractor shall ensure segregation of all loaded munitions containers aboard the vessel in strict conformance of with all applicable regulations concerning the safe and proper loading and stowage of Arms, Ammunition, and Explosives (AA&E). Segregation of all commodities within the containers is the responsibility of the shipper.

I. Owners/Offerors shall acknowledge Classified Requirement:

a. There is a classified requirement in this solicitation. Owners or their representative, with appropriate security clearances in place, must submit to the contracting officer a request to review the classified requirement within one business day of the issuance of this solicitation and then must then make the necessary arrangements at their expense to view the classified requirement at appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the contracting officer does not receive a request on time or if the Offeror misses the appointment.

There is not a requirement to review the classified requirement prior to submitting an offer. Not reviewing the requirement prior to submitting an offer will not in and of itself render an offer ineligible for award.

b. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owners will be notified if their offers were excluded because of this requirement.

J. Part III(g) NON-GOVERNMENT CARGO: Amend to read:

Loading and discharging of other than Government cargo(es) directly associated with this charter, during the currency of this Charter, and itineraries therefor, is not allowed.

K. Part IV(m) SPECIAL REQUIREMENTS: Amend Paragraphs 2 and 3 to read

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
