About this file

This document is a Justification and Approval (J&A) for a sole source contract award. The J&A states that the incumbent contractor, CUI CUI (Sensor Technologies), was previously awarded a contract for TR-333 hydrophone ceramic elements, but none of the deliverable items passed required testing. The government has determined that it will not compete future contracts for these types of supplies at this time, unless another vendor emerges as a potential source. As this is a follow-on to a previous non-competitive award, the prior J&A will be provided for review by the approval authority. The government had previously planned to pursue a third vendor certification process, but due to unsuccessful prior efforts, the program office decided not to fund the certification. The approval of this J&A signifies the approval authority has made the determination required by the applicable regulation.

(Sensor Technologies) were awarded, and none of the deliverable items from those sources passed all required testing. For the reasons set forth in Paragraph 5 herein, Code GXP has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential vendor emerges, NSWC-CR will assess whether competition for future requirements is feasible.

As this is a follow-on for supplies previously awarded on a non-competitive basis, IAW DFARS PGI 206.304(a)(S-70)(i), the prior J&A will be provided to the approval authority for review. In the prior J&A, CR-19307, it was noted the Government would take steps to pursue a third vendor as an additional potential source for the Hydrophone Ceramic Elements. In this pursuance, the Government's plan was to obtain funding, if available, and have the potential third vendor begin the certification process.

However, the Program Office made the determination to not fund the first phase of the certification process due to previous unsuccessful efforts that were funded to certify a new vendor.

Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii) based on the information detailed above herein.
