PROJECT DETAILS

This section provides a summary of the asbestos-containing materials which will be addressed as part of the bid. The scope of work and general work practice requirements are provided in the Asbestos Specification and other construction documents and attached to this Request for Proposal. The Contractor is encouraged to review all aspects of the scope of work when preparing the bid. Please include your proposed schedule in your bid documents.

20.01 Central Elementary School

Performance Environmental Services, Inc. (Performance) identified various asbestos-containing flooring mastics within the main section of the school building (refer to Performance Project #2510112, report dated 01/21/25, and Performance Project #2510164, report dated 02/04/25, copies are located in Appendix 1). The abatement will include removal of all installed flooring materials including carpeting, floor tiles, floor mastics, and covebase materials but the scope of work will exclude ceramic floor tiles and associated bedding materials. Please note that the approximate quantities were detailed within the original report #2510112. The approximate quantities within report #2510164 are not additional quantities; instead, they were accounted for within the first report (#2510112).

No asbestos abatement activities will be required within the gymnasium and the adjacent hallway/rooms directly to the west.

The entire area cannot be released for work at one time; therefore, the work will be completed in phases although the phases will be larger. In addition, the flooring in the multi-purpose room will need to be abated during spring break (Sunday, March 29 – Sunday, April 6, 2025) when the building will become available (refer to map in Performance #2510112 report within Appendix 1 or the map in Appendix 2). Please note that the abatement of the asbestos-containing flooring mastics will require non-chemical methods (i.e. grinding).

The accessible work hours allow for a M-F, 7:00 a.m. to 5:00 p.m. schedule to complete the project. Initial work at the site can begin during spring break (Sunday, March 29 – Sunday, April 6, 2025) with the remainder of the work beginning on Tuesday, June 10, 2025 after school year has ended. Please include your proposed schedule for project completion in your bid documents.

BIDDER’S AGREEMENT AND CERTIFICATION

The undersigned Bidder, having fully examined the project detail documents as well as all other associated information including the addenda listed (if any), and having familiarized himself with the conditions to be encountered affecting the cost of the work, does hereby propose to satisfactorily complete all activities required to be performed and to furnish all of the labor, materials, tools, equipment and all other necessary additional services needed to complete the asbestos abatement activities required in connection with this project. Addenda issued by Linden Community Schools (LCS) or Performance Environmental Services, Inc. (Performance) and acknowledged by the Bidder, are made part of the project documents and are listed on the following page.

All Bidders were provided the opportunity to attend the pre-Bid Proposal meeting and provided the opportunity for an accompanied tour of the building, and all Bidders have been encouraged and provided the opportunity to examine the project site/building and familiarize themselves with the work described in the project detail documents. The submission of a bid for the project(s) described in the project detail documents shall be deemed conclusive evidence that the Bidder has thoroughly examined all documents constituting this project (including, but not limited to, those items listed above), has familiarized himself with the work and requirements described, and shall constitute a waiver by each of all claims of error in bid, withdrawal of bid, or payment of extras, or combination thereof, under the executed contract, or any revision thereof. All figures set forth in the project detail documents referencing sizes, amounts, or materials are estimates only and are provided for the convenience of the Bidder. These project detail documents including, but not limited to, the Bid Advertisement, the Project Details, the General Conditions and the Asbestos Specification for Abatement, have attempted to detail and address all aspects of the projects being performed for LCS. Nonetheless, the successful completion of the projects in a safe manner and in compliance with all applicable regulations remains the foremost concern of LCS. To ensure that this goal is met, it is expressly agreed by and between the parties to the contract, hereinafter to be signed between Linden Community Schools and the Contractor, that LCS and/or Performance, as the Owner’s Representative, have complete control over the manner in which the projects shall proceed and may, in their sole discretion, waive provisions of these project detail documents or require and enforce more stringent or different provisions should they, in their discretion, determine that such changes will or may more fully protect LCS, the Contractor, their subcontractors, agents, servants or others under their control or direction or the general public from any risks and/or situations associated with the said projects.

This provision in no way constitutes a waiver by the Contractor of his/her responsibilities to conduct said projects in accordance with all applicable regulations and in accordance with these specifications. This provision is set forth and is intended to provide LCS and/or Performance with the power to require additional steps to be taken to ensure that the projects proceed in a manner to fully, to the utmost extent possible, protect LCS and/or Performance, as well as the general public, from risks and liability associated with such projects.

After the bids are received, tabulated and evaluated by LCS and/or Performance, and the apparent lowest qualified Bidder(s) for each Bid item has been determined, the Bidder(s) agrees to meet with LCS and/or Performance, if so requested. For purposes of these meetings, the Bidder agrees to provide any post bid information as listed in the General Conditions. The Bidder, if awarded a contract, agrees to commence all pre-project planning and preparation activities upon receipt of a written “Notice to Proceed/Letter of Intent” and to fully complete their work in accordance with and to conform to the activity dates and durations set forth in the project detail documents.

The signature of a representative for the Bidder on each applicable project constitutes a full and complete agreement with the Project Specifications and the Bidder’s Agreement and Certification. GENERAL REQUIREMENTS FOR ALL PROJECTS

The following general project requirements pertain to all of the asbestos abatement projects at the LCS building covered by this Request for Bid.

After the seven-day period, the Owner or Performance will complete the corrective measures at the Contractor’s expense. The Contractor will be required to dedicate two laborers for general clean-up activities throughout the building (as directed by the Owner or Performance) for two days for each project to address “punch list” type items such as pieces of tape/poly or tape/glue residue. The dates will be coordinated at the completion of all abatement activities.

ASBESTOS PROJECT NOTIFICATIONS

All regulatory agencies including, but not limited to, the Environmental Protection Agency, the Michigan Department of Labor and Economic Opportunity, the Michigan Department of Environment, Great Lakes and Energy and/or all other applicable Federal, State, County or City municipalities should be notified within the proper notification period in order to start on the first start date, if applicable. The Contractor shall also be solely responsible for payment of all applicable fees and charges. Failure to notify in a timely manner will not excuse a Contractor from project penalties or from any citations for performing abatement activities without a proper notification. The Contractor(s) shall be responsible for submitting a notification which adequately covers all projects at the building. By submitting a bid, the Contractor agrees to be fully responsible for the notification process.

The Contractor must submit a copy of any notification to the Owner and Performance prior to commencement of the project and in sufficient time to make corrections, if necessary. Copies of all revised notifications should also be provided in a timely manner.
