About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition, issued by the Navy Surface Warfare Center, Port Hueneme Division (NSWC PHD). The document authorizes a sole-source contract with Resources Analysis Corporation (RAC) for a Supportability Management Assessment Report Tool (SMART) software license, valued for the period of September 2025 through September 2029. The software will support Diminishing Manufacturing Sources and Material Shortages (DMSMS) solutions by providing capabilities such as Bill of Material loading, real-time data monitoring, software implementation, solution analysis, executive reporting, and data integration.

The J&A emphasizes that RAC is the exclusive provider of SMART software, with unique proprietary features that cannot be replicated by other sources. A sources sought notice posted on SAM.gov from 02/18/2025-03/04/2025 received two responses, but neither was deemed capable. The document notes that switching to an alternative software would incur substantial costs (estimated at $150,000) and cause a 6-month delay in obsolescence management. The Contracting Officer has determined the anticipated cost to be fair and reasonable, and while there are currently no plans to compete future contracts, the circumstances will be reviewed annually.

Navy Marine Corps Acquisition Regulation Supplement APRIL 2018 (Change 18-24)

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1). The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency; IAW FAR 6.303-2(b)(4).

5. Rationale Justifying Use of Cited Statutory Authority.

RAC is the only source that provides the SMART software, that can meet the current configuration and interface requirements to support and identify Diminishing Manufacturing Sources and Material Shortages (DMSMS) solutions for obsolescence issues in the program. The SMART Database is already in place and is the only database tool used for DMSMS tracking, investigating, and providing obsolescence solutions for the program across all baselines. program are dependent on having the ability to rely on providing, updating, procuring, identifying, and maintaining obsolescence configuration across all Baselines through the SMART software.

Specifically, SMART is the only tool that delivers and supports the following services:

•Bill of Material (BOM) loading with data cleansing & scrubbing •Ensuring the highest degree of accuracy and completeness obtainable •Real-time and continuous data monitoring services with alert notifications •Software solutions with implementation, deployment and training services •Solution analysis and assessment with recommendations and resolutions •Executive Reports for obsolescence impacts and funding justification •Return on investment and cost avoidance metrics and reporting •Identification of Life of Type Buy parts with consignment services. •Data integration and software customization solutions.

No other software can deliver and support the above-stated required services while maintaining the required configuration and interface to support and integrate with the to identify DMSMS solutions for obsolescence issues in the program. Furthermore, RAC holds proprietary rights to their SMART software and have confirmed that RAC has no authorized third party resellers or manufacturers. Therefore, since no other software can meet the Government’s needs and since the software is only available through RAC, if the Government were required to utilize a different source, the Government would incur a substantial duplication of cost of a minimum of $150,000 that is not expected to be recovered through competition and an unreasonable delay of at least 6 months. This estimate is based on the Government’s requirement to find a suitable replacement, test that replacement to ensure the software could provide the same level of transparency, configuration, and interface as the current SMART program, and the initial set up to implement and integrate a new software within the program. A delay of at least 6 months would be unreasonable because it would cause a delay of a complete turnkey obsolescence management solution set.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

SMART has been used by the Program as well as other programs for the past 5 years. The capabilities that SMART provides are unmatched by any other software investigated. RAC is the OEM of SMART and this tool is not available from any third party provider.

Contract specialist/buyer posted a sources sought to SAM.gov from 02/18/2025-03/04/202 and received 02 responses, however neither response was found to be from capable sources.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NSWC PHD Contracting Division has no plans at this time to compete future contracts for the types of services covered by this document. The circumstances surrounding the need to obtain the required services without providing full and open competition will be reviewed annually by the Procuring Contracting Officer (PCO). If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
