Supplementary Conditions (which contain amendments to the General Conditions and additional specifications not found in the General Conditions format, unique to La Plata County); Project

Conditions; Owner’s Revisions (which are the revisions to the 2022 CDOT Specifications pertinent to this project and specific bid items); the Project Drawings and Plans; and, Addenda.

All of the documents contain important instructions to the Bidders regarding the materials and methods required to bid the project and may or may not be cross referenced in all documents.

This IFB incorporates all of the above listed documents, contract forms, submittal requirements and instruction to Bidders, bid forms, the advertisement for bid, and all other documents herein.

The IFB will be incorporated in the bid as if fully set forth.

SPECIAL CONSTRUCTION REQUIREMENTS

Protection of the Public

The most important aspect of the project is the safety of the public. People will be curious and inconvenienced and are capable of many thoughtless actions in their attempts to observe and travel through the construction site. The Contractor will be subject to the following:

1. Project Safety Plan and Traffic Coordination/Closure and Detour Plan.

2. Erosion/Stormwater Protection Plan and Dust Control Plan for County review.

3. Project Maintenance: The Contractor will be responsible for the following items twenty-four (24) hours a day, seven (7) days a week for the duration of the project.

a. Temporary and permanent drainage, including: protection from any collected flows near the roadside, project-related off-site locations, and Contractor’s borrow and disposal areas and staging areas.

b. Road surface, including: all adverse weather-related conditions during the subgrade and graveling portions of the work, and dust control during all portions of the work.

c. The Contractor shall clean, smooth, repair, maintain, and complete all construction activities on the last working day of each week to an acceptable manner to the Project Manager/Engineer before leaving the Site over the weekend. Cut ditches and temporary drainage shall be functioning. The

Contractor’s Erosion Control Plan shall be implemented. Open excavations and unsafe slopes shall be marked with flagging, orange construction fencing, or orange barrels.

4. Coordination with property owners concerning continued driveway accessibility, staging area agreements, replacement of irrigation system, and fencing of stock pasture.

5. Any temporary or permanent construction activities that are partially complete or complete that may endanger the traveling public shall be protected at all times with proper traffic control devices as defined by the latest MUTCD standards and including after project hours and weekends. All said related devices shall be incidental to the work and shall not be paid for separately unless defined otherwise by the Contract Documents.

6. Any accidents or damages to private property and traveling citizen vehicles, including windshields, will be paid for by the Contractor and reported to the County’s Project

Manager/Engineer. Photographs shall be taken and submitted with reports.

Working Days

Regular Working Days shall be Monday through Saturday. If the Contractor requests working on Sundays and holidays, written notice shall be given to the County’s Project Manager/Engineer five (5) working days prior to that Sunday or holiday work. Notice shall include location, type of work, number of personnel and equipment, and status of detours. An Overnight Checking plan for maintaining traffic control, project security, and safety features overnight by twice (2x) nightly checks and over the weekend or holiday will be submitted as part of the traffic control plan.

Working Hours

Regular Working Hours will be from 7:00 AM to 6:00 PM. The Contractor will have construction activities stopped and cleaned up for two lane traffic by 6:00 PM. All project activities shall end at least one (1) hour before dark, unless written permission is received. All traffic control personnel shall be off the project by thirty (30) minutes before dark. If the

Contractor requests working before or after these hours, written notice shall be given to the

Project Manager/Engineer forty-eight (48) hours in advance and a special Traffic Control Plan for each special case or phase shall be submitted.

Protection of Landscaping

Contractor shall be responsible for repair or replacement of any fencing, landscaping, waterlines, irrigation systems, or utility lines that lie outside of County Right of Way, damaged during the construction. All materials shall be kept away from landowners’ fencing at all times.

Project Meetings

Preconstruction Conference – The Contractor and the County’s staff shall have a pre-construction conference prior to any work activities beginning on the project. All key personnel from both parties shall be in attendance at this conference, as well as utility company representatives, and any other outside individuals that may play a role in the construction process. The Contractor and the County will exchange letters at this conference, each naming their primary and secondary contacts who will be the authority and be designated to speak for each party in case of any oral directives or agreements.

The following is a tentative preconstruction conference agenda:

• Authority & Responsibilities

• Traffic Control Plan & Supervisors, Twenty-Four (24) Hour Traffic Control

• Project Safety

• List of Subcontractors and Suppliers

• Identification of Key Personnel of all Parties

• Construction Project Schedule

• Submittals

• Sampling and Testing of Materials

• Project Inspection

• Project Administration

• Coordination and Protection of Utilities

• Coordination and Protection of Adjacent Private Property (maintain driveway access, etc.)

• Progress Payments and Billing Format

• Final Site Restoration

Project Inspection

The County’s Inspectors will act as observers and field representatives for the project.

The Contractor will be responsible for constructing all phases of the work under these provisions. It will be the Contractor’s responsibility to coordinate his work with subcontractors, utility companies and the public in general. The County will have the authority to question the

Contractor’s means and methods of construction as they apply to the requirements of the plans and specifications and the County reserves the right to ask the Contractor to perform a test section before proceeding with their operations. If it can be clearly established that the use of a certain piece of equipment to do a specified job will, in all probability, result in inferior construction quality, it is within the authority of the County to require that appropriate changes be made.

The County shall provide a Quality Control program through a Licensed Materials Testing Lab.

The Contractor shall notify the County twenty-four (24) hours in advance of any inspection and testing required as part of the Contract Documents. Work that has been completed, or partially completed, and has been covered up by the Contractor prior to the inspection or testing, shall be subject to possible removal and replacement and may require additional testing, all at the expense of the Contractor. Failure of a County Inspector to observe a deficiency does not relieve the Contractor of obligation for performance. Extra inspections required as the result of the

Contractor’s deficiencies will be paid for by the Contractor at the County Inspector’s current rate. The Contractor shall pass on all test data to the County and shall notify the County’s testing lab of tests at the direction of the County Inspector.

Inspection Procedures – The Inspector will require a delivery ticket for each load of concrete, gravel, asphalt or any other material bid item that will require weighted measurements delivered to the project. All of the tickets will be collected by the Contractor’s foreman and copies given to the Inspector at the end of each work day. If these tickets are not turned in by the end of the work day, there will be a $150 credit given to the County and assessed at the next pay voucher.

No payment will be made for tickets turned in later than the end of the next day after the material is delivered. It will be the Contractor’s responsibility to ensure that the Inspector receives the delivery tickets. The Contractor will compile all of the tickets into a Material Weight Sheet Log and review it with the Inspector prior to formalizing each Progress Payment for submittal as an invoice. Any rejected loads or non-compliance areas will be noted on the Material Weight Sheet

Log.

Progress Payment (Quantities)

A Material Weight Sheet Log and supporting delivery tickets are to be submitted with each payment request. With each Progress Payment it will be the Contractor’s responsibility to provide concise, accurate and complete quantity information. Failure to provide such information may result in delayed payment or rejection until proper information can be submitted. The County’s Project Manager/Engineer reserves the right to question in-place quantities, partial payments, and other items deemed necessary before each Progress Payment is approved. It will be the Contractor’s responsibility to measure each work item for in-place quantities and the County’s responsibility to independently check and verify the Contractor’s quantities. The Contractor and the County’s Inspector will agree on each monthly Progress

Payment quantity before any Progress Payment is processed.

Submittal Requirements (Note: This reference pertains to the Contractor’s obligations post-award; not to be confused with Submittal Requirements noted elsewhere in this IFB for the bid submission.)

The word “Submittals” shall be interpreted to include drawings, data, manuals, certifications, test reports, curves, samples, color chips or charts, brochures, acceptance letters, and any other items furnished by the Contractor for acceptance, approval, review, informational or other purposes.

The Contractor shall furnish all materials and perform all work required for furnished submittals to the County’s Project Manager/Engineer in accordance with the Contract Documents and

CDOT Standard Specifications for Road and Bridge Construction, 2022 edition. A list of submittals for this project will be available after contract award. The submittals shall be submitted in a timely manner to allow for County review prior to the work. Insufficient lead time for the County review process will not relieve the Contractor’s obligations to construct the work in accordance to the Contract Time and maintain the quality level as prescribed by the

Contract Documents, Drawings, and Specifications, nor will it obligate the County for damages due to delays resulting from untimely submittals.

Project Safety Plan

The Project Safety Plan must address the Contractor’s plan for employee safety on the job. The

Contractor may adopt an existing set of standards, such as the Bureau of Reclamation or other agency with an umbrella-type plan for construction work. The Contractor must address safety at the various work stations and working areas expected to be encountered for this particular project. Personal safety equipment, vehicle and equipment safety procedures and mixing/crushing plant provisions for creating a safe work site should be included in the plan.

The plan should be submitted prior to the beginning of construction.

Traffic Coordination/Detour Plan

This submittal should address a complete plan for traffic control for the various phases of the project. It should be formulated after reading and understanding the requirements of these specifications. The plan should include a traffic control plan of the detour, number of traffic personnel, equipment, and the methodology for traffic control. The Contractor shall determine the twenty-four (24) hour traffic control method, detail the method to be used, and be prepared to defend its selection. The County reserves the right to adjust or reject the twenty-four (24) hour traffic control method if the safety of the public is not adequately addressed. Vehicle delays or stopping time should not be more than twenty (20) minutes total through the project. No stopping delays of more than ten (10) minutes are allowed from 7:00 AM to 8:00 AM and from

4:30 PM to 5:30 PM. The Contractor shall provide two (2) warning signs outside the project alerting the traveling public to potential delays of up to twenty (20) minutes, location to be determined in on-site by the County.

Protection of Utilities

The Contractor shall comply with Article 1.5 of Title 9, CRS (“Excavation Requirements”) when excavation or grading is planned in the area of underground utility facilities. The Contractor shall notify all affected utilities at least two (2) business days, not including the day of notification, prior to commencing such operations. The Contractor shall contact the Utility Notification

Center of Colorado (UNCC) at (8-1-1) or 1-800-922-1987 to have locations of UNCC registered lines marked by member companies. All other underground facilities shall be located by contacting the respective company. Utility services laterals shall also be located prior to beginning excavating or grading.

The location of utility facilities as shown on the plan and profile sheets if provided, and herein described, were obtained from the best available information. All costs incidental to the foregoing requirements will not be paid for separately but shall be included in the work.

OWNER’S REVISIONS

The following provisions take precedence over Specifications, Plans, or Project Standard

General Conditions (ASCE), except as precedence is specifically noted in these Revisions, and supplement the 2022 edition of the Colorado Department of Highways “Standard Specifications for Road and Bridge Construction” (Standard Specifications), which is to be used to control construction of this project.

Revision of Section 107 – Legal Relations and Responsibility to Public

Section 107 of the Standard Specifications is hereby revised for this project as follows:

Section 107.06 shall be revised to include the following:

The Contractor and any subcontractor shall not require any laborer or mechanic employed in performance of the Contract to work in surroundings or under working conditions which are unsanitary, hazardous, or dangerous to their health or safety, as determined under construction safety and health standards [Rules and Regulations of the

Federal Occupational Safety and Health Act of 1970 (OSHA) and as amended].

All facilities and work conditions shall comply with Colorado and local Health

Department Regulations and with OSHA requirements. The Contractor shall have on the site, during working times, first aid supplies and a person certified to Advanced First Aid level at a minimum to perform first aid.

Subsection 107.17 – Delete the last paragraph beginning with “Loss, injury, or damage to the work…” and replace with the following:

The Contractor is responsible for, and must protect and restore from damage, the existing and proposed roadway within the project limits and the existing and proposed drainage features from flooding, as flooding is defined in other parts of this specification.

Revision of Section 109 – Measurement and Payment

Section 109 of the Standard Specifications is hereby revised for this project as follows:

Subsection 109.07 – Delete and replace with the following:

Partial monthly payments to the Contractor for completed work will not include payment for the value of the materials on hand or on site that have not been actually incorporated into the completed work. Payment shall be for bid items completed or partially completed in place, as agreed with the Engineer prior to billing.

Revision of Section 712 – Miscellaneous – Water

Section 712 of the Standard Specifications is hereby revised for this project as follows:

Subsection 712.01 Water shall be revised to include the following:

The Contractor shall be responsible for securing an adequate supply of water sufficient to complete all tasks within each phase of the project. Lack of water or additional fees incurred in the acquisition of water shall not constitute a legitimate claim for additional time or compensation.

The term of the Agreement shall be from the date of the Agreement execution until

December 5, 2025.

2. Depending on budget appropriations and the needs within the Engineering Division, the

5. Local government officials or employees shall not be interested in any contract made by them in their official capacity or by any body, agency, or board of which they are members or employees.
