About this file

This is a Solicitation Addendum No. 1 issued by the Beaverton School District 48J in Oregon for RFP 25-0027, addressing Hot Works and/or Refrigeration Maintenance Service and Repair. The addendum clarifies key operational requirements and modifies the original solicitation deadline to June 23, 2026, at 2:00 PM Pacific Time. The addendum addresses critical questions regarding after-hours work scheduling, emergency response timelines, contractor liability standards, and warranty coverage. After-hours work is clarified as rare, occurring approximately 5 times annually when primary walk-in freezers or coolers require attention following the school day. Emergency response requirements mandate a maximum of two hours from initial notification to accept the service call, with up to seven days for actual unit servicing coordinated with BSD representatives. The addendum confirms that contractor performance must align with generally accepted professional standards, with liability limited to direct damages as defined by the contract terms and liability caps. Proposers must acknowledge receipt of this addendum on the Proposer Certification Form, as failure to do so may result in proposal rejection.

The addendum explicitly states that the District will not modify the RFP to accommodate individual bidders' current business practices; however, proposers are encouraged to submit requested deviations, exceptions, or proposed modifications to the Scope of Work and contract terms as part of their proposal for consideration during the evaluation and negotiation process, with no guarantee of acceptance. Proposed changes submitted by bidders regarding labor warranties (30 days) and parts coverage (90 days) and standard operating hours (Monday through Friday, 7:00 AM to 5:00 PM) are noted but remain subject to District discretion during contract negotiations.

CLARIFICATIONS:

Q1. Section ll – Statement Of Work M. Timing and Rates

• Is the request to schedule work after hours a regular event or is it occasional. Are you able to provide how often this has occurred during the past 12 months??

A1. Work after hours is only required when a primary walk in freezer and/or walk in cooler are high temping at the end of a school day. After hours work is rare with approximately 5 total calls during this last fiscal year.

Q2. Section ll – Statement Of Work O. EMERGENCY PROJECTS: Where emergency response is required:

1. The maximum response time shall not exceed two (2) hours from time of initial notification, seven (7) days a week.

• Is this 2-hour time referring to accepting the service call or having the technician on site?

A2. The 2 hour time refers to the initial notification to respond and accept the service with up to 7 days to service the unit. Scheduling is coordinated with the BSD representative.

Q3. Contractor Responsibilities

a. Contractor shall exercise best professional judgment in performing the Contract services and shall be liable for any loss incurred by BSD resulting from failure to meet standards.

Can you clarify what this refers to? What liability are you referring to?

A3. Performance should be consistent with generally accepted professional standards. Failure to meet standards refers to performing the work within an agreed scope and reasonable control.

Liability is limited to direct damages, liability cap and how "loss incurred to BSD" is defined.

Q4. Are you willing to make changes to the RFP that reflect bidders’ current business practices? See below proposed changes?

J. EQUIPMENT AND PARTS WARRANTIES

Proposed change:

Labor is guaranteed for 30 days and parts are covered for 90 days from the date of service. If any issue arises within these periods related to the original repair, vendor will return promptly at no additional labor cost to correct the problem, ensuring equipment is fully operational and meets customer expectations.

M. TIMING AND RATES

Proposed change:

Standard operating hours, Monday through Friday, 7am-5pm. If required, vendor will work with BSD to schedule work outside the standard operating hours at the standard operating rate.

A4. The District will not modify the RFP to align with individual bidders’ current business practices.

However, proposers are encouraged to clearly identify and submit any requested deviations, exceptions, or proposed modifications to the Scope of Work and/or contract terms as part of their proposal. The District will review and consider such requests during the evaluation and negotiation process but makes no guarantee that proposed changes will be accepted.
