Sole Source Justification (SSJ) For Simplified Acquisitions (over the micro-purchase threshold and up to the Simplified

Acquisition Threshold (SAT)) pursuant to FAR 13.106, including Brand Name

Sole Source Justification

1. Agency and Contracting Activity.

The Department of Homeland Security, U.S. Secret Service (USSS), Procurement Division, proposes to enter into a contract on behalf of the Forensic Services Division (FSD).

2. Nature and/or description of the item/service being procured and anticipated cost.

The USSS intends to award a sole sourced firm-fixed price purchase order for a Chromira 5 ProLab Service Agreement. To include but not limited to: Unlimited Priority Software and Equipment Error Diagnostics. Exchange of any defective components with a target time of 24 hours or less after calling in PPM. Free shipment of replacement parts to the customer. Free mechanical upgrades as needed, at the discretion of ZBE, Inc. Free Software upgrades, if and as ZBE, Inc. releases applicable commercial revisions, one. Travel expenses are the responsibility of the customer.

3. Identification of the authority and rationale.

The proposed procurement will utilize simplified acquisition procedures and will be awarded on a sole source basis in accordance with FAR 13.106-1(b)(1) and as specified below.

Rationale:

ZBE, Inc. is the sole manufacturer of Chromira 5x ProLab equipment as well as of any parts needed to repair the equipment. ZBE, Inc. uses only its own trained technicians for service and repair of its equipment. ZBE, Inc. is the exclusive sole source for service on all Chromira Systems in the United States. The hardware and software are proprietary to ZBE, Inc.

The print quality capabilities of the Chromira 5x ProLab are improved and the archival stability and fade resistance of its prints are better than any similar product that we reviewed. There is also an improved chromatic range of the printer’s calibration, which

The Chromira 5x ProLab prints approximately 1440 4”x 6” prints per hour, 408 8” x 10” prints and 35 30”x 40” prints per hour compared to the HPZ3200 inkjet which prints approximately three 30” x 40” prints per hour.

The acquisition of the Chromira 5x ProLab Premium Service agreement is essential to maintain the quality and decrease the production time of the Forensic Photography Branch’s (FPB’s) end product.

4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2).

Market Research;

Comparison of the proposed price with prices found reasonable on previous purchases;

Current price list;

Comparison with similar items in a related industry;

Comparison to Independent Government estimate;

Contracting Officer’s personal knowledge; or Other reasonable basis.

5. Other Information.

The USSS and FSD continually surveys the market for vendors that can provide technicians that can provide service and repair of the Chromira printer currently in use.
