Statement of Work (SOW) Design Build/Design Bid Build Multiple Award Construction Contract (MACC)

1.0 SCOPE

The Contractor(s) shall provide all management, labor, material, equipment, transportation, supervision, environmental, safety, and quality controls to accomplish the following anticipated tasking under to be included within orders placed under this Indefinite Delivery Indefinite Quantity (IDIQ) contract: new building construction, unspecified minor construction (UMC) as defined per 10 U.S.

Code 2805, building or building systems renovation, Sustainment Restoration and Modernization (SRM), structural repairs, site work, indoor/outdoor test ranges, clean room, industrial roofing, anechoic chamber, explosive storage, (calibration, radiological, explosive) laboratory, historical building renovation, FF&E, paving, Design-Bid-Build Construction, and Design-Build construction to include both Design and Construction within a singular task order. Activities incidental to construction may include work such as building/facilities demolition and debris removal, utility installation/replacement, equipment upgrades, landscaping, geotechnical work, mechanical, electrical, plumbing, security systems, and abatement of materials of environmental concern (e.g. materials containing lead, asbestos, Polychlorinated biphenyls (PCBs), or Hazardous Toxic Radioactive Waste - HTRW) at the following locations: Naval Surface Warfare Center, Crane Division (NSWC Crane) and/or Lake Glendora Test Facility (LGTF). Project volume under the MACC is anticipated to support up to five projects running concurrently at a given time.

The following are also considered within the scope of this contract:

Field surveying of sites to document existing and as-built conditions for all work (e.g.

utilities, mechanical electrical plumbing systems, grading, sidewalks, etc.), and mapping required to update GIS (geographical information system).

Sampling of existing conditions which may include geo technical boring at work sites;

analyzing samples, and test reports indicating to the Government soil-bearing capacity and soil contaminant presence. (CDRL A023) Depending on the outdoor area where soil excavation and removal activities are occurring, there is the relatively low potential for buried radioactive commodities (typically Nuclear Regulatory Commission (NRC)-exempt or NRC Generally-Licensed) or radiological contamination in the soil. Reports shall be submitted to the Contracting Officer’s Representative (COR) via Contract Data Requirements Listing (CDRL A022).

Sampling, abatement, and testing of potential existing hazardous construction materials (e.g. lead, asbestos, PCBs or HTRW). Radiological contaminants or commodities such as smoke detectors (Am-241) or tritium exit signs may be encountered during building renovations. Providing test reports to the Government documenting materials sampled.

Reports shall be submitted to the COR via (CDRL A023).

Design-Build projects are anticipated under this MACC. Design-Build project orders will include preparation of drawings and specifications for renovation, additions, repair or new construction projects. Design meetings with the government may be required to agree on design-build solution(s) that meet the government’s project requirements.

Electronic document delivery details will be specified at the order level. Electronic delivery shall include both .pdf and .dwg formats.

• NOTE – Established relationships between the general contractor and associated design firm are considered favorable to the Government. The general contractor will be expected to maintain a productive relationship with their design firm of choice throughout the life of this IDIQ.

Deviations from that relationship will require written submission to the Government detailing reasoning for deviation. Adjustments to general contractor/design firm relationships will require written approval from the Contracting Officer.

Work performed under this contract will be of varying complexities and require multiple disciplines working simultaneously to include coordination with Architect-Engineer (A-E) firms as necessary. All such work shall be accomplished in strict accordance with all applicable Navy and local instructions, processes, and procedures and applicable building and life safety code requirements.

All policies, procedures, instructions, regulations, etc., outlined herein are to be adhered to by both Prime Contractor and Subcontractor employees during the performance of a resultant task order (TO).

1.1 Background

NSWC Crane’s Infrastructure Division is tasked with providing infrastructure acquisition and construction management capabilities for NSWC Crane and Lake Glendora Test Facility. The Acquisition and Construction Management Branch (Code 1022) roles and responsibilities include:

Infrastructure and Sustainment, Restoration, and Modernization (SRM) acquisition planning and execution oversight; Infrastructure engineering; Design management; SRM project development;

Facilities project planning and implementation; Unspecified Minor Construction (UMC) management;

Facilities engineering; and Construction management. The construction management function focuses on engineering construction management, project cost, schedule development and tracking;

construction oversight to include submittal review, progress reports, engineering changes, site safety, beneficial occupancy closeout, punch list adjudication, and warranty support.

2.0 APPLICABLE DOCUMENTS

All work performed under this contract shall be performed following applicable Government plans, standards, policies, and processes. The Contractor’s activities shall conform to the systems test and operations environment and standards including all updates, improvements, and additions to these process documents made over the life of the contract. The Contractor shall use the Department of Defense (DoD) Unified Facilities Criteria (UFC) for facilities and infrastructure construction and modification Deviations from these processes, policies, and procedures are not authorized without advance approval by the COR.

All projects under this contract shall comply with the most recent edition of all applicable federal, state, and local laws, codes, UFGS specifications, Unified Facility Criteria standards, and regulations.

The following document version or most recent issue in effect at the date of TO award. In the event of conflict between the documents referenced herein and the contents of this SOW, the contents of this SOW shall prevail.

3.0 REQUIREMENTS

3.1 Project Requirements

Each Task Order (TO) will specify the project requirements. The following are required in all TOs:

a) Procuring/providing all construction equipment, labor, materials, plans and specifications (CDRL A007), Asbuilts, and all documentation necessary for timely completion of projects.

The Contractor shall maintain all certification and re-certification equipment paperwork;

inspection records daily reports, and all applicable permits.

b) Provide a project baseline schedule prior to PAK meeting of each TO (CDRL A018) in .PDF and .XER(Primavera) or .MPP(Microsoft Project). A Government approved schedule in accordance with UFGS 01 32 01.00 10 Project Schedule is required prior to commencing work on any project. Upon approval of the baseline schedule the contractor must provide a Cost Loaded Schedule in accordance with UFGS 01 32 17.00 20 Cost-Loaded Network Analysis Schedules (NAS). The Contractor shall be required to provide construction schedule monthly with each pay application throughout the duration of the project.

c) Conducting a site visit prior to commencing work to verify existing conditions; coordinating with NSWC Crane/NAVFAC to confirm location and type of existing utilities at buildings or sites that may be impacted by construction work.

d) Regularly inspecting all work to ensure it is in accordance with all project requirements, design documents, and safety requirements.

e) Obtaining all permits and regulatory approvals required to perform work. Such permits may include but are not limited to: Indiana Department of Environmental Quality (IDEQ), dig permits, confined space, Naval Ordnance Safety and Security Activity (NOSSA), and hot work permits. (CDRL A019)

f) Operation and Maintenance Support Information (OMSI): Providing training to the Government on operating and maintaining all critical systems. The Contractor shall submit to the Government all Operation and Maintenance (O&M) manuals at the conclusion of each Task Order.

g) Provide Daily Project Status Reports. (CDRL A009)

h) Provide a Bill of Materials (e.g., submittals) before material is purchased for approval by RTA (CDRL A014). Frequency and timing of Bill of Material submissions will be determined at the Task Order level.

3.2 Joint Certification Program (JCP)

The technical data packages may contain information that is export controlled. Only those companies that have completed DD Form 2345 and are certified under the JCP in an active status are authorized to receive export-controlled information. ONLY JCP CERTIFIED FIRMS WILL BE ELIGIBLE FOR ANY FUTURE AWARD MADE RELATED TO THIS EFFORT. Additional information about JCP is available at https://www.dla.mil/HQ/LogisticsOperations/Services/JCP/.

3.3 Installation Access

Physical access to Government’s facility at Naval Support Activity (NSA), Crane or areas over which DoD, Department of Navy (DoN), or U.S. Marine Corps have responsibility for, shall be through use of the Defense Biometric Identification System (DBIDS) and associated data processing/information services for purposes of protecting U.S./Coalition/allied government/national security areas of responsibility and information. The Contractor shall obtain employee personal identity verification credentialing (badge) by submitting form SECNAV 5512/1 to the RTA or COR for each Contractor employee and subcontractor employee no later than five (5) days prior to work commencing. Upon Base Registrar authorization of form 5512/1, the Contractor shall submit form NSA Crane 5512/47 DBIDS Badge Application Record to the NSWC Crane Security Division. The Contractor shall retrieve badges of employed personnel upon separation.

Each employee shall affix their badge on their person, always located above the waist while on the Activity. Badges may only be removed for safety reasons and must be reaffixed when work is completed.

For Contractor or subcontractor employees requiring infrequent access to the Activity, one day temporary passes MAY be authorized. Requests for temporary passes shall be submitted to the COR at least 2 working days prior to base access.

Be advised that the DBIDS process and temporary pass process both involve a background check.

Persons with a Felony conviction in the last 10 years will not be issued badges or passes.

Individuals supporting these efforts shall comply with the latest security regulations applicable to the government facility/installation.

a. Depending on the facility/installation regulations, contractor personnel shall present a proper form of identification(s) and vehicle proof of insurance or vehicle rental agreement.

b. All contractor and subcontractor personnel engaged in work while on government property shall be subject to inspection of their vehicles at any time by the Government and shall report any known or suspected security violations to the local host Security Department.

Failure to obtain entry approval will not affect the contract price or the time of completion.

3.4 Program Management

The Contractor shall comply with the manufacturer’s recommendations in installation of all material and equipment. The Contractor shall be responsible for field verification of actual conditions prior to commencement of work. The Contractor shall be responsible for quality control of all work that is performed via orders under this contract. The Contractor is responsible for compliance with the U.S.

Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, and shall always maintain a safe working environment during the performance of orders under this contract. Although this document is intended to identify all significant features of work to be accomplished in the performance of orders under this contract, it should not be considered inclusive of all minor tasks required for completion of the major work described herein.

3.4.1 Design and Construction Quality Control Plan

The Contractor shall establish and maintain a Quality Control program that is administered by a Design and Construction Quality Control Professional. The Quality Control program, at a minimum, shall include utilization of the below:

Quality Control (Design and Construction) Plans in accordance with UFGS 01 45 00.10 20 Quality Control for Minor Construction, (CDRL A008)

Commissioning Plans, Performance Verification Test, Functional Performance Testing, and, Test and Balance Reports, (CDRL A008)

Coordination and Mutual Understanding Meeting with notes at the conclusion (CDRL A008)

Three phases of control to include, submittal, review and approval

Testing Completion inspections

QC certifications

Inspections in accordance with Section 01 45 35.05 20 Special Inspections for Design-Build or Section 01 45 35.05 10 Special Inspections for Design-Bid-Build.

Documentation necessary to provide design, materials, equipment, workmanship, fabrication, construction and operations which comply with the requirements of this Contract.

The QC program must cover on-site and off-site work. No construction work or testing may be performed unless the Contractor’s QC Manager is on the work site.

3.5 Safety and Health

The Contractor shall demonstrate a current and compliant Occupational Health and Safety Program in accordance with NSWCCRANEINST 5100.1B.

3.5.1 Activity Hazard Analysis (AHA)

Before beginning each activity, task or Definable Feature of Work (DFOW) involving a type of work presenting hazards not experienced in previous project operations, or where a new work crew or subcontractor is to perform the work, the Contractor(s) performing that work activity must prepare an AHA. AHAs must be developed by the Prime Contractor, subcontractor, or supplier performing the work, and provided for Prime Contractor review and approval before submitting to the Contracting Officer.

AHAs must be signed by the SSHO, Superintendent, QC Manager and the subcontractor Foreman performing the work. Format the AHA in accordance with EM 385-1-1 or as directed by the Contracting Officer. Submit the AHA for review at least 10 working days prior to the start of each activity task, or DFOW. The Government reserves the right to require the Contractor to revise and resubmit the AHA if it fails to effectively identify the work sequences, specific anticipated hazards, site conditions, equipment, materials, personnel and the control measures to be implemented. AHAs must identify competent persons required for phases involving high risk activities, including confined entry, crane and rigging, excavations, trenching, electrical work, fall protection, and scaffolding. (CDRL A002)

3.5.2 Accident Prevention Plan

Content of Accident Prevention Plan (APP) (CDRL A003) shall be in accordance with Guide SPEC 01 35 26 Governmental Safety Requirements and US Army Corps of Engineers Safety Manual EM385-1-1.

A competent person as defined by the EM385-1-1 must prepare the written site-specific APP. Prepare the APP in accordance with the format and requirements of EM 385-1-1, ENG Form 6293, and herein. The APP must be job-specific and address any unusual or unique aspects of the project or activity for which it is written. The APP must interface with the Contractor's overall safety and occupational health program referenced in the APP in the applicable APP element and be made site-specific. Describe the methods to evaluate past safety performance of potential subcontractors in the selection process. Also, describe innovative methods used to ensure and monitor safe work practices of subcontractors. The Government considers the Prime Contractor to be the "controlling employer" for all worksite safety and health of the subcontractors. Contractors are responsible for informing their subcontractors of the safety provisions under the terms of the Contract and the penalties for noncompliance, coordinating the work to prevent one craft from interfering with or creating hazardous working conditions for other crafts, and inspecting subcontractor operations to ensure that accident prevention responsibilities are being carried out. The APP must be signed in accordance with the APP and ENG Form 6293 Accident Prevention Plan Worksheet.

The SSHO must provide and maintain the APP and a log of signatures by each subcontractor foreman, attesting that they have read and understand the APP, and make the APP and log available on-site to the Contracting Officer. If English is not the foreman's primary language, the Prime Contractor must provide an interpreter.

3.5.2.1 Experience Modification Rate

EXPERIENCE MODIFICATION RATE (EMR): Prime Contractor and Subcontractors on this Contract must have an effective EMR less than or equal to 1.10, as computed by the National Council on Compensation Insurance (NCCI) or if not available, as computed by the state agency's rating bureau in the state where the subcontractor is registered, when entering into a subcontract agreement with the Prime Contractor or a subcontractor at any tier. The Prime Contractor may submit a written request for additional consideration to the Contracting Officer where the specified acceptable EMR range cannot be achieved. Relaxation of the EMR range will only be considered for approval on a case-by-case basis for special conditions and must not be anticipated as tacit approval. Contractor's Site Safety and Health Officer (SSHO) must collect and maintain the certified EMR ratings for all subcontractors on the project and make them available to the Government at the Government's request.

Provide proof of Prime Contractors EMR rating as part of the proposal. Subcontractor EMR Ratings are required to be made available upon request at the Task Order Level.

3.5.3 Accident/Incident Reporting

The Contractor shall maintain an accurate record of and shall report all accidents to the COR immediately (within 10 minutes) after incident occurs (CDRL A005). Near miss reports are considered positive and proactive Contractor safety management actions.

The Contractor shall maintain an accurate record and shall immediately report to the COR all damages to Government Owned Equipment and/or Facilities as prescribed by OPNAVINST 5102.1E. (CDRL A006)

3.5.4 Standard and Critical Lift Plan

Plan lifts to avoid situations where the operator cannot maintain safe control of the lift. Prepare a written lift plan in accordance with EM 385-1-1, Section 16. Form 16-2 is required as part of the lift plan submission for every lift or series of lifts (if duty cycle or routine lifts are being performed). Submit standard lift plan to the COR for approval within 5 working days in advance of planned lift (CDRL A021). Submit critical lift plan to the COR for approval within 20 working days in advance of the planned Lift (CDRL A021).

3.6 Waste Management Plan

The Contractor shall submit a waste management plan within five (5) working days after contract award.

In accordance with UFGS 01 74 19 Construction and Demolition Waste Management, local NSACRANEINST 5100.7 Hazardous Material Control and Management Program, and NSA/NSWC/NAVFAC CRANE INST 5090.2C Hazardous Waste Management Plan. The plan must demonstrate how the project waste diversion goal is met and plan must include the following: (CDRL A010)

Ensure Hazardous Waste is labeled, handled and stored in accordance with the Safety Data Sheets (SDS) and applicable waste labeling regulations as indicated above.

The Contractor shall contact the COR to set up a temporary hazardous waste storage area, as outlined in NSWCCRANEINST 5090.2C.

The Contractor shall immediately call (within 10 minutes) to notify the Fire Department, COR and call the Emergency Dispatch at 812-854-2529 for any hazardous material spillage.

The Contractor shall be responsible for clean-up efforts in accordance with 40 CFR 300 and shall provide verbal and written notifications to the COR (CDRL A011) as required by 40 CFR 355.

Hazardous Waste shall be turned over to RTA or COR.

If any unforeseen hazardous material is found or suspected to be hazardous material the contractor shall notify the COR, (CDRL A004) stop work and wait for the Government for instructions.

Any Polychlorinated Biphenyls (PCBs) waste shall be handled in accordance with 40 CFR 761.

3.7 Waste Management Records

The Contractor shall maintain records to document the quantity of waste generated. Records shall be separated based on categories such as, but not limited to, hazardous waste, universal waste, landfilled solid waste, recyclable material, and earth material. The Contractor shall make the records available to the COR during construction, and a copy of the records must be delivered to the COR upon completion of the construction. (CDRL A012)

3.8 Environmental

3.8.1 The Contractor shall demonstrate a current and compliant Environmental, Safety, and Occupational Health Program in accordance with DoDD 4715.1E. (CDRL A027). The Contractor shall not use any asbestos containing material (ACM) at any time during the construction. The Contractor shall verify that all materials, including those supplied by third parties, are asbestos free.

A written certification letter shall be provided by the Contractor to the Contract Officer certifying that the finished work is asbestos free. A signed letter-head stating,” to the best of my knowledge, no ACM was used as a building material in the building” may suffice, per 40 CFR part 763, five (5) days prior to Beneficial Occupancy Date (BOD). (CDRL A015)

The Contractor shall submit SDS for any suspect materials to the Contract Officer Representative. (CDRL A020)

3.8.2 The Contractor shall provide protection of areas and spaces not to be painted. Prior to surface preparation (i.e., sandblasting, hand sanding, and removal of glue) and coating applications, remove, mask, or otherwise protect such items not to be coated that are in contact with surfaces to be coated.

Following completion of painting, the Contractor shall reinstall removed items by workmen skilled in the trades. The Contractor shall restore surfaces contaminated by coating materials to original condition and repair damaged items.

3.8.3 The Contractor shall comply, at minimum, with manufacturer recommendations for space ventilation during and after paint application. The Contractor shall isolate the area of application from the rest of the building when applying high-emission paints or coatings.

3.8.4 The Contractor shall not apply coating when air or substrate conditions are:

Less than 3 degrees C / 5 degrees F above dew point;

Below 10 degrees C / 50 degrees F or over 35 degrees C / 95 degrees F, unless specifically pre-approved by the COR and the product manufacturer.

3.8.5 The Contractor shall not use materials having a lead content over 0.6 percent by weight of nonvolatile content.

3.8.6 All coatings containers used to apply the contents therein to a surface directly from the container by pouring, siphoning, brushing, rolling, padding, ragging, or other means, shall be closed when not in use.

3.8.7 Containers of any Volatile Organic Compound (VOC) containing materials used for thinning and cleanup shall be closed when not in use.

3.8.8 Compliance with the VOC content limits shall not exceed the following limits: flat coatings, non-flat coatings, non-flat-high-gloss coatings and floor coatings, as per coating category identified in 326 IAC 8-14-3. The Contractor shall provide chemical products SDS to show compliance with VOC content limit.

3.8.9 The Contractor shall not, under any circumstances, violate the manufacturer’s application recommendations.

3.8.10 Other Environmental specifics will be addressed at the order level.

3.8.11 Details of projects involving the construction or modification of equipment with air emissions must be provided to the COR (CDRL A0019) prior to the start of work to evaluate air permitting needs.

No equipment may be constructed or modified prior to this evaluation.

3.8.12 Work conducted on HVAC&R systems must meet all compliance and record keeping requirements of 40 CFR 82, Subpart F.

3.8.13 Radon Resistant New Construction (RRNC) Requirements: Contractor shall provide a complete RRNC to the COR. (CDRL A024) five (5) days prior to BOD. Refer to OPNAVINST 5090.1E, Environmental Readiness Program (3 Sep 2019) and OPNAV M-5090.1, Environmental Readiness Program Manual (3 Sept 2019), referring to the following sections/pages:

o Chapter 25, Toxic Substances Control Act (pages 425 thru 441) o Paragraph 25-3.2, Radon o Paragraph 25-3.2a(5) – Navy Radon Assessment and Mitigation Program (NAVRAMP).

o Paragraph 25-3.2b(3) – NAVRAMP Implementation - Prevention.

o Paragraph 25-4.5p

The NAVRAMP Guidebook for Naval Shore Installations (30 Sep 2017), paragraph 4.3 lists specific requirements, except those standards noted below (due to their being withdrawn). Per Environmental Protection Agency (EPA) recommendation, incorporate ANSI/AARST CC-1000 (2018), Soil Gas Control Systems in New Construction of Buildings. The three withdrawn standards are:

o Unified Facilities Criteria (UFC) 3-490-04A (withdrawn) o ASTM E1465-08a (withdrawn in 2017) o EPA 402-K/11-002 (unavailable)

3.9 Closeout Submittals

As-built drawings are developed and maintained by the Contractor and depict actual conditions, including deviations from the Contract Documents. These deviations and additions may result from coordination required by, but not limited to: contract modifications; official responses to Contractor submitted Requests for Information; direction from the COR; designs which are the responsibility of the Contractor, and differing site conditions. Maintain the as-built drawings throughout construction as a red-lined copy.

These files serve as the basis for the creation of the record drawings. Certified as-built drawings shall be provided in a PDF format no less than five (5) working days prior to BOD for COR approval. Drawings shall be marked with “As-built” and signed (CDRL A016). Other closeout submittals may include, but not limited to, warranty documentation, operation and maintenance manuals, manifests, testing results, equipment training report as applicable. All applicable documents shall be submitted to the RTA and COR before project is complete and final payment is issued.

The record drawings are the final compilation of actual conditions reflected in the as-built drawings.

Provide and maintain two black line print copies of the PDF contract drawings for as-built drawings in accordance with FC 1-300-09N. At a minimum of five (5) working days prior to BOD, the Contractor shall certify both sets of as-built drawings as correct, sign, and submit the as-built drawings for COR approval. (CRDL A016)

3.10 Warranty Management Plan

The Contractor shall develop a warranty management plan which contains information relevant to FAR 52.246-21. At least ten (10) working days before the planned pre-warranty conference, the Contractor shall submit one set of the warranty management plan (CDRL A013). The warranty management plan shall include all required actions and documents to assure that the Government receives all warranties to which it is entitled. The plan must be in narrative form and contain sufficient detail to render it suitable for use by future maintenance and repair personnel, whether tradesmen, or of engineering background, not necessarily familiar with this contract. The term "status" as indicated below must include due date and whether item has been submitted or was accomplished. The Contractor shall assemble approved information to turn over to the Government upon acceptance of the work. The construction warranty period will begin on the date of full invoice acceptance and continue for the full product warranty period.

A joint four (4) month and nine (9) month warranty inspection will be conducted, measured from time of acceptance, by the Contractor, COR, and the Customer Representative.

3.11 Submittal Requirements

A. The Contractor is responsible for providing a Submittal Register utilizing form ER 415-1-10 (CDRL A017) for all anticipated submittal items.

B. Submittals are to be provided to the Government for review and acceptance by the COR prior to procurement of material. Submittals accepted by the Government have a 10-business day review period unless otherwise noted in the TO. The contractor is encouraged to obtain both delivery and read receipts for all emailed submittals.

C. The QCM shall follow processes set forth in the Quality Control plan and Spec 01 45 00.10 20 to ensure the products being submitted are contract compliant.

D. Submittals shall include the following where applicable:

5.0 SPECIAL CONDITIONS

5.1 Contracting Officer’s Representative (COR)

The COR is the point of contact for non-substantiated communications of a technical nature. Only the Contracting Officer has the authority to change the requirements of orders under this contract(s).

5.2 Requiring Technical Activity (RTA)

The RTA contacts are Functional Managers, Task Managers, and Project Leads. RTAs do not have the authority to direct Contractor personnel or change the requirements of orders under this contract(s) or change the requirements of any TI(s). RTAs shall be copied on each CDRL deliverable identified.

5.3 Safety and Health

The requirements of orders under this contract order may require Contractor personnel to come in contact with or be exposed to hazardous conditions. The Contractor shall abide by all applicable federal, local, and state occupational safety and health requirements, as referenced in Section 2. The Government will provide Standard Operating Procedures (SOP) when applicable at the Task Order level. The Contractor must have on record a corporate safety plan (or APP) and shall provide a copy to the COR when instructed. The Contractor shall ensure all employees have appropriate Personal Protection Equipment (PPE). The Contractor shall ensure employees have all required training and certifications related to Occupational Safety and Health Administration (OSHA) requirements. Contractor shall provide training and certification records. (CDRL A003)

Any Contractor employee exhibiting unsafe behavior may be removed from the NSWC Crane site. Such removal shall not relieve the Contractor from meeting its contractual obligations and shall not be considered an excusable delay as defined in FAR 52.249-14.

5.4 Hazardous Materials

The Contractor will provide a responsible party for the handling of the hazardous materials and the respective SDS. This responsibility includes proper training in the handling and disposal of the hazardous materials.

5.5 Control of Contractor Personnel

Contractor personnel shall physically access government facilities and installations for purposes of site visitation, meeting attendance, supervisory and work performance within government spaces (either temporary or permanent). Individuals supporting these efforts shall comply with the latest security regulations applicable to the government facility/installation.

a) Depending on the facility/installation regulations, Contractor personnel shall present a proper form of identification(s) and vehicle proof of insurance or vehicle rental agreement.

b) All Contractor persons engaged in work while on government property shall be subject to inspection of their vehicles at any time by the Government and shall report any known or suspected security violations to the local host Security Department.

c) All persons engaged in work while on Government property shall be subject to search of their persons (no bodily search) and vehicles at any time by the Government and shall report any known or suspected security violations to the NSWC Crane Security Department.

d) Assignment, transfer, and reassignment of Contractor personnel shall be at the discretion of the Contractor. However, when the Government directs, the Contractor shall remove from contract performance any person who endangers life, property, or national security through improper conduct.

e) All Contractor personnel engaged in work while on Government property shall be subject to the Standards of Conduct contained in DOD 5500.7-R (Joint Ethics Regulation).

f) Prior to conducting work under this contract, the Contractor shall provide a list of employees that will be working on site. The employee list shall contain full names, and job title. This list shall be updated within forty-eight hours after changes occur. (CDRL A001)

g) Any photography on base is not permitted without prior approval and photography permit request submitted to the RTA. Permit request (NSWCCRANEINST 5500.1) must be approved and signed by the RTA prior to any photos being taken. All photos taken, after approval, must be analyzed and approved prior to release.

5.6 Smoking Regulations

Smoking on NSWC Crane, Crane, IN premises shall be in approved areas only in accordance with NSACRANEINST 5100.13A (NSA Crane Smoking and Tobacco Use). Smoking in vehicles is prohibited.

5.7 Investigations

Contractor employees shall cooperate with Government investigative agencies conducting criminal or administrative investigations.

5.8 Government Observations

Government personnel, such as Inspector General or higher headquarters staff, are authorized to observe Contractor operations. Efforts will be made to minimize the degree of disturbance on Contractor performance.

5.9 Hours of Operation

NSWC Crane core duty hours for on-site Contractor personnel and the Contractor’s liaison facility personnel assigned to this effort are 0600 to 1600 hours, Monday through Friday, during regular Government workdays. Contractors are required to work during Government work hours in accordance with company timekeeping policies. Exceptions may be approved by the COR if requested by the Contractor.

5.9.1 Closed Days

All closed days will be designated by the Commander, NSWC Crane. Closed days will be associated with holidays, National Security, and/or inclement weather/dangerous conditions. The Contractor will not be allowed to work on NSWC Crane during designated closed days. Government holidays can be found on OPM website.

5.9.2 Inclement Weather

When the Government Agency is closed by the Commander because of inclement weather conditions and/or dangerous conditions, notification of the closing will be broadcast over local radio and television stations.

5.9.3 Unusually Severe Weather

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the FAR 52.249-10 "Default (Fixed-Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

https://www.weather.gov/srh/nwsoffices The Contractor shall make his own investigations and determinations as to weather conditions at the site. Data may be obtained from various National Weather Service offices located generally at airports of principal cities, the nearest to this project being:

Indianapolis International Airport.

The unusually severe weather must directly cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in weather dependent activities.

Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated listed above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair-weather workdays, and issue a modification in accordance with the FAR 52.249-10 "Default (Fixed-Price Construction)".

5.10 Licenses, Certifications, and Training

The Contractor shall provide capable personnel with qualifications, experience levels, security clearances, and necessary licenses, certifications, and training required by Federal, State, and Local laws and regulations. Training necessary to ensure that personnel performing under this contract maintain the knowledge and skills to successfully perform the required functions is the responsibility of the Contractor.

Training necessary to maintain professional certification is the responsibility of the Contractor. Required trainings will be identified at the order level SOWs.

5.11 Contractor Identification

This contract is for non-personal services as defined by FAR Subpart 37.104. As such, Contractor employees shall identify themselves as Contractor personnel by introducing themselves or being introduced as Contractor personnel and displaying distinguishing badges or other visible identification for meetings with Government personnel. In addition, Contractor personnel shall appropriately identify themselves as Contractor employees in telephone conversations and in formal and informal written correspondence. Contractor shall provide a Contractors Personnel Roster. (CDRL A001)

5.12 Post Award Meetings

The Post Award Meeting will fund each MACC awardee $500 to fund Contractor costs to attend the post-award meeting. A Post Award Meeting with the successful offeror will be conducted within 15 working days after award of the TO. The Contractor will be given at least five (5) working days’ notice of location and time of the meeting prior to the date of the meeting by the Contracting Officer. The requirement for a Post Award meeting shall, in no event, constitute grounds for excusable delay by the Contractor in performance of any provisions of the contract. A second post award meeting may, if necessary, be held after the receipt of the first invoice to assure that adequate documentation has been received to substantiate the validity of the invoice for the stated period of performance, in accordance with HQ G-2- 0007. The Contractor will be given at least five (5) working days’ notice prior to the date of the meeting by the Contract Specialist.

5.13 Requirements for Restricted Areas

Visitor control and surveillance of personnel (e.g., escort requirements) in a restricted area requires security consciousness and is the responsibility of all personnel working within the area.

6.0 GOVERNMENT FURNISHED PROPERTY

GFP may be required for completion of tasks under this IDIQ. All Government furnished property is of the U.S. Government and shall not be transferred to any individual or agency, public or private, without the express written approval of the originating Contracting Officer except as required for the specific performance of tasks under orders under this contract. Government Furnished Property shall be managed IAW FAR Part 45, DODI 4161.02, DODI 5000.64, OPNAVINST 4440.26B, SECNAVINST 5200.43, and reported monthly.

6.1 Government Furnished Information (GFI)

The Government will provide all applicable program technical documentation and information to the Contractor as GFI. This may include: drawings, specifications, procedures, processes, and quality system documents required for the performance of this IDIQ. Additional GFI may be provided as required or at the request of the Contractor. Disposition instructions will be provided as required. The Contractor shall submit a GFI Deficiency Report.

6.2 Government Furnished Material (GFM)

The GFM will be provided when the Contractor has a requirement for special or specific Government material in the performance of specific tasking. GFM will be identified at the order level. All material invoiced shall be managed IAW GFP clauses in each applicable order.

In addition, any materials purchased shall become the property of the Government upon payment by the Government for the materials. All materials purchased under each order shall be managed in accordance with the GFP clauses in the contract. GFP reports, when required, shall include the fields required by the GFM module of the PIEE system IAW DFARS PGI 245.103-72 for the purpose of OM&S accountability.
