About this file

This document is a Class Justification and Approval (CJ&A) for a Basic Ordering Agreement (BOA) with CPI for engineering services supporting U.S. Navy microwave tubes and electronic systems. The total estimated value of the BOA is $7.7M, covering engineering services and Government Furnished Equipment support for critical Navy radar and weapon systems, including MK-99 Fire Control System, Aegis Weapons Systems, AN/SPS-49 Radar, AN/SPY-1D(V) Radar, and NULKA systems.

The Navy's Naval Surface Warfare Center Crane Division determined CPI is the sole source capable of providing these specialized engineering services, with no alternative vendors identified through market research and a Sources Sought notice. The justification highlights that establishing alternate sources would require approximately 4.7 years and cost ~$16.8M across five tube lines, potentially degrading the Fleet's anti-air and anti-ballistic missile defense capabilities. The BOA will have a 5-year ordering period, with the authority to act under this CJ&A expiring on 07 March 2030.

Text version

SDS, Klystron and NULKA MWTs since the early 1980s. Power Grid Tubes/Tetrodes have been procured utilizing small purchase procedures.

NULKA MWTs are the 5th tube type. Lockheed Martin Sippican (LMS) is the OEM of NULKA MWTs. LMS has historically sole sourced NULKA MWT engineering services/repairs to CPI.

LMS has not expressed interest in satisfying the Government s requirement for

NULKA MWTs directly. As of 11 October 2023, LMS is not willing to provide any drawings or proprietary manufacturing processe to the Government or any vendor other than

CPI.

There are no known service contracts for the Klystron MWTs or the Power Grid Tubes/Tetrodes.

CPI has received 3 sole source contracts from the Government for engineering services on the CWI and SDR MWTs dating back to January 2000. Services included GFE installation (including test sets), qualification/ performance testing, shelf life testing and operating life testing.

Establishing alternate sources to support the various required services would result in substantial duplication of costs and unacceptable delays in fulfilling requirements in accordance with 10 U.S.C.

3204(a) (1), FAR 6.302-1(a)(2)(iii). NSWC Crane Radar Technologies Division estimates schedule delays of approximately 4 years and 7 months and duplication of costs of ~$16.8M across all 5 tube lines. The estimates include identification of the requirement, reverse engineering, developing level III technical data packages, conducting competitive procurements, producing prototypes, first article testing, production and delivery and procure duplicate GFE.

Without the continuing support for these products, a degradation of the Fleet’s ability to provide Anti-Air and Anti-Ballistic Missile defense capabilities would exist and impact the Fleet’s ability to defend the nation, which could result in a loss of life.

Therefore, award to any source other than CPI would result in substantial duplication of costs that are not expected to be recovered through competition, and unacceptable delays would occur in fulfilling the agency’s requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought was posted to SAM.gov on 16 August 2023, in accordance with Defense Acquisition Regulations Supplement (DFARS) PGI 206.302-1(d). The Sources Sought closed on 01 September 2023 with no responses or inquiries received.

The proposed BOA was synopsized on the SAM website on 14 September 2023. To date, no interested parties have expressed interest or provided feedback concerning this requirement. There is one known source for this requirement: CPI. Any response received will be evaluated to determine whether to conduct a competitive procurement.

The Radar Technologies Division performed market research to include their own knowledge of the industry and found no service providers of a similar or same nature. Open source internet searches were conducted by the Requiring Technical Activity for information on the programs and systems within the scope of the BOA. In addition, there are no similar commercial or modified commercial services that will meet the government’s requirements.

All orders issued under this BOA will be synopsized on the SAM website. Any responses received will be considered.

7. Determination of Fair and Reasonable Cost.

Anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of services covered by this document. If another potential sources emerge, NSWC Crane will assess whether competition for future requirements is feasible.

As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior CJ&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
