About this file

This is a Justification and Approval (J&A) document for other than full and open competition from the Naval Surface Warfare Center, Crane Division for a sole-source award to Meggitt Defense Systems Inc. for Liquid Air Palletized Systems (LAPS). The document justifies a firm-fixed-price contract to Meggitt for LAPS (Part Number PN 708999-1) to be used on U.S. Navy P-8A aircraft, with an estimated value of $8M.

The J&A cites 10 U.S.C. 3204(a)(1) as authority for sole source procurement, stating Meggitt is the only responsible source capable of providing these systems. Key justifications include: Meggitt designed, developed, qualified and manufactured the components; the government lacks technical data package rights; and Meggitt will not license or sell its proprietary data. A sources sought notice was published on SAM.gov on April 4, 2024, followed by a synopsis on May 8, 2024, with no responses received. The Navy requires these long-lead items to convert baseline aircraft into mission functional aircraft in FY25/FY26, with additional aircraft planned for modification.

5. Rational Justifying Use of Cited Statutory Authority.

The LAPS being procured under this J&A are in direct support of the US Navy P-8A aircraft mission. The LAPS have been tested, qualified, and approved by the aircraft OEM, The Government has previously purchased the LAPS from Meggitt under sole source contracts.

The manufacture of the cited components by a source other than Meggitt is not practicable as Meggitt designed, developed, qualified, and manufactured the cited components to meet stringent P-8A aircraft integration and mission requirements.

The Government does not have the technical data package rights to allow for competition and Meggitt has advised that it does not intend to license or sell its proprietary data to the Government or to any entity. Based on Meggitt’s unique system design, test and aircraft interface knowledge and experience, Meggitt is the only contractor possessing the capability to provide the required supplies and services in the timeframes required.

Based on current engineering estimates, the delay and redundant cost necessary to develop specifications, solicit competitive offers, award to a source other than Meggitt, produce, integrate, and conduct operational test verification would cause undue delay and non-recoupable cost if competition was sought. Furthermore, the ability of the Navy to install and maintain critical , without undue delays, is required to retain functional mission capability.

6. Description of Efforts made to Solicit offers from as Many Offerors as Practicable.

A source sought of the planned contract published on the SAM.gov website on 4 APR 2024. No responses have been received to date. Any responses from interested sources received prior to contract award will be considered.

This action was synopsized on 8 May 2024 on the SAM.gov website. No responses have been received to date. Any responses from interested sources received prior to contract award date will be considered.

Based upon the market research, and for the reasons discussed in Section 5, it is not practicable for any vendor other than Meggitt to provide the required supplies.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost ot the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible.
