About this file
This document is a Justification and Approval (J&A) for other than full and open competition for the manufacture, refurbishment, test, overhaul, and/or repair of the SPQ-9B antenna radome, part number N040001.
The J&A cites 10 U.S.C. 3204(a)(1) as the statutory authority, indicating there is only one responsible source that can meet the agency's requirements. CPI Radant Technologies, the current manufacturer, owns the necessary tooling, fixtures, and composite layup details, and duplicating their qualification efforts would cost over $1.6M with a 140-week lead time. A Sources Sought notice yielded only one response, from Valor Defense Solutions, which the Navy determined could not meet the requirement. The Contracting Officer has determined the anticipated cost will be fair and reasonable. The Navy has no plans to compete future contracts for these services, but will assess competition feasibility if other potential sources emerge.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1) only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Northrup Grumman specification drawing 95542-N040001, was developed by Northrup Grumman on 2005 Aug 05 in cooperation with the manufacturer of the item, CPI Radant Technologies (formerly L3 Harris Essco; L3Harris sold Essco to CPI Radant Technologies Division, Inc., in JAN 2021). CPI Radant Technologies utilized Northrup Grummans prescribed outline requirements to develop detailed requirements and a functioning end item.
CPI Radant Technologies owns all tooling, fixtures, and composite layup details required to manufacture and repair the SPQ-9B antenna radome. Drawing number 95542-N040001 lists L3 Harris Essco (currently known as CPI Radant Technologies) as the sole approved source of supply. Northrop Grumman did not update Drawing 95542-N040001 after L3 Harris Essco was bought by CPI Radant Technologies.
Duplication of qualification efforts to establish capability to include tooling, fixtures, and detailed machined codes is in excess of $1.6M with a 140-week lead time both of which are not value added to government schedule. NSWC Crane overhauls assets based upon set periodicity established by Surface Maintenance Engineering Planning Program (SURFMEPP).
The periodicity basis creates a three to nine asset annual schedule to support the United States Navy (USN). A 140-week lead time of radome repairs will not allow NSWC Crane to meet mission critical fleet installations to restore functional readiness of a USN vessel.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
NSWC Crane Radar Technologies Divisions (WXP) subject matter experts in protective coatings, composite structures, and RF testing have examined available drawings and physical assets and determined that the Government does not have a technical data package that is sufficient for competition. The Government would require detailed curvature formulas for the radome shape, composite ribbon (orientation) for each composite layer, material types, and optimal thickness for successful RF operation in order to develop more detailed specification controlled parameters for an open solicitation. Due to these factors, CPI Radant Technologies Division Inc. is the only vendor with adequate knowledge, equipment, and detailed requirements/information to execute prescribed workload. A Sources Sought was Posted on 14 AUG 2023 and closed on 28 AUG 2023; the Government received one response from Valor Defense Solutions Inc. (VDS). The requiring technical activity has reviewed the response and determined that VDS cannot meet the requirement since the Navy does not have authority to release the drawings to any other party not identified in this J&A. VDS does not have facilities necessary to produce the radome for new manufacture deliverables due to facility equipment constraints. VDS does have repair/overhaul capability for composite structures with defined parameters; however VDS does not have the engineering capability to determine composite structure make-up, making VDS unable to execute required repairs.
A combined synopsis solicitation will be posted to SAM.gov IAW FAR 13.105(b).
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If other potential sources emerge, NSWC Crane will assess whether competition for future requirements is feasible.
