Location and Dates of Delivery

The instream restoration site is located approximately 45 miles northeast of Amboy, Washington or 20 miles north of Carson, Washington.

Prehaul/staging work can begin 07/15/2024. Instream work can begin 08/01/2024 and continue through 08/31/2024. Instream work may be extended through 10/31/2024, but that is not guaranteed at this time. The expectation is to have all work completed by 11/21/2024, however the contract may be extended into 2025 if more work is needed.

(a)(4) At any time during contract performance, but not later than 6 months (or such other time as may be specified in the contract) after acceptance of the services or materials last delivered under this contract, the Government may require the Contractor to replace or correct services or materials that at time of delivery failed to meet contract requirements. Except as otherwise specified in paragraph (a)(6) of this clause, the cost of replacement or correction shall be determined under paragraph (i) of this clause, but the "hourly rate" for labor hours incurred in the replacement or correction shall be reduced to exclude that portion of the rate attributable to profit. Unless otherwise specified below, the portion of the "hourly rate" attributable to profit shall be 10 percent. The Contractor shall not tender for acceptance materials and services required to be replaced or corrected without disclosing the former requirement for replacement or correction, and, when required, shall disclose the corrective action taken.

(i)(1)(ii)(D) Other Costs. Unless listed below, other direct and indirect costs will not be reimbursed.

(1) Other Direct Costs. The Government will reimburse the Contractor on the basis of actual cost for the following, provided such costs comply with the requirements in paragraph (i)(1)(ii)(B) of this clause: None

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. 52.217-8 Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days.

(a)The Government may extend the term of this contract by written notice to the Contractor within _____ [insert the period of time within which the Contracting Officer may exercise the option];

provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. 452.236-73 Archaeological or Historic Sites (FEB 1988)

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

452.236-74 Control of Erosion, Sedimentation, and Pollution (NOV 1996)

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

452.237-70 Loss, Damage, Destruction or Repair (FEB 1988)

(a) For equipment furnished under this contract without operator, the Government will assume liability for any loss, damage or destruction of such equipment, not to exceed a total of $0 except that no reimbursement will be made for loss, damage or destruction due to

(1) ordinary wear or tear, (2) mechanical failure, or (3) the fault or negligence of the Contractor or the Contractor's agents or employees.

(b) For equipment furnished under this contract with operator, the Government shall not be liable for any loss, damage or destruction of such equipment, except for loss, damage or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.

(c) All repairs to equipment furnished under this contract shall be made by the Contractor and reimbursement, if any, shall be determined in accordance with (a) or (b) above. Repairs shall be made promptly and equipment returned to use within 48 hours. In lieu of repairing equipment, the Contractor may furnish similar replacement equipment within the time specified. The Contractor may authorize the Government to make repairs upon the request of the Contracting Officer. In such case, the Contractor will be billed for labor and parts costs.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (NOV 2021)

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. Statement of Work for Wind River Phase I Restoration

Objective:

The objective of this project is to improve salmon habitat for Endangered Species Act (ESA) listed lower

Columbia Steelhead in the Wind River Watershed. Using large wood obtained from nearby harvest units, large woody debris will be added to the Wind River to enhance pool quality and quantity, slow stream flow, increase streambank stability, and improve overall water quality for fish habitat. In general, the work under this project includes, but is not limited to, the following major items of work as specified.

The following descriptions are provided as an outline of major work items and shall not be construed as an inclusive or complete listing of all items of work under this task order.

Instream Project Location:

The instream restoration site is located approximately 45 miles northeast of Amboy, Washington or 20 miles north of Carson, WA. The project area is located north of Carson on Wind River Highway /USFS 30 road approximately 52 miles northeast of Amboy, Washington and approximately 18 miles north of

Carson, WA and in Township 5N, Range 7E Section 7, 9, 16, and 17, and Township 6N, Range 7E, and

Section 28 and 33 (Figure 1). The project can be located by traveling north of Carson on Wind River

Highway or traveling northeast from Amboy on WA-503 to National Forest (NF) Road 90 then from

Curley Creek Rd to Wind River Highway. The excavator, skidder and log trucks will use these roads to gain access to the log staging areas and instream project sites. The equipment will be used to place trees, gravel, and boulders below and above ordinary highwater areas of the Wind River.

Hourly Items based on low bid From BPA (Instream Project Work):

The Contracting Officers Representative (COR) will supply the engineered log jam designs and oversight.

The contractor will supply equipment and operator on an hourly rental basis to complete the following items:

• Mobilization: All vehicles and heavy equipment to be used on-site is to be cleaned to remove soil, seeds, vegetative matter or other debris that could contain invasive species. Cleaning will be done by the contractor before mobilizing onto National Forest Lands. If equipment moves from or between project sites or areas known to be infested into other areas, infested or otherwise. The Contracting Officer’s Representative (COR) will meet with the contractor to inspect every piece of equipment before they enter Nation Forest Lands.

• Trees are to be transported throughout the site via skidder and moved into place with an excavator. As needed, bed material will be moved short distances and placed where needed during log jam construction.

• Large diameter trees (22” to 43” DBH) will be felled on site with an excavator, leaving root wads attached and keeping the tree as long a possible for use as key pieces during log jam construction.

• Construct log jams by following the designs and considering on-site recommendations by the acting COR. Trenches will be excavated into stream banks and gravel bars at marked locations with the recommended depths and widths suggested on-site by the COR as needed to account for frequent changes to this complex system, which will naturally deviate over time from the designs. Trees are placed in appropriate positions within the trenches and backfilled as recommended on-site by the COR.

• All landings, skid roads, and compacted sites will be rehabilitated via decompaction with excavator, mulched with slash, and any bare soils seeded with grass. Large holes left from pushing trees over will be leveled to the elevation of native ground. Work is to progress from the rear of the units to the landing, to avoid travel on rehabilitated soils. It is recommended that an excavator be used for this work. Bare soil is to be seeded with native grass.

Project and Log Structure Design:

• The following pages provide criteria for instream structure construction by excavator and/or riparian felling in Wind River. Included is a location of possible instream structures and a templates of typical structure types. These drawings are only templates as each structure will be built to site specific conditions that require a field fit due to the frequent changes to this complex system which will naturally deviate from the designs. A COR will be present on-site to provide recommendations as changing and unforeseen project site variables become apparent during implementation.
