About this file

This document is a Limited Sources Justification for a new Labor Hour (LH) bridge Task Order against TechSource, Inc.'s TEPS III Blanket Purchase Agreement to continue providing technical support services to the NNSA Office of Production Modernization (NA-19).

The Task Order will provide technical, administrative, and programmatic support to NA-19, including participating in meetings, performing analyses, preparing documents, developing alternatives, and completing associated activities to support production modernization efforts across the Nuclear Security Enterprise. The period of performance will be from April 1, 2024, to July 31, 2024, with an option to extend services up to an additional six months. The total estimated contract value, including travel and ODC costs, is $5,237,477.42. The Justification cites the limited sources authority under FAR 8.405-6 as this is a logical follow-on to an existing NNSA TEPS II Task Order awarded to TechSource, Inc. in 2020. Market research determined there is no other vendor that can immediately meet the agency's need for short-term, continued performance without creating schedule and performance risk.

LIMITED SOURCES JUSTIFICATION

NATIONAL NUCLEAR SECURITY ADMINISTRATION

OFFICE OF PRODUCTION MODERNIZATION (NA-19)

Task Order No. 89233124FNA400597

March 27, 2024

I. AGENCY IDENTITY AND CONTRACTING OFFICE

The Office of Production Modernization (NA-19) of the U.S. Department of Energy (DOE), National Nuclear Security Administration (NNSA), plans to contract for technical support services by using a limited sources authority. The contracting activity is the NNSA Headquarters Services Acquisition Branch (NA-PAS-314).

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

This acquisition action is to issue a new Labor Hour (LH) bridge Task Order against TechSource, Inc.’s Technical, Engineering, and Programmatic Support Services III (TEPS III) Blanket Purchase Agreement (BPA), 89233122ANA000017, to continue services being provided in the Performance Work Statement (PWS) entitled, “Technical Support to the Office of Production Modernization (NA-19).”

III. DESCRIPTION OF SUPPLIES AND/OR SERVICES

This acquisition action will provide technical support services to the Office of Production Modernization (NA-19). NA-19 ensures the efficacy of the nuclear weapons stockpile by planning, executing, and monitoring the progress of all weapon-related infrastructure Major Modernization Programs that support the nuclear weapon stockpile. These include modernization of the capabilities in the Nuclear Security Enterprise (NSE). This office is also accountable for construction projects, development and procurement of manufacturing technologies, strategic investments, as well as nuclear and non-nuclear material processing, delivery, and technology development. All these programs enable long-term viability of the Nation’s Nuclear Weapons Stockpile and infrastructure.

The contractor shall assist NA-19 with technical, administrative, and programmatic work.

This will include participating in meetings, performing analyses, preparing documents to support technical and cost analyses, developing alternatives, preparing associated briefings, and to complete associated support activities. These efforts will focus on supporting production modernization efforts including recapitalization efforts across NA- 19’s areas of responsibility. Contract work will extend to any of the major NSE sites deemed necessary.

The period of performance of the resulting Task Order will be from April 1, 2024, to July 31, 2024, and will include FAR Clause 52.217-8 Option to Extend Services which, if exercised, will extend services up to an additional six-months. The total estimated contract value, including travel and ODC costs is $5,237,477.42.

IV. LIMITED SOURCES AUTHORITY

The authority permitting limited sources as implemented by the Federal Acquisition Regulation (FAR) 8.405-6 (a)(1)(i)(C) – In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule (FSS) Order provided that the original Order was placed in accordance with the applicable FSS ordering procedures. The original Order or BPA must not have been previously issued under sole-source or limited-sources procedures.

NNSA issued a Request for Quotation (RFQ) to vendors under NNSA’s TEPS II BPA on June 10, 2020. NNSA awarded Task Order 89233120FNA400322 to TechSource, Inc.

in accordance with the terms of the RFQ. The current Task Order was awarded on September 29, 2020, and is set to expire on March 31, 2024.

The work for the proposed follow-on bridge is a continuation of the current services being performed under Task Order 89233120FNA400322. TechSource, Inc. has been successfully performing the work under the current expiring Task Order and has the workforce in place with the required “Q” clearances and institutional knowledge to perform this requirement. These factors mitigate schedule/performance risks for the continuing NNSA requirements, and a sudden disruption in performance will pose a risk to the program. Competition for these short-term requirements would neither be economical or efficient, as utilization of a new contractor would result in the new contractor having to onboard, obtain the necessary security clearance, and provide knowledgeable staff for a short-term continuation of performance. This would result in unnecessary performance delays due to new staff having to learn and execute ongoing, continuing assignments mid-performance.

V. CONTRACTING OFFICER DETERMINATION OF BEST VALUE

The Contracting Officer has determined after considering the level of effort and the mix of skills quoted for the tasks, that the proposed action represents a reasonable, realistic total price and will be the best value for the Program consistent with FAR 8.404(d). The Contracting Officer compared TechSource, Inc.’s proposed price for the bridge to the Independent Government Cost Estimate (IGCE) and TechSource, Inc.’s GSA Schedule contract (GS-00F-003DA) pricelist. TechSource, Inc. proposed a 3% or 10% discount off their Schedule Labor rates, which is consistent with the discounts they proposed under their TEPS III BPA for work performed within (3%) and outside (10%) of New Mexico.

VI. MARKET RESEARCH

Additional market research was not conducted for this action as the Task Order is a logical follow on to an existing government requirement. There is no other vendor that can immediately meet the agency’s need for short-term, continued performance of the requirements under TechSource, Inc.’s existing Task Order without creating a detrimental schedule and performance risk.
