INTENT TO SOLE SOURCE OPTION
The National Background Investigations Bureau (NBIB) intends to award the sole-source option pursuant to Option 52.217-9 “Option to Extend Services” of NBIB Contract 24262018C0009 to Iron Mountain LLC. The action was awarded as a sole – source contract for shuttle bus services on June 20, 2018. The authority for this action is Federal Acquisition Regulation (FAR) 13.106- 1(b) soliciting from a single source. The intended recipient of this option is Iron Mountain Information Management LLC (lessor), of One Federal St. Boston, MA, 02110-2012. The lessor is the only capable provider for these services. This action is a firm fixed price, single award, open market purchase.
The General Services Administration (lessee) leases part of this facility from the lessor on behalf of the NBIB. NBIB is not the only occupant of this facility. Other government agencies, and non-governmental entities, also lease space from the lessor. As there are multiple governmental agencies and non-governmental entities that lease space from the lessor, the lessor provides security services for their facility. Shuttle bus services are considered a shared service for all stakeholder, and are only provided by the lessor. NBIB is only responsible for a pro-rated share of the actual cost associated with providing the service. Furthermore, utilizing alternative sources would cost the government more than required, and could negate the lessor's responsibility in regards to liability concerns. If the government was to select an independent government contractor to provide these services, the liability concerns of negligence that could result such as the causing of damage or bodily harm to non-governmental individuals could be shifted from the lessor to the Government. As the Government occupies a shared leased space the lessor obtains has retained all rights to provide these services to all of their selected lessees.
The Justification and Approval for this action will be included as a part of the option exercise notice. The NAICS Code is 531120 and the Size Standard is $38,500,000.00.
This notice serves as the intent to award a single source option pursuant to contract 24362018C0009, and is not a request for competitive proposals, and is not a solicitation or a request for offers. Any response to this notice must show clear and convincing evidence that a prospective offeror can fulfill the requirements of the option, that competition would be advantageous to the Government, and would not violate the occupancy lease or ownership rights of the lessor. A determination by the Government not to compete this procurement is solely within the discretion of the Government. Interested parties should submit a capability statement to the Contracting Officer within three (3) calendar days of the date of this notice. Contractors must be actively registered in SAM (https://www.sam.gov/portal/public/SAM/ ) database to be eligible for award.
