This sole source justification is provided in accordance with Federal Acquisition Regulation (FAR) 13.5 Simplified Procedures for Certain Commercial Products and Commercial Services and specifically under FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6 but still require a justification using the format of FAR 6.303-2. As provided under FAR 13.501, this justification is modified to reflect that the procedures under FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 � Simplified Acquisition Procedures or 41 U.S.C. 1903 � Special Emergency Procurement Authority.
1. Agency and Contracting Activity: The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Region VII �MO.
2. Nature and/or description of the action being approved:
(a) On July 30, 2024, FEMA issued an award on a sole source basis for Level II Armed Security Guard services to REDCON Solutions Group, LLC, Address: 14100 Savannah, GA 31416 using special emergency procedures of other than full and open competition in support of disaster response operations under DR-4803 in the state of Missouri. This action was taken pursuant to FAR 13.501.
REDCON Solutions Group, LLC is an SBA certified Service-Disabled Veteran-Owned Small Business (SDVOSB). Moreover, REDCON was the only contractor that was responsive and able to confirm their capability to provide immediate guard service support within 24-hours.
(b) Labor Hour contract for Level II Armed Guard service. Base Period of Performance: 30-Days.
(c) Funding: Code 06 Disaster Operational funding for DR 4803-MO.

3. Description of Supplies/Services: Due to the devastation sustained throughout the state of Missouri stemming from the aftermath of tornadoes and flooding in June 2024, several individual federal facilities will be opened within days of award. It is planned that a Joint Field Office (JFO) and several Disaster Recovery Centers (DRC) will be established in the declared counties of Missouri. These federal facilities require a minimum level of security per DHS guidelines immediately upon opening. As a result, Level II Guard services were required immediately to ensure these critical initial response activities could commence. This vital service needs to be in place before the opening of FEMA's first DRC, which is scheduled to open on Wednesday, July 31, 2024. Immediate award of this contract was necessary to meet the needs for personnel, facility, and asset protection until a longer-term contract can be awarded.

The period of performance and proposed value of this contract is as follows:
Period of Performance Total Base Period: 30-Days $476,863.20
4. Identification of Statutory Authority permitting Other Than Full and Open Competition:
41 U.S.C 3304(a)(1) implemented by FAR 6.302-2, Unusual & Compelling Urgency
5. Demonstration that the proposed contractor�s unique qualifications or the nature of the acquisition requires use of the authority cited: In the aftermath of the tornados, FEMA is providing emergency assistance to applicants throughout the State of Missouri. As a result of this emergency, unusual and compelling urgency precludes full and open competition and any delay in award of a contract would result in serious injury, financial or other, to the Government. The risks to life, health, and/or safety to the federal employees within Missouri do not permit time to seek competition. The Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Full and open competition need not be provided in accordance with FAR 6.302- 2.
6. Description of Efforts Made to ensure that Offers are solicited from as Many Potential Sources as is Practicable: Adequate sources for competition appear to exist within Missouri, however; due to the urgent and compelling need for security service immediately, there isn�t sufficient time to solicit competition.
The Government is currently taking steps to solicit a long-term solution, which either would be solicited as a local area set-aside within the declared counties of Missouri, or as total small business set-aside, with preference given to local firms. This should be completed prior to the end of the this (30) day base period.
This short-term contract (30 days) will cover the time that the Government needs to award a contract using competitive solicitation while ensuring that personnel, assets and facilities are safeguarded. The estimated date of publication for a competitive solicitation on System for Award Management (SAM.gov) and/or Unison Marketplace is mid-August 2024.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will use recently estimated prices and the Independent Government Cost Estimate (IGCE) to determine the anticipated prices are fair and reasonable. Moreover, the Contracting Officer will also review prices from similar contracts under previous disasters that were determined fair and reasonable based on the competitive process.
8. Description of Market Research Conducted: Market research was conducted utilizing the Internet, Unison Marketplace, and SAM.gov to query contractors on the ability to perform at the level of provisions within the scope of work. The results of the query for capable contractors were typical as this process has warranted many of the same contractors after each market research.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: The Government routinely solicits several commonly used contractors for this type of requirement, however;
the Government genuinely has an urgent and compelling need for security services as a result of this disaster and the recent circumstances.

10. A Listing of the Sources, if any, That Express, in Writing, an Interest in the Acquisition:
There has been no expressed interest from other sources. Adequate sources for competition exist within Missouri, however; due to the urgent and compelling need for security immediately, there is not enough allotted time to solicit competition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required. N/A
