About this file
This document is a Notice of Intent to Sole Source from the Marine Corps Systems Command (MCSC) for spare parts to support the Navy/Marine Expeditionary Ship Interdiction System (NMESIS) Fire Control System and Weapon Control System (WCS) subsystems.
MCSC intends to enter sole-source negotiations and award a contract to Kongsberg Defence & Aerospace AS to provide the required spare parts. This sole-source decision is due to the government's lack of technical data rights in the Naval Launcher Unit, WCS, and missile interfaces necessary for competitive acquisition. The anticipated period of performance is from February 2025 through March 2027, with an estimated award in Q2 FY2025. Responsible parties may submit capability statements within 15 calendar days, but the government has sole discretion on whether to compete this requirement based on the responses received. The applicable NAICS codes are 336414 and 541330.

NOTICE OF INTENT TO SOLE SOURCE
Product Manager (PdM) Navy/Marine Expeditionary Ship Interdiction System (NMESIS)
THIS NOTICE OF INTENT TO SOLE SOURCE IS FOR INFORMATIONAL PURPOSES
ONLY.
Marine Corps Systems Command (MCSC) Program Manager, Ground Weapons Systems (PM GWS), PdM NMESIS, Quantico, VA 22134 intends to enter into sole-source negotiations and subsequently award a contract to Kongsberg Defence & Aerospace AS, Kirkegaardsveien 45, Kongsberg, 3616, Norway (Cage Code N0013) to provide spare parts for sustainment support of the NMESIS Fire Control System and Weapon Control System (WCS) subsystems for GWS equipment using the authority at Federal Acquisition Regulation Part 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.” The United States Government (USG) lacks the technical data rights in the Naval Launcher Unit (NLU), WCS, and missile interfaces required for competitive acquisition. Without the technical data rights, a contractor will not be able to ensure the subsystems properly function together to meet the requirements of the NMESIS system. This effort is estimated for award in the second quarter of fiscal year 2025 with an anticipated period of performance from February 2025 through March 2027.
THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.
This acquisition is being pursued on a sole-source basis under the statutory authority implemented by 10 U.S.C. § 3204(a)(1) “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

Responsible interested parties may submit a capability statement in which they identify their interest and capability to respond to this requirement, which shall be considered by MCSC. Responses must be submitted within 15 calendar days after the date of the publication of this synopsis and identify the potential offeror’s interest and capability to respond to the requirement. The USG will consider all information received by this response date that meet the aforementioned criteria. A determination by the Government not to compete this requirement based upon responses received as a result of this notice is solely within the discretion of the USG.
