Ill. Description of supplies/services required to meet agency needs.
This requirement is to acquire maintenance and sustainment support for the AN/ALM-289 Enhanced Maintenance Test Station (EMTS) Test Program Set (TPS) software and associated test components of the legacy and form, fit, function, and interface (FFFI) redesigned ALQ-172 Line Replaceable Units (LRUs) 1, 2, 4, 7, 8, 9, 10, 12 and 21. This requirement will provide organic test and repair capability for the re-designed LRUs including maintenance and support of associated technical data, technical orders (TOs) and TPSs and Test Procedure Interface Hardware (TPIH) required for test/repair of the new and legacy LRUs.
The AN/ALQ-172 is on the B-52 aircraft as well as various models of the C-130 aircraft used by Air Force Special Operations Command. The L3Harris Technologies Inc. AN/ALQ-172(V) radar jammer is described as a "combat proven" equipment that is installed aboard US Air Force (USAF) B-52H strategic bombers (AN/ ALQ-172(V)2), Special Operations MC-130 H 'Combat Talon 'II' transports (AN/ ALQ-172(V) 1) gunships. System design features include full automation, multiband coverage, simultaneous multiple threat recognition and jamming, digital computer control, "advanced" jamming techniques, a "high" effective radiated power value, threat re-programmability, a high-gain antenna array, a threat warning display, dual Military Standard (MIL-STD)-1553B data bus interfaces and "extensive" built- in test capabilities. An automated diagnostics system allows flight-line crews to run a system self-test and obtain probable cause of
March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 2 of 8 failure down to the shop-replaceable unit level "in minutes." Of the three described configurations, AN/ ALQ-172(V) 1 and (V)2 are fully automatic systems with the two variants differing from one another in the (V)2's use of phased-array antenna technology and its ability to counter mono-pulse radars in addition to the baseline AN/ALQ-172(V) capability against pulse, pulse-Doppler and continuous wave radar threats.
For its part, AN/ ALQ-172(V)3 incorporates in-flight re-programmability, extended frequency coverage (including both 'high' and 'low' band) and an improved threat handling capability while the ECP-93 configuration of AN/ALQ-172(V)l has been upgraded (starting in 1998) with an expanded memory, additional channels and flight-line re-programmability. The AN/ALQ-172 is integrated with the aircraft controls and displays and defensive subsystem to provide the aircrew with protection against radar-directed threats.

The level of security clearance is up to the classified level and no amount of foreign participation in this requirement is required. There is no AMC/AMSC or RMC/RMSC code needed. The NAICS code is 541511. The Government does not own or have access to the complete data set required to fulfill this requirement. The Government has determined that this system is not a commercial item or requirement.
Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number do not apply.
The overall program acquisition strategy for future sustainment is to receive delivery of full production Level 3 LRU drawing packages and associated technical data as well as fully Government owned EMTS and VDATS TPS software source code and hardware which will allow the Government to break barriers to competition and/or allow for organic sustainment on future maintenance and sustainment requirements.
Any and all IP data delivered under this contract with be Government owned unlimited rights.
IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.
This agency's minimum needs can only be satisfied by the unique supplies or services available from only the above cited qualified source that possesses unique capabilities demonstrated as follows :
L3Harris Technologies Inc. is the only vendor with unique capabilities, experience, expertise, and relationships to satisfy the Government's requirements of the TPS for these highly specialized services.
L3Harris Technologies Inc. is the original designer and developer of the AN/ ALQ-172 Countermeasures System. They are currently on contract for the AN/ALQ-172 redesigns ofLRUs -1 , 2, 4, 7, 8, 9, 10, 12, 21 and Radio Frequency Interface Unit (RFIU). The equipment (Government Furnished Equipment (GFE) accountable under contract FA852218C0001required for the redesign effort and development of the TPS is located at L3Harris Technologies Inc.
It is estimated to take over 42 months for another vendor to become familiar and acquire specialized skills with the AN/ALQ-172 system before the vendor could begin a TPS development project. Due to the complex nature of the development of the AN/ ALQ-172 system, another vendor would require an extensive amount of time and financial investment to become familiar with the AN/ ALQ-172 system. There are no commercial vendors for this type of TPS development or repair sustainment. The only source of supply for this development and repair service is the original equipment manufacturer (OEM) for the AN/ALQ-172
March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 8 system. The 42-month estimate is based on the accumulation of time from contract award to completion of System Requirement Review (SRR) for the AN/ ALQ-172 LRU redesign contracts. A new vendor would require this same amount of time or more time to become familiar because the AN/ ALQ-172 components, from Software design to Hardware components, are tightly intermingled with most system documentation, creating barriers to sanitizing information for release. Additionally, the TPS development or repair sustainment requires the vendor to have a comprehensive system knowledge of the AN/ ALQ-172 system architecture which is not available beyond the OEM. Due to obsolescence, another source cannot acquire an EMTS or GFE required to support the setup for the EMTS. The cost and time involved in having another source acquire the equipment and expertise would not be cost effective and feasible.
The Government does not possess a full technical data package for the AN/ ALQ-172(V) System. A contractor must have access to the technical data and have extensive knowledge and expertise of the AN/ ALQ-172 system in order to complete this effort. Due to the lack of completed functional/interface specifications between the LRUs, system knowledge and experience will be required in order to properly stimulate Radio Frequency (RF) and digital and analog signals between the UUTs. A vendor must have expertise on the ALQ-172 theory of operation, greatly above the knowledge of a generic radar or Circuit Card Assembly level expertise. L3Harris Technologies Inc. is the only vendor that possesses the knowledge and expertise of the redesigned AN/ ALQ-172 Countermeasures System.
Harris Corporation is currently developing a FFFI replacement for the LRU hardware. The development contract(s) will result in qualified prototypes and delivery of full Level-3 technical data package for each redesigned LRU. The Government will have full data rights to compete future acquisition of LRU production units. This redesign service requirement does not include any redesigned AN/ ALQ-172 LRU production units but the TPS for repair and sustainment of redesigned units. In order to produce or repair these LRUs, the Government requires the development of new TPS for the VDATS.
The LRUs (LRU-1 , 2, 4, 7, 8, 9, 10, 12, 21 and RFIU) are highly specialized to the AN/ALQ-172 system because the AN/ALQ-172 system provides Situational Awareness (SA) and Self-Protection (SP) capabilities to large aircraft such as B-52 and C-130s. This is a unique capability for the B-52 and C-130 aircraft defense against threats. The AN/ ALQ-172 Electronic Countermeasures (ECM) System has been upgraded over the last 40+ years since its inception in the early 1970s. The system architecture is comprised of three (3) subsystems, pulse (LRU-1 and 2), PD/CW (LRU-4 and 10) and antenna (LRU-7, 8, and 9), in order to meet its requirements with a significantly reduced number ofLRUs. The small footprint of the system requirement resulted in a distributed processing architecture between the subsystems, each performing specialized functions while collaborating with other subsystems. Therefore, internal system interfaces, and other timing requirements between subsystems, LRUs and SRUs are critical factors for the proper integration and full operations of the system. Harris Corporation is the only vendor who has knowledge of the critical factors required to make the system fully operational.
There are currently only select and an extremely limited amount ofredesigned LRUs available (redesigned LRU-10 and LRU-12). A new vendor would not only need knowledge of the AN/ALQ-172 system but would need a redesigned LRU(s) in order to develop the TPS(s). Waiting on availability ofredesigned LRUs would cause an unacceptable delay in meeting mission requirements. Furthermore, the Government does not own the complete data package. It is estimated to take a new vendor over 3.3 years, with a team of 30 personnel to reverse engineer and develop a data package. This estimate is based on the same amount of time required by Harris for the LRU redesign effort. If the Government were to undertake an organic
March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 5 of 8 reverse engineering effort, it is estimated to cost based on 251 ,432 labor hours and 4+years to complete. This is based on the premise of the depot having the available manpower and required skill sets to complete an organic reverse engineering effort. The Air Force Life Cycle Management Center (AFLCMC)/WNY AN/ALQ-172 Operational Safety, Suitability and Effectiveness System Program Office Engineering and 408 SCMS Engineering took a bottom-up drawing reconstruction approach to develop the estimated cost. The estimate was based on an engineering review and analysis of the tasks, which included analyzing, capturing the requirements, and generating all required technical drawings required to develop the data; and the FY24 Depot Maintenance Activity Group (DMAG) Other Major End Item (OMEI) rate was used to calculate labor costs. The estimated time to complete of 4+ years is based on similar duration needed to capture the requirements for the development of TPS since the purpose of the SRR is to generate the top-level requirements and allocate the requirements to the product level which is TPS products.
Due to the critical demand of the legacy LRU's, obsolescence of the legacy LRU's, limited schedule, and cost, it's in the Government's best interest to pursue TPS development and repair sustainment of the redesigned LRUs from the OEM.
Accordingly, L3Harris Technologies Inc. is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing substantial duplication in cost and unacceptable delays that is not expected to be recovered through competition.
V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under FAR 5.202 applies.
A Sources Sought (SS) / Request for Information (RFI) synopsis was posted to SAM.gov on 25 July 2023 with a response date of 25 August 2023 under Solicitation Number F A852223RFIETMS . The SS/RFI requested responses from interested vendors that possess the expertise, capabilities, and experience to meet qualification requirements for this effort. There were no responses to the SS/RFI.
The incumbent, L3Harris Technologies Inc. was determined to be the only capable vendor.
The requirement will be synopsized in SAM.gov in accordance with FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential subcontracting possibility.
VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Based upon (1) certified cost or pricing data provided in the offeror's proposal in accordance with FAR 15.403-4; (2) the program office or expert technical personnel analysis of the offeror's Basis of Estimates;
(3) inputs from the Defense Contract Management Agency, the contracting officer expects to determine the anticipated cost to the Government to be fair and reasonable.

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted 2 January 2023 to 25 August 2023 in accordance with FAR Part 10.001 and 10.002. The Market Research Report was completed on 11 September 2023. The market research techniques used are as follows:
As described in Section V above, a SS/RFI was posted to SAM.gov advising industry of the pending acquisition and soliciting inquiries from interested vendors. The SS/RFI was posted on 25 July 2023 under Solicitation Number FA852223RFIETMS. No interested vendors responded to the SS/RFI.
Queries were conducted within Government databases and various internet searches (SAM.gov and Google) were performed using North American Industry Classification System (NAICS) code 541511 and keywords ALQ-172 repair, Enhanced Maintenance Test Station maintenance, EMTS ALQ-172, AN/ ALM-289 maintenance, and Enhanced Maintenance Test Station TPS support to search for potential vendors. No other potential vendors were identified as capable of meeting these requirements outside of L3Harris Technologies Inc.
A Small Business Administration (SBA) Dynamic Small Business Search (DSBS) query was conducted using keywords ALQ-172 repair, Enhanced Maintenance Test Station maintenance, EMTS ALQ-172, AN/ ALM-289 maintenance, and Enhanced Maintenance Test Station TPS support. This query produced no additional potential vendors .
The EMTS and associated TPSs does not fit the definition of a commercial item as defined in FAR Part
2.101. This item is defined as military unique and is not customarily used by the general public or by non Governmental entities. The Government requires parts that meet an exact form, fit, and function as determined by the specific mission .
The market research concluded L3Harris Technologies Inc. is the only vendor capable of fulfilling the Government's requirement.
VIII. Any other facts supporting the use of Other Than Full and Open Competition.
ITT (now L3Harris) was the prime integrator of the ALQ-172 system and EMTS. L3Harris is currently redesigning the ALQ-172 LRUs for the B-52 aircraft and, as part of this redesign effort, is developing updated EMTS Test Program Sets (TPSs) for each new LRU. These TPSs include the test program software, interface test hardware, and TPS documentation. L3Harris is the only vendor that has the proprietary technical data to fully support this requirement.
L3Harris has been successfully supporting this effort as the contract award incumbent for all previous contract for this effort. They are also the prime designer and integrator for the redesigned ALQ-172 LRUs and EMTS TPSs. L3Harris has all the required equipment and license data rights to perform maintenance and support of the EMTS and all associated hardware & software for this requirement.
March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 7 of 8
IX. List of any sources that expressed, in writing, an interest in the acquisition.
See Section V above.
X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.
The plan to break barriers to competition in the prior J&A was to receive delivery of full production-Level 3 LRU drawing packages and associated technical data as well as fully Government owned EMTS and VDATS TPS software source code and hardware which will allow the Government to break barriers to competition and/or allow for organic sustainment on future maintenance and sustainment requirements.
Delivery of the final redesigned LRU Level 3 technical data and software/hardware is anticipated to occur in 2024. The initial contractor schedule was estimated to complete the MARS redesign effort in 2021 as written in the previous J&A. Due to material shortages, vendor delays, COVID induced supply chain disruptions. The MARS redesign has been delayed until 2024. AFLCMC WNY has Operational Safety, Suitability, and Effectiveness (OSS&E) authority over the ALQ-172 System, and they are currently working on the Life Cycle Sustainment Plan (LCSP) to include the newly redesigned MARS LRUs. These LRUs are expected to be replaced on an attrition basis. It is expected the fleet will maintain both the redesign and legacy LRU s.
Based on the reason for the delay of the Level 3 drawing package, the current J &A does not require higher level approval in accordance with DFARS PGI 206.304(a) (S-70) (ii).
XI. Certification by the Contracting Officer.
As evidenced by my signature above, I certify that this justification is accurate and complete to the best of my knowledge and belief.
XII. Certification by the technical/requirements personnel.
As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
