About this file

This document is a Brand Name/Sole Source Justification for Cable Services at Naval Surface Warfare Center Port Hueneme (NSWC PHD). The justification explains that Spectrum Cable Services is the only compatible provider that can be used with the existing Spectrum-branded digital cable receivers and coaxial cabling infrastructure in the command's buildings 445 and 1392. Spectrum is the only authorized and available coaxial cable carrier service in the local area providing commercial television services to NSWC PHD. If Spectrum services are not provided, the command would lose access to real-time news and information sources that directly affect its mission-related decision-making. The justification cites the need for compatibility with existing equipment, as well as the substantial duplication of costs of approximately $20,000 that would be incurred to install a new cable infrastructure and service provider. The related federal contract opportunity is Solicitation Number 24P0010 for CHARTER/SPECTRUM CABLE SERVICE, which was awarded to CHARTER COMMUNICATIONS OPERATING LLC on 2024-04-12.

Brand Name/Sole Source Justification under $250K

PID Number: 24-SIMACQ-BD3-0048

Department: 104

Company Name/Brand: Spectrum Cable Services

Description of Product, Supplies or Services required to meet the agency’s needs:

This requirement is for Cable Services for buildings 445 and 1392 at NSWC PHD. Cable television services will allow on-site leadership and other users access to real-time news and information sources for situational awareness and updates during real-world events. Cable services allow for military and civilian leadership to stay in touch with current events and for ad hoc viewing of newsworthy events that directly affect the command, local community and Navy.

Identification of Justification Rationale:

☒ The Material or service must be compatible will aspects (Form, Fit, and Function) with existing systems presently installed.

☐ A patent, copyright, proprietary data, or licensing agreement limits competition.

☐ These are “direct replacement(s)” parts/components for existing equipment.

☐ Urgency.

Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). Only one responsible source and no other supplies or services will satisfy agency requirements. IAW FAR 6.303-2(b)(4).

Identification of the Justification Rationale Explained: **If using form, fit, and function, describe the current equipment and how the new item/service must coordinate or interface.

**If using patent, copyright, proprietary data, describe the proprietary data. **If using direct replacement, describe this below.

NSWC Port Hueneme currently has existing Spectrum-branded digital cable receivers and coaxial cabling infrastructure in associated buildings on campus. Spectrum cable is the only compatible service that can be used with these receivers since it is the only available service provider in the local area that provides physical coaxial infrastructure and technical support services to Port Hueneme’s existing broadcast television receivers.

Specific Characteristics of the Item or Service required that Limit the Availability to a Sole Source or Brand Name: **This is the most important section. Explain in detail why this company or brand are the only ones that can meet the requirement.

Spectrum cable is the only authorized, existing and available coaxial cable carrier service in the local area providing commercial television services to NSWC Port Hueneme, specifically within buildings 445 and 1392. Spectrum is also the only provider compatible with the buildings’ existing Spectrum-specific digital cable television receivers. If Spectrum television services are

not provided, PHD leadership will lose access to real-time broadcasts of world and other newsworthy events pertaining to information that could directly affect the Command’s mission related decision-making. If not provided to the Command by Spectrum cable television service provider, the Command would have loss of cable television service until a new service provider completed a new installation. The installation would consist of installing a new cable infrastructure in the ground and in the building to existing and newly designated locations. Any cable installation between buildings requires NSWC PHD to obtain a permit from NAVFAC Public Works, which can take up to 120 days. Further, the new service provider would also have to provide a cable service signal receiver solution since the current cable service signal receiver was provided by Spectrum and only works with Spectrum services. Based on these requirements, if NSWC PHD were required to use another service provider, it would incur a substantial duplication of cost of approximately $20,000 that is not expected to be recovered through competition.

Market Research Conducted:

Mandatory sources were searched with no availability. Online research was conducted to find any other national or regional cable television providers available to provide services through the command’s existing cable infrastructure in the 94043 zip code. Spectrum is the only available and authorized provider of this specific service in the NSWC Port Hueneme local area.

Local area searches for additional cable service providers such as Cox and Xfinity revealed that these providers do not provide services to the local area.

Statement of Actions, if any to Remove Barriers to Competition in the Future:

NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
