A. Information

The State is seeking qualified energy service companies (ESCOs) to submit Statements of Qualifications (SOQ) to be pre-qualified as potential suppliers for as-needed Energy Savings Performance Contracting services for the delivery of energy efficiency and decarbonization projects.

1. Establishment of a Pool of Qualified ESCOs The State is issuing this Request for Qualifications (RFQ) under the authority of Public Utilities Code Section 388. Firms that submit a complete Statement of Qualifications (SOQ) response consistent with the requirements set forth in this RFQ will become members of a Qualified Pool of ESCOs. Firms responding to this RFQ should submit a SOQ as defined in this RFQ. The SOQs will be evaluated to identify the qualified firms that meet the qualifications needed to successfully deliver energy and water conservation projects. The firms selected by this RFQ process will make up the pool of ESCOs.

The Department of General Services (DGS) intends to use the Qualified Pool to participate in energy efficiency project opportunities via RFP. The State has sole discretion over the method by which the Qualified Pool will be used. The Qualified Pool of ESCOs will be in effect for up to three years from the final pool creation and notification date. At any time after the establishment of the Qualified Pool, the State may decide to re-establish a new pool to supersede this one through a new RFQ process.

The ESCOs in the Qualified Pool will have the opportunity, through a Request for Proposal (RFP) selection process, to:

· Conduct energy audits and assessments at selected state facilities

· Propose energy efficiency and decarbonization projects at specified facilities

· Design and implement energy efficiency projects

· Verify energy savings

2. Financing ESCOs selected through an RFP process will develop the sustainability project and work with the State to finance the project through a variety of potential funding options, including but not limited to the following:

· GS$MART: Pronounced "GS Smart," GS $Mart is DGS’ financial marketplace and provides loans for energy efficiency projects.

https://www.dgs.ca.gov/PD/Services/Page-Content/Procurement-Division-Services-List-Folder/Finance-Acquisition-Through-GS-$Mart

· Loans from the DGS-managed Energy Efficient State Property Revolving Fund, a program that is subject to federal requirements.

· On-Bill Financing (OBF) through utility providers.

· Other funding mechanisms, such as grants.

Some of these requirements may entail additional work and expenses that could affect the project cost.

3. Client State Agency Participation DGS implements projects on behalf of state agency clients. The client is the property owner, the agency funding the project, and a key stakeholder.

B. Potential Services

Potential Services that may be awarded by future RFPs to the Qualified Pool are referenced below:

ESCOs may be asked by DGS to identify, develop, design, implement, measure and verify energy efficiency measures (EEMs) to decarbonize, reduce waste and energy consumption, electrify, and make more efficient use of energy and water, for state client agencies. A primary objective of each state agency project is to implement cost effective energy savings measures in which the entire package of measures are self-funded over the required financing term.

Services

A Qualified Pool member must respond to an RFP in order to be considered for a contract award for a specific project.

Services or expertise that may be required in RFPs include:

1. Cooperation among stakeholders.

The firm will work cooperatively with DGS and other entities to identify and assess possible energy efficiency measures. Collaboration may be required with the California Lighting Technology Center at UC Davis, which will be involved in the review of proposals and recommendation of lighting measures appropriate for inclusion in DGS funded projects. Additionally, collaboration with the California Conservation Corp. may be required.

2. Title 24 Energy Code, and other relevant expertise.

The firm shall have ability to document compliance with applicable codes. Firms should have a methodology for approving all Title 24 documentation. Ideally, firms should have one or more Acceptance Testing Technician(s) on staff for lighting controls and mechanical systems. Decarbonization is a priority for the Administration. Lighting projects should adhere to the Design Lighting Consortium Technical Requirements latest version. Additionally, DGS prefers firms with expertise on dark sky provisions and ensure outdoor lighting does not cause light pollution. Furthermore, firm will need to have experience utilizing low global warming potential (GWP) equipment for projects.

3. Utility incentives and Federal tax credits.

The ESCO will coordinate with the service utility (or utilities) and the State and/or through the DGS Investor-Owned Utility (IOU) partnership to obtain any and all available incentives on behalf of the client agency.

4. OSFM/Division of State Architect (DSA) experience.

The firm is expected to attain applicable permits or exemptions/waivers from regulatory agencies including State Fire Marshal and DSA for each project.

5. Project Proposal and/or Initial Audits or Preliminary Assessments (PAs).

If specified in an RFP, these documents could be the basis for project award and will provide preliminary savings calculations and other benefits including decarbonization benefits, and technical approach for the evaluation of project feasibility.

6. Investment Grade Audits (IGAs).

These assessments include a level of detail that will vary depending on the size and complexity of the project site. The detailed requirement of the IGA will be specified in the RFP. The IGA may include, but is not limited to, the following:

a. A clear description of the existing equipment and conditions at the prospective site.

b. Detailed baseline development analysis and end use analysis.

c. Detailed technical descriptions and thorough financial analysis of proposed EEMs.

d. A scope for implementing each recommended EEMs.

e. Estimated annual energy savings and/or decarbonization benefits for each recommendation that provide the basis for the performance assurance.

f. Predicted cost of implementing each recommended EEM.

g. Preliminary design and documentation of all recommended EEMs at a minimum of 30% design.

h. ASHRAE audit as specified in RFP

i. IGA submittal package should include M&V plan, Cx plan, training plan, and O&M plan.

7. Implementation and Construction.

Construction/installation of approved project measures. These services may include implementation schedules, coordination plans, completion of design drawings and project specifications, completion of drawings and operations and maintenance procedure manuals, securing regulatory approvals for permits or construction drawings, progress reporting, and contract documentation.

a. If the State authorizes implementation, then the IGA establishes the scope of work.

b. Construction shall adhere to the General Conditions as noted in RFP.

c. State inspections may be required.

8. Measurement and Verification (M&V) and Monitoring Based Commissioning (MBCx) Protocols.

The following M&V activities may be required, depending on the RFP and magnitude of the project.

a. M&V activities shall align with the Federal Energy Management Program (FEMP): Measurement and Verification for Performance-Based Contracts (Version 4.0) and Supplement to M&V Guidelines: Measurement and Verification for Performance-Based Contracts Version 4.0.

b. These services may include developing a detailed M&V plan establishing a pre-installation baseline, and measurement and verification of post-installation energy use, including a Post-installation M&V Report and optional Annual M&V Reports.

c. Verify operation of the installed equipment or systems. The State may observe M&V activities, review calculations, utility bill records, and other elements of the baseline to confirm that the M&V plan is followed.

9. Project documentation, maintenance and training.

The following services may be required:

a. Printed and digital record documents such as operating manuals in specified formats acceptable to the State.

b. Provide warranty and operation and maintenance (O&M) manuals.

c. Provide video-recorded training to the State’s designated staff

10. Building automation systems controls expertise.

Building Automation Systems (BAS) / Building Management Systems (BMS) systems expertise. Firms will need the ability to incorporate open source software for BAS controls.

11. Commissioning (Cx).

Commissioning of equipment and test results documentation. The contractor may be required to provide Cx services and details on all plans, manuals testing scripts, and a final Cx report.

Additional related services

In addition to the services listed above, ESCOs may be required to include in their RFP proposals an analysis of other cost reduction measures that may not necessarily reduce energy consumption but might reduce costs through fuel switching, electricity load shifting, improving equipment operations, reducing maintenance, or utility rate restructuring opportunities or aligned with Administration directives or policies. Additionally, ESCOs may be required to work with a Demand Response Provider to maximize energy savings associated with time of use rates.
