About this file

This document is an Addendum No. 1 to Request for Proposals (RFP) No. 23RD003 issued by the California Air Resources Board (CARB) for "Air Toxic Pollutants Associated Cancer Health Monetization Research". The RFP seeks experienced and qualified contractors to develop a methodology to quantify and monetize cancer causes due to exposure to toxic air pollutants. The addendum provides responses to questions submitted by interested parties, clarifying requirements around the inclusion of the Bidder Declaration Form (Attachment 9) in both the Technical and Cost Proposals, as well as the approval of subcontractors proposed in the initial response.

The RFP is applicable to the state of California, with the primary jurisdictions being Sacramento County and Sacramento City. Bidders are not required to separately provide costs of subcontracted work, as completing the percentages in Attachment 9 will be sufficient. CARB has also clarified the intent of the Conflict of Interest and Confidentiality Statement, which prohibits contractors' employees from accepting any gifts, benefits, or considerations from the offeror during the project duration.

Questions and Answers

Question #1:

RFP page 15, section III.A.10, Subcontracts/Subcontractors, identifies Attachment 9 (Bidder Declaration Form (GSPD 05-105)) as a required element of the Technical Proposal. Further, RFP page 17, section III.A.11.e., Page Headers and Page Numbering, states that “all pages of the Technical Proposal, including cover pages, Table of Contents, references and resumes, and the Bidder Declaration Form GSPD-05-105 (Attachment 9) shall have” a Technical Proposal specific header and page numbering. However, Attachment 9 also seems to appear as an element of Cost Proposal, specifically - RFP page 18, section III.B.2., Page Headers and Page Numbering, states that “all pages of the Cost Proposal; the Bidder Declaration Form GSPD-05-105 (Attachment 9); and, if applicable, any forms pertaining to socio-economic preferences (SB, MB, or DVBE), shall have” a Cost Proposal specific header and page numbering. Would CARB please confirm that bidders shall include Attachment 9 and, if applicable, any forms pertaining to socio-economic preferences (MB, SB, NVSA, DVBE) as part of its Technical Proposal, utilizing the Technical Proposal header referenced on page 17?

Answer #1:

Please page 17. Page 17 indicates the numbering for the technical proposal, marked Exhibit A – Attachment 1. Please see page 18. Page 18 indicates the numbering for the cost proposal, marked Exhibit B - Attachment 1. Both items shall be included in the proposal as one document. Any Socio-Economic and Preference Programs shall be included in the same document as attachments.

Question #2:

RFP page 15, section III.A.10, Subcontracts/Subcontractors, states that “all subcontracts must be approved by CARB, and no work shall be subcontracted without the prior written approval of the State.”

Would CARB please confirm that any team subcontractors included in the proposal in response to this solicitation will be approved as part of the prime contract award?

Answer #2:

Any contractors identified on Attachment 9 – Bidder Declaration Form (GSPD-05-105), will be considered as part of the prime contractor’s proposal.

Question #3:

RFP page 15, section III.A.10, Subcontracts/Subcontractors, states that “the cost of the subcontract work is to be itemized in the Cost Proposal as described below in the section entitled Cost Proposal Requirements, and not in the Technical Proposal.” Page 18, section B.1.b (part of Cost Proposal Requirements) requires that “all subcontractors proposed to be used for this project must be identified on Attachment 9, Bidder Declaration Form.” Attachment 9 includes Table 2 which only includes spate to provide a percentage of bid price, and not the subcontract cost. Would CARB please confirm that bidders are not required to separately provide costs of subcontracted work, and that completing percentages in Attachment 9 will be sufficient?

Answer #3:

Yes. Percentages listed will be taken as percentage of the total bid price. Per page 74 “Bidder Declaration Instructions “Corresponding % of bid price—Enter the corresponding percentage of the total bid price for the goods and/or services to be provided by each subcontractor. Do not enter a dollar amount.”

Question #4:

RFP pg. 81, Attachment 14, Conflict of Interest & Confidentiality Statement states: “For the duration of my involvement in this Project, I agree not to accept any gift, benefit, gratuity, or consideration, or begin a personal or financial interest in a party who is offering, or associated with an Offeror, on the Project.” If “Offeror” means the contractor submitting a proposal to CARB, then we are confused by the quoted sentence. Is CARB asking Contractor’s employees to certify that they will not receive any benefit or consideration from the Contractor during the period of performance? Please consider revising this prohibition to be more clear and to explain what CARB’s intent is for this restriction.

Answer #4:

Yes, CARB is asking Contractor’s to certify they will not be receiving any benefits or consideration outside of the scope of contract. Per page 81 of the Conflict of Interest & Confidentiality Statement “I certify that I have no personal or financial interest and no present or past employment or activity which would be incompatible with my participation in any activity related to the planning or contract processes for this Project. For the duration of my involvement in this Project, I agree not to accept any gift, benefit, gratuity, or consideration, or begin a personal or financial interest in a party who is offering, or associated with an Offeror, on the Project.” We will not be revising this statement as we believe it is clear in its intent and message.
