Questions and Answers (09/04/2026)
1. Set-aside status – Block 10 of the September 3 revised SF1449 marks the acquisition as unrestricted, and the current SAM.gov record states “No Set Aside Used.” However, responses 2, 6, 9, and 10 of the Questions and Answers state that the acquisition is a total small-business set-aside and that the Nonmanufacturer Rule applies. Please confirm that the September 3 solicitation is unrestricted and that an offeror may furnish compliant ammunition manufactured by either a large or small domestic manufacturer.
It is Unrestricted and Yes manufacturers can be either small or large.
2. FAR 52.219-33 – If the acquisition is unrestricted, please confirm that the Nonmanufacturer Rule does not apply to the resulting unrestricted award.
Yes, it does not apply.
3. Minimum guarantee – Section VI states that the initial Southern, Northern, and Western delivery orders will satisfy the minimum guarantee. Please identify the guaranteed minimum quantity or dollar amount applicable under FAR 52.216-22.
The orders are required the number of cases being requested by the Field Office.
4. Order limitation – FAR 52.216-19 states both a minimum-order threshold and maximum-order limitation of $7,011,116.99. Please confirm whether each individual order is expected to equal $7,011,116.99, or whether the three initial regional orders may be issued for lower amounts.
It can be either lower or higher than the expected dollar amount.
5. Delivery destinations – The solicitation requires FOB Destination pricing but does not identify the destination addresses or allocation by destination. Please provide the destination ZIP codes, anticipated number of delivery points, and quantities allocated to each delivery point for the initial Southern, Northern, and Western orders.
The delivery addresses are updated on the Statement of Work for each Field Office.
6. CLIN 0006 and 0007 spreadsheets – The revised SF1449 and Questions and Answers identify CLIN 0006 as 5.56mm 50-grain semi-jacketed frangible ammunition and CLIN 0007 as .223 Remington 55-grain FMJ ammunition. The attached pricing spreadsheets retain the earlier reversed descriptions. Please confirm that offerors should leave the government spreadsheet descriptions unchanged while identifying the correct offered products in Volume I.
We will keep the descriptions for CLIN 0006 and CLIN 0007 unchanged.
7. Part numbers – Response 11 of the Questions and Answers states that the part numbers should be removed. Please confirm whether offerors should remove the reference part numbers from the pricing spreadsheets or retain them and offer brand-name-or-equal products in the technical volume.
The part numbers will be retained.
8. Submission address – Section V refers to submission to the correct email addresses, but the solicitation identifies only jose.r.munozjr@irs.gov. Please confirm that the complete quotation should be submitted solely to that address.
The quotes are to be submitted via email address: jose.r.munozjr@irs.gov
