PERFORMANCE WORK STATEMENT (PWS)
PEARL HARBOR NAVAL SHIPYARD & IMF (PHNSY&IMF)
DISPOSAL OF DOCKING BLOCKS
1.0 BACKGROUND:
Docking blocks are used during maintenance and repair of Naval vessels. PHNSY&IMF has a large number of docking blocks which are obsolete or unserviceable. Disposal of the docking blocks is beyond the scope of Shipyard operations and resources.
2.0 SCOPE:
2.1 PHNSY&IMF requires a Contractor to completely remove 37 ea. docking blocks as follows:

Onsite demolition of the existing docking blocks shall not be permitted. Contractor shall not be allowed to generate any onsite construction demolition debris or dust during removal of docking blocks.
The docking blocks to be disposed are located at PHNSY&IMF along the shoulder lane of Cushing Street, between Seabee Way and Ingersoll Avenue. Docking blocks may also be located near the intersection of Central Ave. and Leftwich St as well as at the intersection of Lake Erie St and South Avenue. Note that the blocks to be disposed are grouped with existing blocks to remain. Contractor shall safely relocate and return existing blocks as needed for disposal work. Damage to existing blocks to remain shall be replaced by the Contractor at no cost to the government, including all costs to expedite if needed. Work cannot interfere with normal operations. Coordinate with PHNSY TPOC on exact blocks to be removed prior to start of work.
2.2 The Contractor shall provide all labor, equipment, tools and materials to remove the docking blocks and properly dispose of or recycle the material. The Contractor shall have salvage rights to all scrap material generated as a result of the demolition.
3.0 PERFORMANCE REQUIREMENTS:
3.1 The Contractor shall comply with paragraph 7.0 REFERENCES: TABLE B of this PWS.
3.1.1 Safety Plan: The Contractor shall provide a safety plan covering all aspects of safety for this project. All work performed shall be in accordance with applicable Federal, State of Hawaii and OSHA requirements.
3.1.2 The Contractor shall present an Environmental Protection Plan (EPP) as part of the Contractor’s proposal and bid submittal. Appendices I and II outline the various elements that shall be addressed, including testing the docking blocks for the presence of

hazardous material, including lead and asbestos, and environmental mitigation efforts, including nuisance dust control and other steps to be taken to minimize or prevent damage to adjoining structures, on-going PHNSY & IMF operations and injury to personnel working in the vicinity. Once accepted by the Government, the EPP shall become an integral part of the requirements of this PWS.
3.2 Pre-Removal Coordination meeting: The Contractor shall participate in an on-site Pre-
Removal Coordination meeting with the technical point of contact (TPOC) and other Government representatives to coordinate, review and discuss aspects and phases of the removal work, including the EPP and the Contractor’s Safety plan. The Contractor shall provide the Government with the name and contact number for key personnel responsible for the execution of the service during working hours.
3.3 The Contractor shall be responsible for the proper disposal or recycling of all scrap material generated as a result of the removal. Disposal of material shall be in accordance with Federal, State and local laws and regulations. The disposal of material within PHNSY & IMF is prohibited.
3.4 Containment methods should be employed to prevent uncontrolled release of dust or debris outside of the designated construction work area. In addition, temporary barriers should be provided to prevent cars and pedestrian from entering the construction work area. Contractor shall also provide traffic control as needed to facilitate all work.
3.5 The Contractor shall comply with PHNSY crane requirements per Appendix IV
NAVFAC P-307 dated June 2016.
3.6 Prior to commencing work on the project, the Contractor shall obtain all necessary permits, approvals and licenses necessary for the transportation of the material on highway/roads and disposal/recycling.
3.7 The Contractor shall ensure that the site is cleaned of all debris and the ground surface is free of hazards, including tripping, low spots, pot-holes or other uneven conditions resulting from the removal phase of the work.
3.8 Work Phases:
Phase I - Pre-Removal Coordination meeting. Mobilize equipment.
Phase II - Haul-out material.
Phase III - Clean-up and demobilize.

4.0 QUALITY ASSURANCE:
4.1 The Contractor is responsible for implementing and maintaining a Quality Control
Program (QCP) to ensure that the work performed meets or exceeds contract requirements and results in the correction of potential and actual problems. The QCP shall be implemented on the first day of contract performance.
4.2 Periodic Progress Meetings: The Contractor agrees to attend any progress meetings during the contracted period of performance, the TPOC and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the TPOC will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will notify the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
4.3 Environmental/Safety compliance: The Government will monitor the Contractor, to ensure that the Contractor’s EPP is being followed. The TPOC retains the right to stop the Contractor from performing any work that violates environmental or safety regulations; the Contractor shall be in compliance prior to re-commencing the work.
5.0 GOVERNMENT FURNISHED UTILITIES AND SERVICE:
5.1 The Government will not provide any equipment or supplies to the Contractor.
5.2 Utilities: none.
5.3 Services: none.
5.4 Equipment: none.
6.0 CONTRACTOR QUALIFICATIONS:
6.1 The Contractor shall be a licensed Contractor in the State of Hawaii with documented experience in demolishing structures of similar size as those listed in paragraph 2.1. The Contractor shall provide qualified equipment operators to perform all aspects of this work.
6.2 All vehicles provided for performance under this contract shall have current State of
Hawaii permits, licenses, safety checks and insurance. Vehicles shall be clearly marked with the Contractor’s name.
6.3 U.S. Citizenship is required for facility access. The Contractor shall conduct background investigations on personnel who are used in connection with this contract. Only those individuals with favorable investigations shall be utilized on this contract.
6.4 Identification badges shall be worn at all times when performing work, including while attending Government meetings and conferences that may take place outside the facility.
Badge requests for all contractor personnel should be submitted 14 days in advance to the COR prior to the start of work.
6.5 The Contractor performing services shall be required to comply with all Pearl Harbor
Naval Shipyard & IMF rules, regulations, and training that is applicable to conduct, safety, security, and procedures governing site entry and exit.

8.0 CONTRACTOR PERSONNEL.
8.1 The Contractor shall comply with Public Law 105-270, Section 5(2)(A), which states that contractors will not perform inherently governmental functions. Section 5(2)(A) of this Public Law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2)(B), inherently governmental functions include management of Government programs requiring value judgments, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter-intelligence operations. Per Section 5(2)(C), inherent governmental functions DO NOT include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials; or (ii) any function that is primarily ministerial and internal in nature.”
8.2 Contractor personnel shall not establish an employee-employer relationship with
Government personnel under this contract.
8.3 Contractor personnel shall not manage, supervise, or task Government employees or military personnel. Contractor personnel may not make any commitment to non-DoD personnel, including a foreign official, which commits the expenditure of U.S.
Government resources.
8.4 The Contractor shall not provide personal services.
8.5 Contractor personnel will make clear to all individuals they engage with that they are
Contractor employees and not Government employees. When participating and introducing themselves during official events wherein Government, non-Government, or foreign personnel are present, Contractor personnel will identify themselves as employees of the Contractor. Contractor personnel must be clearly identified (i.e.
company shirt, pin, visible company ID, etc.) in a visible location as to who their employer is.
8.6 Facilities may close due to local or national emergencies, administrative closings, or other Government directed facility closings. Contractor access to Government facilities during closures is not permitted.
8.6.1 If a holiday falls on a Saturday, the holiday is observed on the preceding Friday. If a holiday falls on a Sunday, the holiday is observed on the following Monday.
8.6.2 Federal Holidays:

9.0 HOURS OF OPERATION:
9.1 NORMAL HOURS: Work shall be performed during the normal working hours of 0630 to 1500 hours, daily Monday through Friday, excluding Federal Holidays.
9.2 Any work performed outside normal hours shall be coordinated and approved by the
TPOC prior to start of work.
