MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at http://www.msc.usff.navy.mil, under “Contracts,” then “Proforma,” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

PART I-DRYTIME BOXES:
1. Vessel Required:
A. U.S. or foreign flag, self-sustaining vessel(s) (multiple awards up to two vessels or until the government’s needs have been met) capable of carrying a portion of 200,066 square feet (10,154.7 short tons) of cargo (helicopters, wheeled vehicles, tracked vehicles, and breakbulk) from a cargo list described below.
B. Each vessel shall be capable of carrying a minimum of 70,000 square feet of military cargo from the cargo list.
C. Minimum laden speed shall be 15 knots.
D. Cargo List: Contact MSC Contracting for cargo list to be used for stow plan.

Special requirements:
A. Health and Safety Requirements:
1. Owner/Offeror shall provide the MSC Area Commander with any report required under
U.S. Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.
2. Owner/Offeror shall provide in its proposal its company’s health and safety plans for its crew, related to the novel coronavirus for this mission. The plan will become part of the contract.
3. With respect to Restriction of Movement (ROM) procedures/COVID testing provisions, this portion of the plan will be evaluated to ensure it meets or exceeds MSC QMS requirements and provisions as it relates to routine crew rotations; the MSC QMS is available upon request. An unacceptable plan as it relates to routine crew rotations will render an offer ineligible for award. Alternatively, in lieu of having their ROM procedures/COVID testing provisions evaluated as part of contract award, or meeting MSC QMS requirements, an Owner/Offeror may warrant that they will not conduct any routine crew changes during the course of the charter.
4. Any and all costs related to all crew changes/rotations shall be for the responsibility and account of the Owner/Offeror, who shall notify the Contracting Officer not later than two weeks prior to the crew change/rotation.
5. Owner/Offeror is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner/Offeror’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.
6. The Owner/Offeror agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the Owner/Offeror agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
7. The Owner/Offeror agrees to have a minimum of three COVID-19 rapid test kits per crew member onboard the ship upon delivery or upon tendering Notice of Readiness as applicable.
B. Documentation: Upon award, Owner/Offeror will provide open and/or overdue conditions of class, statutory conditions, any short term certificates vice full certificates with reasoning, current deficiencies per category and corrections are planned, any USCG 835’s that are outstanding, and any ABS open ISM findings and/or observations. This is to assist Military Sealift Command in determining the scope of On-hire inspection.

J. Classified Requirement:
a. There is a classified requirement in this solicitation. Owner/Offeror or their representative, with appropriate security clearances in place, must submit to the Contracting Officer a request to review the classified requirement within one business day of the issuance of this solicitation and then must make the necessary arrangements at their expense to view the classified requirement at appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the Contracting Officer does not receive a request on time or if the Owner/Offeror misses the appointment. There is no requirement to review the classified requirement prior to submitting an offer. Not reviewing the requirement prior to submitting an offer will not in and of itself render an offer ineligible for award.
b. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owner/Offeror will be notified if their offers were excluded because of this requirement.
K. Press Release: Owner/Offeror agrees not to issue any press releases related to the charter, post-award, pre-delivery/loading, or post-redelivery/ discharging without the approval of
MSC.
L. Vessel Name Release: For the purpose of obtaining timely country clearance, vessel names under consideration for award may be released, within government channels, prior to contract award.
M. Offer Detail: Owner/Offeror shall explain the capability to meet the requirements for Items
1A, 1B, 1C, 5, 6A2, 6G Part V(m) 1-4, 7, and 6H Part V(n) in their offers. Owner/Offeror shall acknowledge Items 1D, 2, 3, 4, 6A1, 6A3, 6A4-7, 6B, 6C, 6D Part V(i), 6E Part V(j), 6F Part(l), 6I Part V(o), 6J, 6K, 6L, 6M, Part III(c)vi Position Reports, Part III(d)(2) Qualifications, and PART XI (e) a and b in their offer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

PART XI. FAR 52.212-2 EVALUATION -- COMMERCIAL ITEMS (OCT 2014) (tailored pursuant to FAR 12.302(a)) – SPOT CHARTER

“(d) PAST PERFORMANCE. The Government will search Contractor Performance Assessment Reporting System (CPARS) for each offeror’s three most recent and relevant government contracts for the ocean transportation of cargo. While the Government intends to use primarily CPARS to gather information on offerors’ past performance, it reserves the right to consider other sources of relevant information. The Government will not consider the past performance of parent or sister companies, and will only consider the past performance of the offeror. Recency and relevancy are defined in Part X, above, of past performance information. The Government will consider the extent of the offeror’s ability to perform a previous contract successfully in the areas of (A) quality of product or services, (B) timeliness or scheduling of supplies/deliveries, (C) business relations/customer satisfaction, and (D) key personnel and staffing (including subcontractors).
Additionally, the Government will consider past performance with respect to FAR 52.219-8.
Marginal and unsatisfactory ratings or comments will be addressed during discussions, if held.
Absent negative information, a rating of satisfactory will be assigned.”
PART XI(e) PRICE; amend to read as follows:
XI(e)(a) “The offeror’s price proposal will be evaluated based on the value of the charter hire rate(s) offered for the entire charter period of (a) 55 days, price for fuel, and any other pricing elements set forth in the offer. For evaluation purposes, the period of performance will consist of (b) 55 days. Fuel calculations will be based upon (c) 38 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 68 and 70; (d) 00 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 69 and 70; and (e) 17 days in port idle, using the fuel consumption provided in DRYTIME Box 71. The evaluated price will be per vessel offered and will be computed based upon the above costs set forth in the offer, divided by the percentage of the cargo packing list (per vessel) in square feet that can be carried, to formulate a “per percentage, by square feet, of the packing list” rate. Award will be made, if at all, for vessels, starting with the lowest “per percentage, by square feet, of packing list rate,” that collectively can carry 100% of the packing list, or until the Government’s needs have been met, and being technically acceptable with acceptable past performance.”
