This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items. Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the Government contemplates award of a firm fixed price contract resulting from this solicitation.

MSC Strategic Sealift Program Support Office, N103A, requests proposals for one vessel capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available MSC web site at https://www.msc.navy/mil, under “Contracts,” then “Proforma” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

Notes:

(1) Due to increased e-mail security, it may take longer for e-mails to be received in the appropriate in-box, especially when an e-mail is hosted in a foreign country; some e-mails are delayed in excess of hours. Offerors are encouraged to submit offers as soon as possible.

(2) As outlined in relevant Parts IX and X within Proforma, submission of an offer requires the submission of relevant shipyard data information for all Jones Act vessels owned or controlled by the offeror. PART I-DRYVOY BOXES:

1. Vessel Required:

One, U.S. flag, Jones Act-compliant, self-sustaining vessel, or ABS certified tug & barge unit, capable of carrying a minimum of 45 TEUs of containerized ammunition. Vessel or tug/barge unit overall length (LOA) not to exceed 700 ft. / 214 m and laden draft not to exceed 50 ft. / 15.2 m.

2. A. Cargo Description:

20-Foot ISO shipping containers as per packing list.

Average container weight of 19,500 lbs and maximum container weight of 36,400 lbs.

B. Hazardous Material:

The maximum Net Explosive Weight is estimated at 222,000 pounds.

Hazard Classes/Divisions 1.1D – 1.4S.

C. Packing List: Contact MSC Contracting for packing list to be used for stow plan.

D. Load Terms/ Discharge Terms: F.I.O.S.S.

7. Terms/Conditions/Attachments added, deleted or modified:

A. Health and Safety Requirements:

1. Owner/Offeror shall provide the MSC Area Commander with any report required under U.S. Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.

2. Owner/Offeror shall provide in its proposal its company’s health and safety plans for its crew, related to the novel coronavirus for this mission. The plan will become part of the contract.

3. With respect to Restriction of Movement (ROM) procedures/COVID testing provisions, this portion of the plan will be evaluated to ensure it meets or exceeds MSC QMS requirements and provisions as relates to routine crew rotations; the MSC QMS is available upon request. An unacceptable plan as relates to routine crew rotations will render an offer ineligible for award. Alternatively, in lieu of having their ROM procedures/COVID testing provisions evaluated as part of contract award, or meeting MSC QMS requirements, an Owner/Offeror may warrant that they will not conduct any routine crew changes during the course of the charter.

4. Any and all costs related to all crew changes/rotations shall be for the responsibility and account of the Owner/Offeror, who shall notify the Contracting Officer not later than two weeks prior to the crew change/rotation.

5. Owner/Offeror is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner/Offeror’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.

6. Owner/Offeror agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the Owner/Offeror agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.

7. Owner/Offeror agrees to have a minimum of three COVID-19 rapid test kits per crew member onboard the ship upon delivery or upon tendering Notice of Readiness as applicable.

B. Lashing Gear: Vessel must be fully outfitted with container deck fittings, semi-automatic twist locks, stackers, rods, turnbuckles, lashing gear, dunnage, and shifting boards in sufficient quantity to safely stow and secure cargo.

C. Certificates: Provide most recent and complete copies (with endorsements) of the following documents:

1. Company Document of Compliance, or Tug Safety Management System

Certificate (tug/barge), as applicable.

2. Vessel Safety Management Certificate, or ABS Statement of Compliance (tug/barge), as applicable.

3. Vessel International Ship Security Certificate, or Vessel Security Plan (tug/barge), as applicable.

4. Vessel/Tug/Barge Certificate of Inspection (COI) as applicable.

5. Vessel Document of Compliance for the Carriage of Dangerous Goods, or DOT

Hazardous Materials Certificate of Registration (tug/barge), as applicable.

6. Certificate of Documentation (tug/barge)

D. Stow Plan: Provide detailed stow plan, including vessel trim and stability values resulting from the proposed stow plan, using the provided cargo list showing the vessel’s ability to support the requirement. Stow plans may be cross-checked in ICODES for feasibility - to include square footage, weight, trim, and stability issues.

E. Letter of Variance: In accordance with 49 CFR §176.170(b), (e) and U.S. Coast Guard requirement(s), if cargo stowage variances are required, proof of capability (i.e., Letter of Variance) must be provided. If variance is not required, offer must state that no variance is required.

F. Fully Bunkered: Vessel shall be fully bunkered for the voyage.

G. Itinerary: Provide complete mission itinerary to include laydays, arrival and departure at all ports.

H. Forklift: If a barge is offered, a container handling forklift (provided by the contractor) shall be onboard the barge. The container handling forklift will position containers on the barge during upload and discharge operations. Forklift shall be in good working order and have backfire deflectors and a fire extinguisher as stated in DA PAM 385-64, Paragraph 10-3.

I. Self-Sustaining: Government cranes will be used to load cargo at MOTCO. Owner/

Offeror must provide specification of self-sustaining equipment intended for use for this contract to include the capacities.

J. Segregation: Owner/Offeror shall ensure segregation of all loaded munitions containers aboard the vessel in strict conformance with all applicable regulations concerning the safe and proper loading and stowage of Arms, Ammunition, and Explosives (AA&E). Segregation of all commodities within the containers is the responsibility of the shipper.

K. Classified Requirement:

a. There is a classified requirement in this solicitation. Owner/Offeror or their representative, with appropriate security clearances in place, must submit to the contracting officer a request to review the classified requirement within one business day of the issuance of this solicitation and they must then make the necessary arrangements at their expense to view the classified requirement at appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the contracting officer does not receive a request on time or if the Owner/ Offeror misses the appointment.

There is no requirement to review the classified requirement prior to submitting an offer. Not reviewing the requirement prior to submitting an offer will not in and of itself render an offer ineligible for award.

b. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owners/ Offeror will be notified if their offers were excluded because of this requirement.

L. Press Release: Owner/Offeror agrees not to issue any press releases related to the charter, post-award, pre-delivery/loading, or post-redelivery/ discharging without the approval of MSC.

M. Offer Detail: Owner/Offeror shall explain the capability to meet the requirements for items 1, 3, 4, 5, 6, 7A2, 7A3, 7C1, 7C2, 7C3, 7C4, 7C5, 7C6, 7D, 7E, 7G, and 7I in their offer. Owner/ Offeror shall acknowledge items 2A, 2B, 2C, 2D, 3, 4, 5, 6, 7A4-7, 7B, 7F, 7H, 7J, 7K, 7L, 7M, Part III (c)vi Position Reports, and Part III(d)(2) Qualifications, and Call Out Part V(o) in their offer.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. Offerors shall comply with all parts of the solicitation and shall use the guidelines set forth in Part X for submission of offers.

AMEND PART XI(a) TO READ AS FOLLOWS:

(a) The Government will award a contract resulting from this solicitation to the responsible offerors (See Note (1) below) whose technically acceptable proposal with acceptable past performance represents the lowest price to the Government.

NOTE (1): It is emphasized that as an integral part of the award selection a responsibility determination of the offeror will be made in accordance with FAR Part 9.104. Within this determination, the Government will only consider an offeror responsible if it presents a viable, continued capacity to fully provide the contracted services in accordance with the charter, regardless of operating conditions (e.g., conflict or contingency operations). This will be determined using the factors shown in FAR Part 9.104, to include: 1) experience;

2) operational controls; 3) technical skills; 4) satisfactory performance record; and 5) ability to comply with required delivery schedule.

Award preferences for U.S. Flag vessels, for vessels enrolled in the Voluntary Intermodal Sealift Program (VISA, at 77 FEDERAL REGISTER 53963-53965, 04 September 2012, or most current reference), for VISA Participants (see sec. VI.A.2. of VISA), and for domestic shipyard usage (see DFARS 252.247-7026) will be applied to the Government's evaluation of offers. Award will be made, if at all, to an offeror in the highest priority (among those offers received) set forth in Sec.III.A.3. of VISA, in accordance with the award criteria set forth below. If two or more offers exist in the same VISA priority as set forth in Sec. III.A.3. of VISA, award will be made to the lowest price, technically acceptable offeror that has category 1 domestic shipyard usage.

If 50% or more of the cost of overhaul, repair, and maintenance work of an offeror’s covered vessels (see DFARS 252.247-7026(a)) has been conducted within a U.S. shipyard (during the period covering the current calendar year, up to the date of proposal submission, and the preceding four calendar years), the offeror is in “category 1.” All other offerors are in “category 2.”

AMEND PART XI(b) TO READ AS FOLLOWS:

(b) In selecting the lowest price, technically acceptable offer, the following factors, with consideration given to VISA Participation and Domestic Shipyard Usage priority, will be considered:

flag vessels, to include current U.S. flag vessels and vessels to be U.S. flag upon delivery.

AMEND PART XI(d) TO READ AS FOLLOWS:

“(d) Past performance. The government will search contractor performance assessment reporting system (cpars) for each offeror’s three most recent and relevant government contracts for the ocean transportation of cargo. While the government intends to use primarily CPARS to gather information on offerors’ past performance, it reserves the right to consider other sources of relevant information. The government will not consider the past performance of parent or sister companies, and will only consider the past performance of the offeror. Recency and relevancy are defined in Part X, above, of past performance information. The government will consider the extent of the offeror’s ability to perform a previous contract successfully in the areas of (a) quality of product or services, (b) timeliness or scheduling of supplies/deliveries, (c) business relations/customer satisfaction, and (d) key personnel and staffing (including subcontractors). Additionally, the government will consider past performance with respect to far 52.219-8. Marginal and / Unsatisfactory ratings or comments will be addressed during discussions, if held. Absent negative information, a rating of satisfactory will be assigned.”
