This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items. Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the Government contemplates award of a firm fixed price contract resulting from this solicitation.
MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.navy.mil, under “Contracts,” then “Proforma,” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

PART I - DRYTIME BOXES:
1. Vessel Required:
One, U.S. flag vessel capable of carrying a minimum of six (6) 20-feet ISO containers, four (4) of which are comprised of Class 7 and Class 8 hazardous material and 20 boxes (8 ft long x 4 ft wide x 5 feet high each) of Class 4.1 and Class 7 hazardous material, while satisfying cargo compatibility and segregation requirements. Barges are not acceptable for this movement due to the nature of the cargo.
A. Vessel specifications:
(1) Vessel LOA shall not exceed 568 feet.
(2) Vessel cannot have obstructions (cranes, masts, superstructure, etc.) within 20 feet either forward or aft of the area that the container will pass over the side of the ship.
Ships over 350 feet will be docked with their port side against the pier. The side of the ship cannot be 140 feet above the pier level. The maximum depth the cargo can be lowered below the pier level is estimated at 30 feet.
(3) Vessel draft shall not exceed 30 feet when loaded with intended cargo.
(4) Minimum laden speed shall be 15 knots.
B. Cargo specifics and requirements:
(1) In Japan: Loading Four (4) TEUs of HAZMAT (Class 7 and 8), and two (2) additional TEU of general cargo. Heaviest 20-feet ISO container to be no more
20,000 lbs. each.
(2) In Guam: Loading 20 boxes (8 ft long x 4 ft wide x 5 feet high each) of HAZMAT (Class 4.1 and Class 7). Each box to be no more than 4,500 lbs. each.
(3) Vessel must be capable of receiving containerized cargo exactly 239 feet from the 25 feet pier datum marking as shown in Figure 1 (below), Pier 13, Yokosuka, Japan.
The shore portal crane can reach in from the side of the ship up to 56 feet when considering the Yokohama fender contact locations.
(4) Cargo must be stowed with proper segregation and separation below deck and not be double stacked.
(5) The 20-feet cargo containers must be secured with container ISO twist locks in the hold.
(6) Vessel shall have a minimum of 8 sets of additional chains, turnbuckles, ratchet chain binders and straps per TEU container and a minimum of 4 sets of lashing for all other boxes. Minimum working load for acceptable gear is 5000 lbs. The vessel must be able to provide documentation of the ISO lock working load capacity at time of loading.
(7) Vessel crew shall be responsible to install above minimum lashings as requested by the direction of PSNS & IMF personnel.
(8) Vessel’s crew must restrict cargo access from foreign nationals.
(9) Containers will be manifested in accordance with DOT regulations.
(10) Vessel shall present fully bunkered for mission with a minimum 20 days at sea and
10 days in port in addition to fuel safety margins.
(11) Vessel cannot have cocoons that must be removed for unloading and loading operations.

Special requirements:
A. Reporting Requirements
1. Owner shall provide the MSC Area Commander with any report required under U.S.
Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.
2. Owner shall provide in its proposal its company’s health and safety plans for its crew, related to the novel coronavirus for this mission. The plan will become part of the contract.
3. With respect to Restriction of Movement (ROM) procedures/COVID testing provisions, this portion of the plan will be evaluated to ensure it meets or exceeds MSC QMS requirements and provisions as relates to routine crew rotations; the MSC QMS is available upon request. An unacceptable plan as relates to routine crew rotations will render an offer ineligible for award. Alternatively, in lieu of having their ROM procedures/COVID testing provisions evaluated as part of contract award, or meeting MSC QMS requirements, an offeror may warrant that they will not conduct any routine crew changes during the course of the charter.
4. Any and all costs related to all crew changes/rotations shall be for the responsibility and account of the owner, who shall notify the Contracting Officer not later than two weeks prior to the crew change/rotation.
5. Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.
6. The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
7. The ship-owner agrees to have a minimum of three (3) COVID-19 rapid test kits onboard for each crew member upon delivery.
B. Stow Plan: Provide detailed figures of the hold where the cargo containers are to be placed along with the dimensions from the stern of the ship and the sides of the ships to the TEUs and boxes locations in order to be considered for the bid.
C. Certificates: Provide most recent and complete (including proper endorsements) copies of the below documents. Prior to hire, if there are any changes to this documentation or certifications, notification of the changes must be made to the Contracting Officer immediately:
1. Vessel Safety Management Certificate (SMC)
2. Company Document of Compliance
3. Vessel International Ship Security Certificate (ISSC),
4. Vessel Document of Compliance for the Carriage of Dangerous Goods (IMDG)
Certificate
5. U.S. Coast Guard Certification (COI) including all amendments.
6. Company Department of Transportation HAZMAT registration certificate.
7. Prior to arrival at delivery port, HAZMAT Training Certificates of vessel crewmembers who will be conducting cargo operations.
D. Documentation: Upon award, carrier shall provide open and/or overdue conditions of class, statutory conditions, any short term certificates vice full certificates with reasoning, current deficiencies per category and corrections are planned, any USCG 835’s that are outstanding, and any ABS open ISM findings and/or observations. This is to assist Military Sealift Command determine the scope of On-hire inspection.
E. Agent Information: As soon as practical after award, provide Full Style of vessel and load/discharge port agents’ contact information.
F. Classified Requirement:
a. There is a classified requirement in this solicitation. Owners or their representative, with appropriate security clearances in place, must submit to the contracting officer a request to review the classified requirement within one business day of the issuance of this solicitation and then must then make the necessary arrangements at their expense to view the classified requirement at appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the contracting officer does not receive a request on time or if the offeror misses the appointment. There is not a requirement to review the classified requirement prior to submitting an offer. Not reviewing the requirement prior to submitting an offer will not in and of itself render an offer ineligible for award.
b. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owners will be notified if their offers were excluded because of this requirement.
G. Contractor Responsibility: Pursuant to PART III (g)(6) Charterer’s Responsibility;
Contractor shall arrange for lashing/unlashing services at all ports visited under this Charter, with reimbursement for all necessary and reasonable agency fees, all reasonable costs of lashing/unlashing, and port charges in accordance with IV(n) (Port Charges and Expenses) below, II(i) (Payment) above, and IV(y) (Reimbursable Supplies and Services (Charters) below.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
