JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The Naval Sea Systems Command (NAVSEA) Naval Surface Warfare Center, Crane Division (NSWC Crane), Expeditionary Simplified Acquisition Contracting Branch (0234)
2. Description of the Action Being Approved.
Award of a five-year, firm-fixed priced, indefinite delivery indefinite quantity sole source contract to Optics 1, Inc., 2 Cooper LN Bedford, New Hampshire 03110-5966, to procure the SU-290 Pocket Laser Range Finder (PLRF25C) BLE X3 . This contract is for replacement assets that have been damaged or have been determined to be "Beyond Economical Repair" (BER) used in supporting Naval Special Warfare (NSW) Visual Augmentation Systems (VAS) Operators. In accordance with 41 USC 1901, this action will utilize Federal Acquisition Regulation subpart 13.5 for the use of Simplified Procedures for certain commercial items.
3. Description of Supplies/Services.
The Government’s requirement is for the SU-290 Pocket Laser Range Finder (PLRF25C) BLE X3 “Eye Safe Laser Range Finder (ESLRF) Version” 10m Submersible, Part Number 917971 (“PLRF25C”). The PLRF25C required is a direct replacement for Government-owned assets that are BER. The Laser Range Finder is a small, monocular style, handheld, single-button operated, Class I ESLRF with integrated digital magnetic compass and sighting optic. The Government’s plan is to repair PLRFF25Cs or replace PLRF25Cs determined to be BER starting in FY 22 through FY 26. The plan is to purchase quantities up to 42 PLRF25Cs for FY22 and potentially 10-25 each year thereafter for the duration of contract.
This effort is also for non-warranty repair of systems purchased through this contracting action, as well as for the same systems previously purchased and fielded to US Navy Components. Systems are required to replace fielded systems that have been returned for repairs and have been determined to be BER in support of NSW VAS efforts. This effort will also include return of fielded systems for non-warranty repair for ESLRF determined not to be BER. The systems being procured are direct replacements for fielded systems that have been damaged during operational use, including during overseas contingency operations. Optics 1, Inc., is the sole manufacturer of the PLRF25C Laser Range Finder Systems. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The services portion of this contract would include the Test, Teardown, and Evaluation (TT&E) of the PLRF25Cs, as well as repair costs, and represents 13% ($205,000.00) of the total estimated contract cost, $1,564,089.00 as depicted in the below table.

PLRF25C pricing is based on historical costs from a previous contract (N00164-17-D-JQ23).
Pricing for TT&E and repairs is based on historical repair costs for PLRF25Cs found to be BER and estimated return of fielded systems from operating units.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1)Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302-1(c).
5. Rationale Justifying Use of Cited Statutory Authority.
Pursuant to 10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements. Optics 1, Inc. is the only source that can meet the Government’s sustainment requirements without unacceptable delays or the incurrence of substantial duplication of cost. Prior to fielding any Laser device, the Laser Safety Review Board (LSRB) must approve the laser for use. The LSRB has already approved Optics 1, Inc.’s PLRF25C.
In order to find another vendor to provide the requirement, the acquisition process would have to begin with a Capability Development Document (CDD) and Capability Production Document (CPD) prior to initiating a competitive acquisition. Based on technical experience of the required lasers, creating, validating and approving required documents can take up to two years. A competitive acquisition, which includes product samples and best value analysis/formal source selection that would include military personnel, can add an additional two years. As noted above, prior to fielding any Laser device, the LSRB must approve the laser for use. That is a long process that could take up to an additional two years and eventually cost in excess of $50,000.00. At the conclusion of the acquisition phase, the effort would be subject to the production lead time of the contract to receive Low Rate Initial Production (LRIP) systems. LRIPs are then required to be vetted through developmental testing and operational testing to validate the production systems are operationally suitable and effectiveness, in accordance with the validated requirement documents and the performance specification of the contract. This test phase can last up to one year. Upon conclusion of the test phase, sustaining program documents must be generated, validated and approved. This process can take up to one year. In total, it is estimated that to conduct an acquisition with other than the recommended source could take up to eight years, depending on scheduling, as depicted in the table below.
