JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Naval Sea Systems Command (NAVSEA) Naval Surface Warfare Center, Crane Division (NSWC Crane)

2. Description of the Action Being Approved.

The use of other than full and open competition to award of a three–year, firm-fixed price (FFP), indefinite delivery, indefinite quantity supply contract for a Field-Programmable Gate Array (FPGA) Card, part number DSP-PCIe/104-CC FPGA Module, supplied from Sundance Digital Signal Processing Inc. (Sundance DSP), 2591 Range View Lane, Reno, NV 89519-0907. In accordance with 41 USC 1901, this action will utilize Federal Acquisition Regulation subpart 13.5 for the use of Simplified Procedures for certain commercial items.

3. Description of Supplies/Services.

The required FPGA card is a component utilized in the production of the Program Loader Set (PLS) platform. The PLS provides and enhances the capability and performance of software loading requirements for Navy and Marine Corps aircraft with a Program Loader.

The PLS is designed as an integrated system and relies on numerous components working together to incorporate existing capabilities and functionality with provisions for future technology. The total cost of this J&A is $500,000.00 as outlined in the below table.

The above estimated costs are derived from historical procurements of the required FPGA card. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1) [10 U.S.C. 3204(a)(1)], Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302- 1(a)(2)(iii).

5. Rationale Justifying Use of Cited Statutory Authority.

The PLS is designed as an integrated system and relies on numerous components working together to incorporate existing capabilities and functionality with provisions for future technology, while using commercial-off-the-shelf or modified-off-the-shelf assets. As such, the replacement or redesign of any of the major components would require a redesign of the entire PLS system. The specified FPGA Card is the only FPGA Card available to the United States Navy that has been developed, tested, documented, trained on, and safety-certified for use in the PLS. The only known source for the FPGA Card is Sundance DSP because no other FPGA Cards can support the performance, schedule, and operational requirements of the program. The existing designs, drawings, and software code of the FPGA Card are Sundance DSP’s proprietary information.

If the Government were to procure this product from another supplier, it would have to revalidate and possibly redesign the PLS hardware and software to communicate and interface with the new unit. The new card would have to go through environmental testing involving temperature and moisture in both operational and stored configurations. Additionally, the new card would have to be re-tested for functionality on the aircraft, thus consuming valuable mission time for the aircraft and incurring considerable costs.

Below is an estimate of additional costs required to validate an alternative FPGA Card, based on the expertise of the original PLS design team. The development of a new FPGA Card would add the following cost and schedule delays:

The above is exclusive of the timeframe to for the competitive acquisition process and associated costs to include Government personnel evaluating potential sources and new board pricing.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Request for Information (RFI)/Sources Sought was posted on the System for Award Management website on 01 August 2022, in accordance with FAR 15.201, exchanges with industry before receipt of proposals. The posted RFI / Sources Sought announcement, which closed on 15 August 2022, yielded no responses.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible.
