PERFORMANCE WORK STATEMENT

Title: Third Party Data Verification and Validation for McAlester Army Ammunition Plant

1. PURPOSE AND BACKGROUND

The McAlester Army Ammunition Plant (MCAAP) is permitted by the State of Oklahoma to operate RCRA open detonation/open burn hazardous waste treatment sites. Conditions of the permit include periodic multi-media sampling to monitor potential contaminants and third party data verification and validation of the multi-media sampling analyses.

Definitions for data verification and data validation vary. For purposes of this contract, all data verification and data validation activities will be covered under the term: data validation. The term data validation refers to a process during which a body of analytical data is reviewed to evaluate/ensure the quality and reliability of the data. The evaluation is done through a comparison of the data to a set of project acceptance criteria, other established analytical method requirements, and contractual Requirements. The acceptance criteria are established in a manner that will enable the data user, using the data validation report and deliverables, to determine to what degree the data set will meet the intended purpose for a particular project. Data that is generally unfit for use is identified during the data validation process.

2. SCOPE

The MCAAP is requesting a contract to support/perform data validation. The criteria used to perform the data validation will generally be (in this order of priority): the project Quality Assurance Project Plan (QAPP), specified analytical methods/SOPs, then finally the current version of the National Functional Guidelines (NFG), coupled with any Environmental Protection Agency (EPA) Region-specific data validation criteria. If data validation criteria is not available in the QAPP (for a specific QC element to be reviewed), the applicable analytical method or Standing Operating Procedure (SOP) would then be consulted, and so on. If the QAPP contains all the criteria needed to perform data validation (not likely), the methods would not have to be consulted.

3. PERIOD OF PERFORMANCE

The period of performance for this contract are as follows:

Base Period November 15, 2021 – October 14, 2022 Option Period 1 November 15, 2022 – October 14, 2023 Option Period 2 November 15, 2023 – October 14, 2024 Option Period 3 November 15, 2024 – October 14, 2025 Option Period 4 November 15, 2025 – October 14, 2026

Option years may be utilized to cover additional third party data validation of semi-annual multi-media sampling events.

4. WORK LOCATION

The work location for this requirement is at the Contractor’s office location. There is no onsite support for this requirement.

5. PERFORMANCE REQUIREMENTS

There may be projects that are covered under the Department of Defense (DoD) Quality Systems Manual (QSM), with lab work performed by a DoD Environmental Laboratory Accreditation Program (ELAP)-accredited laboratory. In this case, DoD QSM (current version) criteria (within the quality control tables in the applicable QSM appendix) may be inserted in the priority order listed above, after the QAPP. The references containing the criteria for a particular project will be provided at the time of the data validation request (and prior to submission of the data packages). In addition, analytical SOPs employed for a project will be provided prior to data submission as needed (MCAAP in-house explosives analysis SOP for example).

5.1 Objectives

Objective 1 - The Contractor shall perform data validation at the requested Stage as required by MCAAP. There are different stages of data validation for this contract. The stages will be defined as in the EPA document: Guidance for Labeling Externally Validated Laboratory

Analytical Data for Superfund Use - http://www.epa.gov/superfund/policy/pdfs/EPA-540-R-08- 005.pdf. At points in the various data validation stages where evaluations of sample data based on associated blank results are called for, field blanks (when identified) are to be used in the evaluation, as well as laboratory/method blanks.

Objective 2 – The Contractor shall provide draft and final reports as defined in Key Tasks below.

5.2 Specific Tasks/Requirements

Objective 1, Key Task 1 - The Contractor shall perform Stage 1 data validation as requested by MCAAP. Stage 1 is a completeness check to ensure the proper methods were employed, the proper parameters were reported, the final results and associated data (units, quantitation limits, etc.) are reported appropriately, and to address sample condition upon receipt at (and during the time in) the laboratory.

Objective 1, Key Task 2 - The Contractor shall perform Stage 2a and 2b data validation as requested by MCAAP. Stage 2a and 2b includes Stage 1 activities, plus an additional completeness check to ensure all laboratory quality control (QC) measures specified in the quality assurance project plan (QAPP) and analytical method (if/when not covered in the QAPP) have been implemented, and the QC results and mathematical interpretation (percent recoveries, RPD, etc) are within the report and raw data. In addition, that all calibration data and calibration verification results and data (including calibration blanks) are included in the data package. This stage also includes a comparison of the calibration and QC data to QAPP, method, and/or other reference criteria and assessing the degree to which the calibration and QC results met project/method criteria. This stage also includes ensuring the actual sample holding times and sample preservation conditions for the samples can be obtained from the data package;

comparing the actual hold times and preservation conditions to QAPP, method, and regulatory requirements; and assessing the potential effect of any non-compliance on the quality/usability of the results.

Objective 2, Key Task 1 - The Contractor shall provide a Draft Report (Deliverable 1) to the MCAAP Environmental Office point of contact for review and comment within 3 weeks (21 calendar days) of receiving all project lab reports and raw data packages, Electronic Data Deliverables (EDDs), Standing Operating Procedures (SOPs), and the QAPP (if available). The Draft Report will contain draft versions of all items in the Final Report defined in this PWS.

Objective 2, Key Task 2 - The Contractor shall respond to and incorporate Government feedback from the Draft review within 2 weeks (14 calendar days) from receiving the comments from the government to prepare and submit a Final Report (Deliverable 2) to the MCAAP Environmental Office point of contact. The Final Report shall consist of the following:

a. Report (text) narrative, which identifies the project, explains the general procedure followed for the data validation, defines data validation qualifiers (and reason codes that indicate why the qualifier was added), and summarizes the outcome of the data validation by matrix and parameter (for example, a section for Volatile Organic Compounds (VOCs) in soil, a section for VOCs in water, a section for explosives in soil, etc.). The individual matrix/parameter sections should list individual sample points/results that have been qualified as a result of the validation process, and the reasons why. If there are no anomalies/data qualifications for a particular matrix/parameter, the narrative should state this.

The data validation qualifier should include direction of bias, if applicable and if it can be determined (e.g., J+). A data validation report example: if the data validation report shows a data validation code of J- and a reason code of m (due to low matrix spike recoveries, for example), the narrative should discuss that there was a low matrix spike recovery for the matrix/parameter in question, and state the samples associated with the MS failure.

b. Documentation that the requested items within each requested data validation stage were reviewed. This documentation would include any notation of non-compliance for the items. The documentation can be in the form of a checklist or worksheet.

c. Contractor SOPs that cover data validation must be submitted during the contract award process and then afterwards if there are revisions.

6. DELIVERABLES

The contractor shall complete and submit deliverables in accordance with the “Deliverables Table” below. Unless specified in the PWS within the description of the deliverable, all deliverables will be made to the MCAAP Environmental Office point of contact electronically.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Lowest Price, Responsible Offer Technical and past performance, when combined, are NONE. (Contracting Officer state, in accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, when compared to price.)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 days from the end of the period of performance (insert the period of time within which the Contracting Officer may exercise the option).

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days (insert the period of time within which the Contracting Officer may exercise the option); provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days (60 days unless a different number of days is inserted) before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed (5) years, six (6) months from the start of the initial period of performance..

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

(1) Document type. The Contractor shall submit payment requests using the following document type(s): INVOICE 2in1

(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

(ii) For fixed price line items—

(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting

All shipments and deliveries must be at the main gate (truck gate) on or before 3:00 P.M. No shipments will be accepted after 3:00 P.M. unless prior arrangements have been made.

Normal work hours are Monday through Thursday 6:30 A.M. until 5 P.M. Contractors will not be permitted to work on Fridays, Saturdays, Sundays, or legal holidays for any reason, unless otherwise approved by the Contracting Officer. The following legal holidays will be observed:

January 1st 3rd Monday of January 3rd Monday of February Last Monday of May July 4th 1st Monday of September 2nd Monday of October November 11th 4th Thursday of November December 25th
