1 Minimum Qualifications
1.1 Offeror’s Minimum Qualifications
To be considered reasonably susceptible of being selected for award, the Offeror must document in its Proposal that it satisfies the following Minimum Qualifications:
The following minimum qualifications are mandatory. The Contractor shall be capable of furnishing all necessary services required to successfully complete all tasks and work requirements and produce high quality deliverables.
The subjective judgment of the diver is important because of the extensive reliance on visual examinations of structures. Only small (at least 10%) percentages of structural numbers in critical areas are spot checked with cleaning and measurements. Accordingly, each diving team assigned to a work order under this Contract is required to have at least one engineering diver (Engineer-in-charge), who shall be a licensed Professional Engineer, registered and licensed in the State of Maryland, with a degree in civil or structural engineering. The Professional Engineer diver shall be part of the diving crew and should be in the water activity performing inspections for at least 50 percent of all underwater inspection activities for each task assigned under this Contract. All divers (including Supervisors, Tenders and Professional Engineers) shall be:
1. Accredited by the Association of Diving Contractors International;
2. Trained and certified for scuba diving and surface air;
3. Skilled in the use of state- of- the art inspection equipment, including a broad range of viewing, cleaning, and measuring equipment;
4. Comply with US Government Occupational Safety and Health Administration (OSHA) diving standards, delineated in 29 CFR Part 1910; and
5. Have a minimum of three (3) years’ experience, within the past five (5) years, in performing marine structural inspections.
THE REMAINDER OF THIS PAGE IS INTENTIONALLY LEFT BLANK.
2 Contractor Requirements: Scope of Work
2.1 Summary Statement
1. The Maryland Department of Transportation Maryland Port Administration (MDOT MPA) is issuing this Request for Proposals (RFP) to provide all necessary expertise, labor, supervision, materials, and services defined in this Section 2, as specified in this RFP, from a Contract between the successful Offeror(s) and the MDOT MPA to provide diving services o n a work order, as needed basis. These services may include, but are not limited to; diving, hydrographic survey, and underwater imaging services at various locations at the Administration’s marine terminals.
2.1.1 The Contract shall be performed in accordance with the MDOT MPA Terms and Conditions - Contracts for Services, attached hereto as Attachment G and incorporated herein by reference.
2.1.2 The MDOT MPA intends to make a single award as a result of this RFP. See RFP Section 4.9 Award Basis for more Contract award information.
2.1.3 The Contract term shall be from the date the MDOT MPA issues a Notice to Proceed for this Contract until such time as the Contractor exhausts the not-to-exceed amount of $100,000.
2.1.4 An Offeror, either directly or through its subcontractor(s), must be able to provide all goods and services and meet all of the requirements requested in this solicitation and the successful Offeror (the Contractor) shall remain responsible for Contract performance regardless of subcontractor participation in the work.
2.1. Background and Purpose
The MDOT MPA is soliciting competitive sealed proposals to establish a contract for architectural and engineering services to include all labor, materials, equipment, and supervision required to perform diving, hydrographic survey, and underwater imaging services at various locations at the Administration’s marine terminals, on an as-needed basis. An award will be made to the Consultant with the highest technical evaluation provided contract price negotiations are successful. All personnel assigned to work under this contract shall be properly trained and competent. All Consultant’s personnel shall report to the MDOT MPA’s Director of Engineering or designee. The MDOT MPA shall retain the right to assign its own Resident Engineers to perform in whole, or part, the services sought hereunder. All work performed under the contract issued under this RFP shall be done in a manner and method to the complete satisfaction of the MDOT MPA Director of Engineering, and in accordance with generally accepted architectural and engineering practices. Work will be performed in accordance with the attached MDOT Terms and Conditions for Service Contracts (Attachment G) and specifications and all other contract documents.
2.2 Responsibilities and Tasks
The work to be accomplished by Contractor personnel under this contract shall include but not limited to the following subtasks:
A. Scope-of-Work
The Contractor shall perform diving services, including bathymetric and acoustical imaging surveys, as requested through individual task orders requested by the Administration. The scope of work for each task order will be based upon, but not necessary limited to, factors such as the inspection level of effort and purpose, type of survey including bathymetric and acoustical imaging and construction of the structure to be inspected, the function and use of the structure, the structure’s maintenance and repair history, biofouling and deterioration, water depth (52 feet max), temperature, and structure accessibility.
Generally speaking, each task order will consist of an underwater imaging component and/or an underwater inspection with three different levels of inspection as outlined in paragraph B below. A three-man dive team size shall at a minimum consist of at least one Maryland Professional Engineer diver, a dive tender, and another diver. The Professional Engineer shall be part of the diving crew, shall be in the water performing inspections for at least a minimum 50% of all in-water inspection activities, and shall be onsite for the entire duration of every task. The results of each inspection shall be summarized in a formal report.
B. Levels of Effort
For purposes of illustration, task order inspections will generally comprise of one or a combination of all the following three levels:
Level I General Inspection
| Level II | Detailed Inspection |
| Level III | Highly Detailed Inspection |
Level I – General Inspection
The Level I effort is essentially a general inspection “swim-by” overview. It does not involve cleaning of structural elements, which allows the inspection to be conducted rapidly. The Level I effort can confirm as-built structural plans and detect obvious major damage or deterioration due to overstress (collisions, ice), severe corrosion, or extensive biological growth attack. The underwater inspector relies primarily on visual and/or tactile observations (depending on water clarity) to make condition assessments. These observations are made over the specified exterior surface area of the underwater structure whether it is a quaywall, bulkhead, seawall, pile or mooring. Although this is an overview, close attention should be given to conforming or providing information to update available facility drawings and condition evaluations.
Level II – Detailed Inspection
The Level II efforts are complete, detailed investigations of selected components or subcomponents directed toward detecting and describing damaged or deteriorated areas which may be hidden by surface biofouling. Limited deterioration measurements may be obtained. These data are sufficient for gross estimates of facility load capability. Level II inspections will often require cleaning of structural elements. Since cleaning is time consuming, it is generally restricted to areas that are critical or which may be typical of the entire structure. Simple procedures, such as use of calipers and other measuring are commonly used to take physical measurements. Subjective judgments of structural integrity are occasionally made by probing wood with ice picks and by pounding concrete with hammers. A small percentage of more accurate measurements (Level III efforts) taken with sophisticated instruments may be required to statistically validate large numbers of simple measurements and will enable gross estimates to be made of the structure’s integrity. For example, on extensively corroded steel H-piles, a small (a minimum of 10) percentage of piles may receive ultrasonic thickness measurements to determine typical cross-section profiles. The cross-sections determined by these spot checks may be used to determine individual H-pile vertical load capability.
Level III – Highly Detailed Inspection
The Level III effort is a more detailed and thorough investigation to detect the full extent of hidden or interior damage and the loss in material thickness. Recommendations for repairs are estimated based on size of sample examined by a Level III effort. Detailed underwater engineering surveys or 100% Level III effort examination are required to obtain complete information for development of plans and specifications. Level III often requires the use of Non-Destructive Testing (NDT) techniques but may also require the use of partially destructive techniques such as sample coring through concrete and wood structures, physical material sampling, or in situ surface hardness testing. A Level III effort usually requires prior cleaning. The use of NDT techniques is generally limited to key structural areas, areas that may be suspect, or to structural members which may be representative of the total structure.
C. Photo Documentation
Color photographs shall be taken during the inspection to document facility configuration, representative damage, or deterioration, both typical and extraordinary marine biofouling, pile splices or joints, cross-bracing and previous repairs. Photographs shall include samples of structural members at the mud line, tidal zone and midway between both areas. Turbid water conditions can be overcome for close-ups photos by the use of clear water boxes and wide angle and close-up lenses. Underwater television can be useful to document general observations and to have real-time display available on the surface. Color TV is preferable to black and white because the colors provide more distinction between types of corrosion and biofouling than do shades of gray. However, the video image lacks the resolution and color rendition qualities of still photography. Therefore, Color TV should be used to augment color still photography rather than to replace it. Both types of visual records are useful to the structural analyst, particularly one who may not be part of the dive team.
D. Data Collection
Since industry practices for obtaining and recording underwater data vary, the collection of data is standardized as much as possible. The Contractor shall obtain a full set of updated drawings of the facilities and other necessary data required by the inspection team. These include pile plan layouts and cross sections of typical bents. Throughout the inspection, notes shall be taken of all observations by the EIC as well as by the inspecting team. The inspectors shall maintain a daily log of the inspection details. The log shall clearly document the exact location of all observations minimally showing relative elevation along the pile, water depth relative to MLW and location of each pile on the pier as well as all measurement data. Specific test and measurement data shall be recorded manually in formats, which are standardized for easy input to a computer database for the underwater inspection program.
E. Underwater Imaging
When requested, the Contractor shall perform underwater imaging and/or bathymetric surveys to determine mudline depths, locations of debris, and also side scan images. This work shall include all data collection as well as data analysis and manipulation (i.e. stitching together images). The images provided to the MPA shall be linked to GPS coordinates and overlaid on an aerial image.

The Maryland Department of Transportation Maryland Port Administration shall have the right to require that the limits of liability set forth in the above paragraphs hereof be raised if in its sole judgment economic or insurance market conditions warrant. If additional costs are incurred because of raised limits, the pre-approved additional cost shall be added to the Contract Sum.
Without limitation of any other provisions of this contract, if (a) the Contractor's agreement herein to insure or to name as an additional insured the Maryland Department of Transportation Maryland Port Administration and the State of Maryland with respect to contractual liability assumed by the Contractor under the terms of the Contract Documents or otherwise, or (b) any Contract of insurance between the Contractor or any Subcontractor and its insurance company, shall to any extent be or be determined to be void or unenforceable, it is the intention of the parties that such circumstances shall not otherwise affect the validity or enforceability of Contractor's agreements and obligations under the Contract Documents nor the validity or enforceability of such contract of insurance, each of which shall be enforced to the fullest extent permitted by law.
The furnishing of evidence of insurance by certificate or policy copy that is not in conformance with the above requirements shall not constitute a waiver or amendment of the requirements. Any modification or waiver of the requirements is only effective if provided by the Maryland Department of Transportation Maryland Port Administration in writing to the Contractor and agreed to by signature of any authorized Officer of the Contractor.
