JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center (NWSC)

Crane, Spectrum Warfare Contracts Division, Advanced Electronic

Engineering Support Branch (WXMSL).

2. Description of the Action Being Approved

Award of a firm fixed price non-commercial service contract on a limited competition basis to conduct Environmental (climatic) testing, Ship Motion/Vibration testing, and Heavy-weight High

Impact (HI) Shipboard Shock testing on the AN/SLQ-32(V)6 High Gain

High Sensitivity Antenna (Above Deck Assembly) of the Surface

Electronic Warfare Improvement Program (SEWIP) to NTS Technical

Systems (hereafter referred to as NTS), Rustburg, VA or Hi-Test

Laboratories, Inc. (hereafter referred to as Hi-Test), Arvonia, VA.

The ANS/SLQ-32(V)6 is designed for installation on the CG, CVN, DDG, LHA, LSD, and LPD ship classes.

3. Description of Supplies/Services

This procurement is in support of Program Executive Office, Integrated Warfare Systems (PEO IWS2), Above Water Sensors, and will involve three (3) distinct tests as follows,

1) Environmental (Climatic) Testing 2) Heavy-weight HI

Shipboard Shock testing and 3) Vibration Testing of the High

Gain High Sensitivity Antenna (Above Deck Assembly). The HGHS

Antenna had previously failed Environmental (climatic) testing, Ship Motion/Vibration testing, and Heavyweight HI Shipboard

Shock testing. The HGHS Antenna was then redesigned to mitigate water intrusion issues, ship motion/vibration, and heavyweight high impact shock issues, thus requiring a retest.

The estimated dollar value for this procurement is $489,710.00

USING FY20 Navy (OPN) funds. Performance is expected to be completed by September 1, 2021. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The estimated dollar value is identified below:

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). Limited sources of supplies or services with unique capabilities will satisfy agency requirements as set forth in Federal Acquisition Regulation (FAR) 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority

The contractors’ unique qualifications and the nature of the acquisition require use of FAR 6.302-1. NAVSEA Instruction 9491.1C, dated 21 March

1996, remains in force with no updates. It specifies HI shock test requirements for shipboard machinery, equipment and systems in accordance with Military Specification MIL-S-901. The approved facilities are equipped with unique test devices, which are constructed in accordance with BUSHIPS drawing 645-1973904, Floating Shock

Platform, and are approved for MIL-S-901 Shock Testing.

In accordance with NAVSEA Instruction 9491.1C, there are only two approved commercial Heavy-Weight HI Shock test facilities:

- NTS (formerly Dynamic Testing, Inc.) Rustburg, VA.

- Hi-Test Laboratories, Inc., Arvonia, VA.

Approval of an additional commercial facility for HI shock testing would be in accordance with future revisions to NAVSEA Instruction 9491.1C.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Appropriation FY20

OPN $489,710.00

A Request for Information (RFI) was posted on the Federal Business

Opportunities (FEDBIZOPS) website on 25 February 2020. There were no responses received.

The Technical Warrant Holder (TWH) confirmed that the only vendors approved for Heavy-Weight HI Shock testing in accordance with NAVSEA

Instruction 9491.1C are NTS and Hi-Test.

The proposed contract was synopsized on the FEDBIZOPS website on 12

March 2020 and no interest has been expressed to date. No additional market research was conducted because it is not practicable for the reasons discussed in paragraph 5 above.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated cost to the

Government for the services covered by the J&A will be fair and reasonable. The contracting office anticipates to use adequate price competition and may use other cost or price analysis as well as prior contracting history to determine a fair and reasonable price. Defense

Contract Management Agency (DCMA) and Defense Contract Audit Agency

(DCAA) may be utilized to assist in analyzing any cost or pricing data provided.

8. Actions to Remove Barriers to Competition

For the reasons set for in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document outside of the vendors listed. If another potential source emerges as approved by NAVSEA Instruction 9491.1C, NSWC Crane will assess whether competition for future requirements in feasible.
