This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items.
Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the Government contemplates award of a firm fixed price contract resulting from this solicitation.
MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.navy.mil, under “Contracts,” then “Proforma,” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

PART I - DRYTIME BOXES:
1. Vessel Required:
A. One U.S. flag self-sustaining vessel with registry endorsement under 46 CFR § 67.17 capable of carrying a minimum of 900 ammunition TEUs from packing list while satisfying all applicable regulatory HAZMAT segregation and compatibility requirements.
B. Vessel must be capable of 13 knots minimum when laden.
C. Vessel must not exceed a maximum overall length of 304.8 meters (1000 feet) or a laden draft of
8.9 meters (29.5 feet)
Intended Hazardous Material (Without Guarantee). Vessel must provide certification to show it is able to stow Hazard Class 1 material, Divisions 1.1 through 1.4 in all stow areas below and on deck per the vessel Document of Compliance for the Carriage of Dangerous Goods.
Cargo Dimensions:
20-foot ISO containers. Average container weight of 30,000 lbs. Maximum container weight of
39,000 lbs.

Special requirements:
A. Health and Safety Requirements
1. Owner shall provide the MSC Area Commander with any report required under U.S.
Coast Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.
2. Health and Safety Plan: Owner shall provide in its proposal its company’s health and safety plans for its crew related to the novel coronavirus for this mission. While not evaluated, upon award, this plan shall become contractually binding on the owner.
3. Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above, or was otherwise reasonably preventable by following U.S. Coast Guard or Center for
Disease Control COVID-19 guidelines in publication at the time of breach.
4. The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
5. Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the
Owner and not the Charterer.
B. Lashing Gear: Vessel must be fully outfitted with container deck fittings, semi-automatic twist locks, stackers, rods, turnbuckles, lashing gear, dunnage, and shifting boards in sufficient quantity to safely stow and secure cargo.
C. Spreader Bar. Vessel must be equipped with a spreader bar, one per crane, capable of lifting
20-foot containers for each crane, weight tested to 45,000 lbs.
D. Certificates: Provide most recent and complete copies (with endorsements) of the following documents:
a. Company Document of Compliance
b. Vessel Safety Management Certificate
c. Vessel International Ship Security Certificate
d. Vessel Certificate of Inspection (COI)
e. Vessel Certificate of Documentation with Registry Endorsement
f. Vessel Document of Compliance for the Carriage of Dangerous Goods
E. Stow Plan: Provide detailed stow plans using the provided cargo list showing the vessel’s ability to support the requirement. Stow plans may be cross-checked in ICODES for feasibility - to include square footage, weight, trim, and stability issues.
F. Fully Bunkered: Vessels shall be delivered fully bunkered for the charter period.
G. Supercargo. Pursuant to PART VI(k), a minimum of 2 supercargo is required.
H. Self-Sustaining: A contractor-provided mobile crane on vessel can equate to being self-sustaining. Offer must provide specification of self-sustaining equipment intended for use for this contract.
I. Classified requirement. There is a classified requirement in conjunction with this RFP that may eliminate offerors. Offerors who are affected will be given the opportunity during discussions to read/address this requirement provided that affected offerors have appropriate security clearances in place. Offerors not affected will not have a need to know about the requirement regardless of appropriate security clearances being in place.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

AMEND PART XI(a) TO READ AS FOLLOWS:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror (See Note (1) below) whose technically acceptable proposal with acceptable past performance represents the lowest price to the Government. Award preferences for U.S. Flag vessels and for participants enrolled in the Voluntary Intermodal Sealift Program (VISA, at 77 FEDERAL REGISTER 53963-53965, 04 September 2012, or most current reference (see sec. VI.A.2. of VISA) will be applied to the Government’s evaluation of offers. Award will be made, if at all, to an offeror in the highest priority (among those offers received) set forth in sec. III.A.3. of VISA and Section 6.4 of DoD Instruction 4500.57, in accordance with the award criteria set forth below.
NOTE (1): It is emphasized that as an integral part of the award selection a responsibility determination of the offeror will be made in accordance with FAR Part 9.104. Within this determination, the Government will only consider an offeror responsible if it presents a viable, continued capacity to fully provide the contracted services in accordance with the charter, regardless of operating conditions (e.g., conflict or contingency operations). This will be determined using the factors shown in FAR Part 9.104, to include 1) experience, 2) operational controls, 3) technical skills, 4) satisfactory past performance record, and 5) ability to comply with required delivery schedule.
PART XI(e) Price; Amend the following:
XI(e)a. The offeror’s price proposal will be evaluated based on the value of the charter hire rate(s) offered for the entire charter period of (a) 72 days, price for fuel, and any other pricing elements set forth in the offer. For evaluation purposes, the period of performance will consist of (b) 72 days. Fuel calculations will be based upon (c) 56 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 68 and 70; (d) 00 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 69 and 70; and (e) 16 days in port idle, using the fuel consumption provided in DRYTIME Box 71. This will represent the overall price to the Government. The proposed price(s) must be determined to be fair and reasonable..
