This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items.

Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the

Government contemplates award of a firm fixed price contract resulting from this solicitation.

MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.navy.mil, under “Contracts,” then “Proforma,” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

PART I - DRYTIME BOXES:

1. Vessel Required:

One, U.S. flag vessel with the capability to carry a minimum of six 20-feet ISO containers comprised of hazardous material (Class 7 and Class 8) while satisfying cargo compatibility and segregation requirements.

Barges are not acceptable for this movement due to the nature of the cargo.

A. Vessel specifications:

(1) Vessel LOA shall not exceed 568 feet.

(2) Vessel cannot have obstructions (cranes, masts, superstructure, etc.) within 20 feet either forward or aft of the area that the container will pass over the side of the ship would interfere with transferring the container onto or off the ship. Ships over 350 feet will be docked with their port side against the pier. The side of the ship cannot be 140 feet above the pier level. The maximum depth the cargo can be lowered below the pier level is estimated at 30 feet.

(3) Vessel draft shall not exceed 30 feet when loaded with intended cargo.

(4) Vessel shall have a minimum speed of advance of 13 knots.

B. Cargo specific and requirements:

(1) Six (6) TEUs of HAZMAT (Class 7 and 8). Heaviest 20-feet ISO container to be no more 20,000 lbs. each.

(2) Vessel must be capable of receiving containerized cargo 233 feet from the 25 feet pier datum marking as shown in Figure 1 (below), Pier 13, Yokosuka, Japan.

The shore portal crane can reach in from the side of the ship up to 31 feet when considering the

Yokohama fender contact locations.

(3) Cargo must be stowed with proper segregation and separation below deck and not be double stacked.

(4) The 20-feet cargo containers must be secured with container ISO twist locks in the hold.

(5) Vessel is to have min 48 additional chains, turnbuckles, and ratchet chain binders and straps to lash down the containers. Minimum working load for acceptable gear is 5000 lbs. The vessel must be able to provide documentation of the ISO lock working load capacity at time of loading.

(6) Vessel crew will be responsible to install above minimum lashings as requested by the direction of

PSNS & IMF personnel.

(7) Containers shall not be stowed less than 18 inches side-to-side to allow for rigging removal.

There are no end-to-end container spacing requirements.

(8) Vessel’s crew must restrict cargo access from foreign nationals.

(9) Containers are considered government property and will be manifested in accordance with DOT regulations.

(10) Vessel shall present fully bunkered for mission with a mininum 14 days at sea and 10 days in port in addition to fuel safety margins.

A. Health and Safety Requirements

(1) Owner shall provide the MSC Area Commander with any report required under U.S. Coast

Guard Marine Safety Information Bulletin 02-20 (Change 3) (requiring hazardous conditions be reported), prior to entering the port.

(2) Health and Safety Plan: Owner shall provide in its proposal its company’s health and safety plans for its crew related to the novel coronavirus for this mission. While not evaluated, upon award, this plan shall become contractually binding on the owner.

(3) Owner is advised that due to the time-sensitive and critical nature of the mission, including environmental factors, the Excusable Delay provision shall not apply if delay was caused by a breach of Owner’s Health and Safety Plan cited above or was otherwise reasonably preventable by following U.S Coast Guard or Center for Disease Control COVID-19 guidelines in publication at the time of breach.

(4) The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.

(5) Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the Owner and not the

Charterer.

B. Vessel cannot have cocoons that must be removed for unloading and loading operations.

C. Provide detailed diagrams of vessel deck and compartments, identifying all deck spaces to be provided for loading indicating stowage of the 6 containers with method of securing. Any significant deck obstructions to rigging (e.g. cranes, etc.) must be divulged. Diagrams should indicate the dimensions from the stern of the vessel and the sides of the vessel to the ISO container in relation to

Figure 1 (above).

D. Provide detailed figures of the hold where the cargo containers are to be placed along with the dimensions from the stern of the ship and the sides of the ships to the TEUs and boxes locations in order to be considered for the bid.

E. Provide most recent and complete (including proper endorsements) copies of the below documents.

Prior to hire, if there are any changes to this documentation or certifications, notification of the changes must be made to the Contracting Officer immediately:

(1) Vessel Safety Management Certificate (SMC)

(2) Company Document of Compliance

(3) Vessel International Ship Security Certificate (ISSC),

(4) Vessel Document of Compliance for the Carriage of Dangerous Goods (IMDG) Certificate

(5) U.S. Coast Guard Certification (COI) including all amendments.

(6) HAZMAT Training Certificates of vessel crewmembers conduction cargo operation.

(7) Company Department of Transportation HAZMAT registration certificate.

F. As soon as practical after award provide Full Style of vessel and load/discharge port agents’ contact information.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

PART XI(e) Price; Amend the following:

XI(e)a. The offeror’s price proposal will be evaluated based on the value of the charter hire rate(s) offered for the entire charter period of (a) 24 days, price for fuel, and any other pricing elements set forth in the offer. For evaluation purposes, the period of performance will consist of (b) 24 days. Fuel calculations will be based upon (c) 14 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 68 and 70; (d) 00 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 69 and 70; and (e) 10 days in port idle, using the fuel consumption provided in DRYTIME Box 71. This will represent the overall price to the Government. The proposed price(s) must be determined to be fair and reasonable..
