Section 00 70 00 - Conditions of the Contract
SCOPE OF WORK
STATEMENT OF WORK / SPECIFICATIONS
Leech Lake Dam Tailwater Security Fence
1. General: The contractor shall supply all equipment, labor, supervision, and materials necessary to install a 7-foot high by 45-foot long security fence on each side of the dam directly downstream of the concrete abutment wall.
The U.S. Army Corps of Engineers’ Leech Lake Dam is located near the town of Federal Dam in Cass County, Minnesota. All work shall conform to local, county, and State laws and codes.
2. Measurement and Payment: Payment will be made upon completion and acceptance of the contracted work.
The contractor must submit a detailed invoice to the Section Supervisor, Jeff Steere, for payment at the following address: US Army Corps of Engineers, Mississippi Headwaters Office, PO Box 625, 34385 US Highway 2 West, Grand Rapids, Minnesota 55744 or emailed to
3. Security Fencing: The two sections of security fence shall meet the following specifications:
9-gauge galvanized steel chain link fence 7’ high 45’ long Extension wing shall be 7‘ high by 10‘ long and extend approximately 10’ over the water 3” diameter galvanized steel post buried in the ground 3’ Fence shall have a top, a center and a bottom rail all fastened with wire ties Wire ties shall be galvanized steel Wire ties shall be used to fasten all line posts and rails Fence may be fastened directly to the concrete dam abutment wall There shall not be a gap larger than 4” between the fence and dam abutment wall
4. Contractor Alert: The downstream riverbank is protected with 12” to 18” rock rip rap in the same area as where the new security fence is to be installed. If rocks are removed in-order-to install the fence posts the rock shall be replaced once the fencing work is complete.
5. Completion Date: The security fencing project shall be completed by 1 November 2021

8. Safety: The Contractor shall complete all work according to the Corps of Engineers’ Safety Manual, USACE EM 385-1-1-http://www.usace.army.mil/SafetyandOccupationalHealth/EM38511,2008BeingRevised.aspx.
The dams and recreation areas will remain open during the completion of this work and it is the responsibility of the Contractor to secure the work area from the public.
9. Clean Up. The Contractor shall be responsible for leaving the area in the same condition as when they started.
Disposal of debris shall meet all local, County and State disposal codes.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (NOV 2020)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:
